Book excerpt: This User’s Guide is a resource for investigators and stakeholders who develop and review observational comparative effectiveness research protocols. It explains how to (1) identify key considerations and best practices for research design; (2) build a protocol based on these standards and best practices; and (3) judge the adequacy and completeness of a protocol. Eleven chapters cover all aspects of research design, including: developing study objectives, defining and refining study questions, addressing the heterogeneity of treatment effect, characterizing exposure, selecting a comparator, defining and measuring outcomes, and identifying optimal data sources. Checklists of guidance and key considerations for protocols are provided at the end of each chapter. The User’s Guide was created by researchers affiliated with AHRQ’s Effective Health Care Program, particularly those who participated in AHRQ’s DEcIDE (Developing Evidence to Inform Decisions About Effectiveness) program. Chapters were subject to multiple internal and external independent reviews. More more information, please consult the Agency website: www.effectivehealthcare.ahrq.gov)
Book Synopsis User Protection in IT Contracts:A Comparative Study of the Protection of the User Against Defective Performance in Information Technology by : Clarisse Girot
Download or read book User Protection in IT Contracts:A Comparative Study of the Protection of the User Against Defective Performance in Information Technology written by Clarisse Girot and published by Kluwer Law International B.V.. This book was released on 2001-03-06 with total page 488 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume considers the theme of the protection of the user in the field of Information Technology, and more specifically in relation to software licences, electronic information services and Internet access services. Litigation in IT usually stems from the users' feeling that their expectations have been frustrated at performance. When dealing with such cases, the courts seem to increasingly take the objective of user protection into account. How is this protection implemented? Is this trend generally desirable? Is this judicial protection excessive? What are the constraints met by IT providers that should be taken into account in litigation? How can the user's position be improved? User Protection in IT Contracts extensively presents the reasons why, and the ways in which national courts may decide a case in favour of the user. Many practical issues are considered in this respect. Which factors appear relevant to deal with liability claims in IT? Are exemption clauses always enforceable? What are the implications of information duties for IT providers? How can general conditions be safely incorporated to a contract? This book exhaustively reviews these and other issues in English, Dutch and French law.

Book Synopsis Institutional Competition between Optional Codes in European Contract Law by : Alexander J. Wulf
Download or read book Institutional Competition between Optional Codes in European Contract Law written by Alexander J. Wulf and published by Springer. This book was released on 2014-05-14 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commission of the European Union has identified divergences between the national contract laws of the Member States as an obstacle to the completion of the European Internal Market and put this issue on its highest political agenda. Alexander J. Wulf analyses and predicts the effects. The study is situated in the context of the recent developments in the discussion on European contract law. The book begins with an introduction to the economic and legal theories that serve as the rationale for the development of the line of argument. These theories are then applied to the issues involved in the current controversy on European contract law. The author develops a model that he uses to analyze the institutional processes of European contract law. Empirical data are employed to test this model and discuss the results. From his analysis the author develops criteria that can serve as a starting point for thinking about the economic desirability of an optional European contract law.

This book was released on 2006-06-07 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report is one of a series of studies by the NAO which examine key factors involved in improving project performance in defence equipment procurement, with the aim of establishing best practice in relation to a theoretical 'gold standard' developed by assessing and comparing results of overseas and commercial operations. Following on from the first report in the series (HCP 30, session 2005-06, ISBN 0102932611) which identified the contract as a key component of project control, this report sets out recommendations on how the Ministry of Defence and its industry partners can best use the contract to maximise the likelihood of successful project outcomes. (It does not examine methods (competitive or otherwise) the MoD might pursue to select a potential supplier, as the effective use of competition will be the subject of a future report). More information on the evidence underlying the recommendations in this report and the gold standard criteria developed can be found on the website: www.naodefencevfm.org

Available in PDF, EPUB and Kindle. Book excerpt: This comprehensively rewritten, updated and extended new edition of this established text focuses on what has become the most important single facet of the quantity surveyor's role - cost management. The scope of the book has been broadened to take account of the widening and more sophisticated cost management and control service that clients now require. The book examines the factors influencing building costs and how the precontract costs can be estimated, analysed and controlled, to ensure that buildings can be completed within the agreed budget and timescale, and be of acceptable quality, function effectively and provide value for money. A new chapter on value management has been added, together with an introductory chapter on cost modelling; the chapter on life cycling costing is extended, while the sections on energy conservation and occupancy costs are expanded. Throughout the text many new case studies, with supporting tables and diagrams, are included in order to enhance the value of this book to the student and the practitioner.
