Contemporary anti-corruption campaigns, however, have led gifts to be viewed with ever-increasing suspicion, because it is feared that the social bonds created by gift giving may contaminate professional decision-making. Suspicious Gifts investigates the sensitive issue of gift exchanges and how they become an object of contention. Malin akerstro;m considers the moral dilemmas presented by bribes and gift giving as experienced by Swedish aid workers and professionals working in the public sector, business, and adoption agencies. She also deals with professionals' interaction with foreign officials or contractors. Often a gift is just that, although sometimes the gift giving may be seen by others as a bribe. akerstro;m highlights the tensions between strict regulations designed to prevent corruption with the human affection for the institution of gift giving. Gift-giving is everywhere governed by social and customary norms before it encounters the law and the giving of gifts takes place largely outside of the marketplace. As a result of these two characteristics, the law of gifts provides an optimal lens through which to examine how different legal systems engage with social practice. The law of gifts is well-developed both in the civil and the common laws. Richard Hyland's study provides an excellent view of the ways in which different civil and common law jurisdictions confront common issues. The legal systems discussed include principally, in the common law, those of Great Britain, the United States, and India, and, in the civil law, the private law systems of Belgium and France, Germany, Italy, and Spain. Professor Hyland also serves a critique of the dominant method in the field, which is a form of functionalism based on what is called the praesumptio similitudinis, namely the axiom that, once legal doctrine is stripped away, developed legal systems tend to reach similar practical results. His study demonstrates, to the contrary, that legal systems actually differ, not only in their approach and conceptual structure, but just as much in the results.

For them, a gift is no exception to this, except for the slight and misleading veil of altruism which covers a purely egoistic motivation. On the other hand, theologians, philosophers and ethicists use a more normative concept of man. Man realises his best potential through deeds of selfless sacrifice that remain unknown to everyone. In reality, however, people are either entirely egoistic nor altruistic. Marcel Mauss' model of the gift is interesting because it seems to escape the classical (or rather, modern) egoism/altruism dichotomy. Gifts are not primarily motivated by the well-being of myself or the other but rather by the desire to bring about or maintain a certain kind of social relation between giver and receiver. Altruistic as well as egoistic motivations are an integral part of that relation. The role of gifts in the constitution of social relations and social cohesion explains why most kinds of gifts are reciprocal and even obligatory. In this book anthropologists, sociologists and economists as well as philosophers focus on the question of the relevance of Mauss' work on the gift for the understanding of actual social phenomena.
