Available in PDF, EPUB and Kindle. Book excerpt: Wertheimer attempts to move beyond previous theories of coercion by conducting a fairly extensive survey of the way in which cases involving coercion have been treated by American courts. This impressive project occupies the first half of the book, where he makes a convincing case that there is a fairly unified 'theory of coercion' at work in adjudication, past and present. This legal theory, however, is not entirely adequate for the purposes of social and political philosophy, and the last half of the book develops Wertheimer's more comprehensive philosophical theory. Book excerpt: This volume of the series Advances in Risk Analysis consists of papers presented at the 1988 Annual Meeting of the Society for Risk Analysis, which was held October 30 through November 2 at the Mayflower Hotel in Washington, DC. The papers span the gamut of the increasing number of risk assessment topics addressed by the Society since it held its fIrst annual meeting in June 1981, also in Washington DC. Organized to promote interdisciplinary analyses, the Society approaches risks from three broad perspectives: (1) the impact of various risks on the health of the world's populations and on the environment; (2) the social and political implications of specifIc risks, and (3) the management and reduction of risks through the development of a risk analysis methodology and corresponding data bases. The papers included in this volume typify these three approaches and illustrate their interdependence. For example, both cancer and noncancer health risks are examined for a variety of situations that exist within society. The public's perception of risks and the correlation between that perception and the acceptance or nonacceptance of certain risks is also addressed. In addition, the progress to date on predicting and quantifying specifIc risks, including the risks associated with the construction and use of large engineered systems, is reported. Included among the papers are several dealing with recent current issues, such as the impact of California's Proposition 65, hazardous waste disposal, and chemical accidents.

Leadership is often a struggle, and yet strong taboos keep us from talking openly and honestly about our difficulties for fear of looking weak and seeming to lack confidence. But Steven Snyder shows that this discussion is vital—adversity is precisely what unlocks our greatest potential. Using real-life stories drawn from his extensive research studying 151 diverse episodes of leadership struggle—as well as from his experiences working with Bill Gates in the early years of Microsoft and as a CEO and executive coach—Snyder shows how to navigate intense challenges to achieve personal growth and organizational success. He details strategies for embracing struggle and offers a host of unique tools and hands-on practices to help you implement them. By mastering the art of struggle, you’ll be better equipped to meet life’s challenges and focus on what matters most. “Leadership and the Art of Struggle provides you with the opportunity to learn from Snyder’s remarkable wisdom. It is a living guide that you can return to time and time again as new situations arise.” —From the foreword by Bill George, former CEO, Medtronic; Professor of Management Practice, Harvard Business School; and author of the bestselling True North “The leadership book of the year...one of the most intelligent, revealing, and practical books on the subject I have ever read. It confronts a vital truth: that challenge is the crucible for greatness and that these adversities introduce us to ourselves.” —Jim Kouzes, coauthor of the bestselling The Leadership Challenge “Steven Snyder covers all the bases from channeling your energy to managing conflict, including a great segment about overcoming your leadership blind spots...This encouraging book is a must-read!” —Ken Blanchard, coauthor of The One Minute Manager and Great Leaders Grow “Leadership and the Art of the Struggle gives you clear and compelling advice on transforming pitfalls into possibilities.” —Jodee Kozlak, Executive Vice President, Human Resources, Target

Book excerpt: Laura Huang, an award-winning Harvard Business School professor, shows that success is about gaining an edge: that elusive quality that gives you an upper hand and attracts attention and support. Some people seem to naturally have it. Now, Huang teaches the rest of us how to create our own from the challenges and biases we think hold us back, and turning them to work in our favor. How do you find a competitive edge when the obstacles feel insurmountable? How do you get people to take you seriously when they're predisposed not to, and perhaps have already written you off? Laura Huang has come up against that problem many times--and so has anyone who's ever felt out of place or underestimated. Many of us sit back quietly, hoping that our hard work and effort will speak for itself. Or we try to force ourselves into the mold of who we think is "successful," stifling the creativity and charm that makes us unique and memorable. In Edge, Huang offers a different approach. She argues that success is rarely just about the quality of our ideas, credentials, and skills, or our effort. Instead, achieving success hinges on how well we shape others' perceptions--of our strengths, certainly, but also our flaws. It's about creating our own edge by confronting the factors that seem like shortcomings and turning them into assets that make others take notice. Huang draws from her groundbreaking research on entrepreneurial intuition, persuasion, and implicit decision-making, to impart her profound findings and share stories of previously-overlooked Olympians, assistants-turned-executives, and flailing companies that made momentous turnarounds. Through her deeply-researched framework, Huang shows how we can turn weaknesses into strengths and create an edge in any situation. She explains how an entrepreneur scored a massive investment despite initially being disparaged for his foreign accent, and how a first-time political candidate overcame voters' doubts about his physical disabilities. Edge shows that success is about knowing who you are and using that knowledge unapologetically and strategically. This book will teach you how to find your unique edge and keep it sharp.

Book excerpt: Focusing on a matter of continuing contemporary significance, this book is the first work to offer an in-depth exploration of exploitation in the doctor-patient relationship. It provides a theoretical analysis of the concept of exploitation, setting out exploitation’s essential elements within the authors’ account of wrongful exploitation. It then presents a contextual analysis of exploitation in the doctor-patient relationship, considering the dynamics of this fiduciary relationship, the significance of vulnerability, and the reasons why exploitation in this relationship is particularly wrongful. Two case studies – sexual exploitation and assisted dying – are employed to assess what the appropriate legal, ethical and regulatory responses to exploitation should be, to identify common themes regarding the doctor’s behaviour (such as the use of undue influence as a conduit through which to take advantage of and misuse patients), and to illustrate the effects of exploitation on patients. A recurring question addressed is how exploitation in the doctor-patient relationship is and should be dealt with by ethics, regulators and the law, and whether exploitation in this relationship is a special case. The book provides a critical, interdisciplinary evaluation of exploitation in the doctor-patient relationship that will be of interest to health care lawyers, bioethicists, legal academics and practitioners, health care professionals and policymakers.

Book excerpt: Lawyers involved in international commercial transactions know well that unforeseen events affecting the performance of a party often arise. Not surprisingly, exemptions for non-performance are dealt with in a significant number of arbitral awards. This very useful book thoroughly analyzes contemporary approaches, particularly as manifested in case law, to the scope and content of the principles of exemption for non-performance which are commonly referred to as 'force majeure' and 'hardship.' The author shows that the 'general principles of law' approach addresses this concern most effectively. Generally accepted and understood by the business world at large, this approach encompasses principles of international commercial contracts derived from a variety of legal systems. It's most important 'restatements' are found in the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) and the UNIDROIT Principles of International Commercial Contracts (UPICC). Establishing specific standards and "case groups" for the exemptions under review, the analysis treats such recurring elements as the following: contractual risk allocations; unforeseeability of an impediment; impediments beyond the typical sphere of risk and control of the obligor; responsibility for third parties (subcontractors, suppliers); legal impediments (acts of public authority) and effect of mandatory rules; involvement of states or state enterprises; interpretation of force majeure and hardship clauses; hardship threshold test; frustration of purpose; irreconcilable differences; comparison with exemptions under domestic legal systems (impossibility of performance, frustration of contract, impracticability) The book is a major contribution to the development of the use of general principles of law in international commercial arbitration. It may be used as a comprehensive commentary on the force majeure and hardship provisions of the UPICC, as well as on Art. 79 of the CISG. In addition, as an insightful investigation into the fundamental question of the limits of the principle of sanctity of contracts, this book is sure to capture the attention of business lawyers and interested academics everywhere.

The oldest secular Jewish organization in the United States, it was founded in 1843. Thereafter, it followed in the footsteps of its immigrant founders, spreading into the cities, towns, and villages of America, eventually becoming the worldwide order it is today. What is more, B'nai B'rith's physical expansion was paralleled by the scope of its activities. It supports one of the most prominent American Jewish defense organizations, the Anti-Defamation League. Its Hillel Foundations constitute an international network of student activities on college campuses. It sponsors a broad array of learning programs through its Adult Jewish Education Commission. The B'nai B'rith Youth Organization serves the entire Jewish community. It conducts projects and programs in Israel of philanthropic and educational nature, helps finance several national Jewish hospitals and homes for the aged, and supervises an International Council to coordinate its overseas units and to take responsible action on issues relating to world Jewish affairs. And it is partnered in all these activities by B'nai B'rith Women, an independent organization. This is the saga of B'nai B'rith, recounted by Professor Deborah Dash Moore. To elucidate the diverse facets of this venerable, yet youthful, organization and to reveal their integral relationship to the history of the Jews in America, Professor Moore focuses on the moments of innovation that have influenced its development and direction, and on the outstanding individuals who have guided the Order's destiny.

Book excerpt: “[A]n excellent book...” —The Economist Financial Times Asia editor David Pilling presents a fresh vision of Japan, drawing on his own deep experience, as well as observations from a cross section of Japanese citizenry, including novelist Haruki Murakami, former prime minister Junichiro Koizumi, industrialists and bankers, activists and artists, teenagers and octogenarians. Through their voices, Pilling's Bending Adversity captures the dynamism and diversity of contemporary Japan. Pilling’s exploration begins with the 2011 triple disaster of earthquake, tsunami, and nuclear meltdown. His deep reporting reveals both Japan’s vulnerabilities and its resilience and pushes him to understand the country’s past through cycles of crisis and reconstruction. Japan’s survivalist mentality has carried it through tremendous hardship, but is also the source of great destruction: It was the nineteenth-century struggle to ward off colonial intent that resulted in Japan’s own imperial endeavor, culminating in the devastation of World War II. Even the postwar economic miracle—the manufacturing and commerce explosion that brought unprecedented economic growth and earned Japan international clout might have been a less pure victory than it seemed. In Bending Adversity Pilling questions what was lost in the country’s blind, aborted climb to #1. With the same rigor, he revisits 1990—the year the economic bubble burst, and the beginning of Japan’s “lost decades”—to ask if the turning point might be viewed differently. While financial struggle and national debt are a reality, post-growth Japan has also successfully maintained a stable standard of living and social cohesion. And while life has become less certain, opportunities—in particular for the young and for women—have diversified. Still, Japan is in many ways a country in recovery, working to find a way forward after the events of 2011 and decades of slow growth. Bending Adversity closes with a reflection on what the 2012 reelection of Prime Minister Shinzo Abe, and his radical antideflation policy, might mean for Japan and its future. Informed throughout by the insights shared by Pilling’s many interview subjects, Bending Adversity rigorously engages with the social, spiritual, financial, and political life of Japan to create a more nuanced representation of the oft-misunderstood island nation and its people. The Financial Times “David Pilling quotes a visiting MP from northern England, dazzled by Tokyo’s lights and awed by its bustling prosperity: ‘If this is a recession, I want one.’ Not the least of the merits of Pilling’s hugely enjoyable and perceptive book on Japan is that he places the denunciations of two allegedly “lost decades” in the context of what the country is really like and its actual achievements.” The Telegraph (UK) “Pilling, the Asia editor of the Financial Times, is perfectly placed to be our guide, and his insights are a real rarity when very few Western journalists communicate the essence of the world’s third-largest economy in anything but the most superficial ways. Here, there is a terrific selection of interview subjects mixed with great reportage and fact selection... he does get people to say wonderful things. The novelist Haruki Murakami tells him: “When we were rich, I hated this country”... well-written... valuable.” Publishers Weekly (starred): "A probing and insightful portrait of contemporary Japan."
