Available in PDF, EPUB and Kindle. Book excerpt: All insurance has coverage limits, and insurers usually control whether a case is settled or tried. If the insurer rejects a within-limits settlement offer, the insured bears the risk of an above-limits verdict. In response, virtually every state has imposed a ldquo;duty to settlerdquo; on insurers, which creates incentives for plaintiffs to make at-limits offers and for insurers to accept those offers when expected damages exceed limits. We study the association between the duty to settle, settlement at limits, claim duration, and defense costs using detailed data from Texas for 1988-2005 on closed, commercially insured personal injury claims. We focus principally on medical malpractice suits against physicians, but find consistent evidence for other types of cases. We find strong evidence that the duty to settle affects settlement dynamics. Essentially all physician-defendant cases that settle at-limits are preceded by an at-limits demand. Roughly 20% of physician-defendant cases settle at 90-100% of policy limits (ldquo;broad at-limitsrdquo;) and 13% settle exactly at limits (ldquo;exact at-limitsrdquo;). Broad- and exact-at-limits cases close about five months faster than similar ldquo;below-limitsrdquo; cases -- a roughly 20% shorter time from suit to settlement, controlling for payout and type of harm. Broad- and exact-at-limits cases also have substantially lower defense costs, controlling for case duration and complexity. More broadly, as the payout/limits ratio approaches 1 from below, duration declines (controlling for payout) and defense costs decline (controlling for payout and duration). Payouts above-limits are uncommon; when they occur, insurers are the primary payers. Policy limits alone cannot explain these results; most likely reflect a combination of policy limits and the duty to settle.

Book excerpt: "In this book, I examine every aspect of personal injury litigation, from attracting new clients to jury trials, and beyond. The personal injury laws vary from state to state and between state and federal court. Since 1983, I have been a trial lawyer in Pennsylvania and New Jersey. Much of the information presented involves those experiences. The law in your state may be different. Nevertheless, there is much uniformity throughout the states. The information in this book can be used by personal injury litigants and their counsel in any state. You may have to refer to local sources for the law or practice that applies to your situation". -- INTRODUCTION.

Book excerpt: A layman who witnesses the actual proceedings in a court room would be amazed at how vastly different they are from what he sees in the movies. Likewise, there are a lot of misconceptions that the general public has about the legal profession. To a large extent, this is because cases which attract wide public interest are sensational and involve murder, mayhem and mystery. In general, however, the pursuit of law is a slow, steady process requiring great patience and stamina. Just Black and White is a collection of short stories and articles written by a lawyer who has seen the system at work and still believes in it. It is a set of episodes, escapades and excerpts from his life, along with a few of his random thoughts. It is a delightful read, for lawyer and layman alike. As the author says “Every lawyer has such stories and thoughts. I just wrote about them”
