This book was released on 2005-01-01 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses upon two themes: the definition of 'family' and the impact of the expansion of the concept of 'family' in law: and family fights over wills and estates - what recourse family members may have in challenging an estate. The first part, `The challenge of the "new family" for Law', considers the challenge both in the inter vivos and the postmortem contexts in the United States, Canada, France, the United Kingdom, Australia and New Zealand. A particular focus is upon the dramatic expansion of the definition of family from the traditional nuclear family consisting of a husband, wife and their mutual children to a definition that includes unmarried heterosexual and same sex couples living together and, in some jurisdictions to new kinds of companionate partnerships that are not based on a sexual relationship. In some jurisdictions such developments are simply an expression of sharing responsibility by allocating it in the private domain, as opposed to the public potentially through social welfare; in others, particularly in the United States, it is a defence of fundamental institutions and, with it, a defence of society itself. The second part, 'Family fights over wills and estates', examines the law in Australia, Switzerland, France, Mexico, and the United Kingdom. Its comparison of civil and common law approaches shows how the law expresses the same principle objects - protection of family and obligations towards key family members - but does so from entirely different perspectives; and where the common law which enshrined the notion of testamentary freedom is being qualified through the expanding domain of family provision legislation, the civil law which is based on codified shares and allocated responsibilities expressed through proportionate entitlements in estates, is being qualified through a range of disqualifying and varying mechanisms.

Available in PDF, EPUB and Kindle. Book excerpt: Industrialised countries worldwide have for years been confronting the prospect of a steadily ageing population. This book, first published in 1997, reflects the breadth of research into gerontology and analyses the major themes and issues in the area of ageing and social policy in both an Australian context and from an international comparative perspective. Topics discussed include unemployment, education, and housing for the aged. Added to this is the contemporary influence of multiculturalism and the challenge it poses to policies and programs that must cater for a growing diversity in the ageing population. A special focus is given to the situation of women and Aboriginal Australians and the specific structural disadvantages they face. This book is essential reading for students and policy-makers in sociology, social and public policy, gerontology, and public health.

Book excerpt: Public discussion of population aging usually focuses on the financial burden that increasingly elderly populations will impose on younger generations. Scholars give much less attention to who does the actual work of day-to-day care for those no longer able to care for themselves; and although women are the majority among the elderly, little is heard about gender differences in economic resources or the need for care. This volume is dedicated to giving gender - and a full range of social and cultural differences - their rightful place in these discussions. The authors address, amongst other issues: the worldwide dilemmas of eldercare the structure of income and care provisions for older populations the role of family, marital status, and class in these provisions the impact of polices affecting retirement age the role of social insurance in preventing poverty among elderly women. The essays included address these topics in a myriad of geographical contexts, including South Africa, the US, Palestine, Australia, South Korea, Spain, Germany, and Sweden. The concerns highlighted here also remind us that whether through individual families or social insurance, through family caregivers or paid help, the oldest generation will continue to depend on adults of working age for its well-being. This book was previously published as a special issue of Feminist Economics.

Available in PDF, EPUB and Kindle. Book excerpt: The idea that our society is ageing is a popular source of gloomy predictions for the future. We see today's youth struggling in their mature years to pay for the masses of geriatric baby boomers whose productive years lie far behind. Australia's New Aged shows that this belief is part reality and part myth. While there will be an increase in the proportion of aged people in the next 20 years, this is a temporary phenomenon and it is likely that tomorrow's elderly will quite differently from their parents. Australia's New Aged examines public policy for the aged in the context of an increasingly vocal and active elderly population and cutbacks to health and welfare spending. The authors argue that policy makers have become trapped in a 'social problem' approach to ageing that assumes the elderly are a homogeneous, disadvantaged group with common interests. They examine a range of cases and identify negative consequences of inappropriate assumptions in terms of structural blindness and brutality. They show that this approach is no longer viable and argue that both policy makers and the aged care industry will need to be more sensitive to diversity and more flexible than ever before. Australia's New Aged is essential reading for students, policy makers and anyone working with the aged. John McCallum is Professor of Public Health and Dean of the Faculty of Health at the University of Western Sydney, Macarthur and co-editor of Grey Policy (1990). Karin Geiselhart is a journalist previously employed by the Office for the Status of Women in Canberra.
