Book excerpt: Delegated Legislation in Australia, 5th edition provides updated and detailed coverage of all aspects of subordinate legislation, and is an essential reference for legislators, public officials at all levels of government, judicial officers and lawyers. It is the latest addition to the LexisNexis Black and Silver series. Legislation made by various government and other bodies under the authority of an Act of Parliament far exceeds in volume the legislation made by Parliament in the form of statutes. Delegated Legislation in Australia includes a comprehensive overview of why and how delegated legislation is used to impose obligations on both citizens and business, and in what forms such legislation takes. Commentary is provided for each Australian jurisdiction as to the means used by Parliament to review the content of the legislation, and assess and compare the performance of each parliament. Updated material in this edition includes discussion of parliamentary committees, including the effect of the abolition of the Scrutiny of Legislation Committee in Queensland, and the effect of the operation of the new Parliamentary Joint Committee on Human Rights. There is also updated discussion in relation to judicial review, including analysis of a number of new court decisions and the element of proportionality as a ground of review.

Available in PDF, EPUB and Kindle. Book excerpt: Since the International Civil Aviation Convention was concluded in 1944,a great deal has changed in the world of international aviation. Deregulation was introduced in the United States in 1978, the historic Single European Aviation Market was created in 1993, and now the Single Aviation Market of Australia and New Zealand has also been created. Liberalisation and competition has brought unprecedented choice to air transport users. There are no signs that this trend will go into reverse. Many of these efforts have taken place in the context of regional aviation markets from Europe to South America to Africa and across to Asia. Together, they offer a different perspective to the search for a new juridical order in the regulation of international aviation. This book seeks to add to this search. It examines developments in Australasia and argues that Australia, New Zealand and the Single Aviation Market they have established have much to offer the continuing campaign to re-write the constitution and conventions of international aviation.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of sports law in New Zealand deals with the regulation of sports activity by both public authorities and private sports organizations. The growing internationalization of sports inevitably increases the weight of global regulation, yet each country maintains its own distinct regime of sports law and its own national and local sports organizations. Sports law at a national or organizational level thus gains a growing relevance in comparative law. The book describes and discusses both state-created rules and autonomous self-regulation regarding the variety of economic, social, commercial, cultural, and political aspects of sports activities. Self- regulation manifests itself in the form of by-laws, and encompasses organizational provisions, disciplinary rules, and rules of play. However, the trend towards more professionalism in sports and the growing economic, social and cultural relevance of sports have prompted an increasing reliance on legal rules adopted by public authorities. This form of regulation appears in a variety of legal areas, including criminal law, labour law, commercial law, tax law, competition law, and tort law, and may vary following a particular type or sector of sport. It is in this dual and overlapping context that such much-publicized aspects as doping, sponsoring and media, and responsibility for injuries are legally measured. This monograph fills a gap in the legal literature by giving academics, practitioners, sports organizations, and policy makers access to sports law at this specific level. Lawyers representing parties with interests in New Zealand will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative sports law.

Available in PDF, EPUB and Kindle. Book excerpt: This volume arises from the inaugural Public Law Conference hosted in September 2014 by the Centre for Public Law at the University of Cambridge, which brought together leading public lawyers from a number of common law jurisdictions. While those from such jurisdictions share background understandings, significant differences within the common law world create opportunities for valuable exchanges of ideas and debate. This collection draws upon one of the principal sub-themes that emerged during the conference – namely, the the way in which relationships and distinctions between the notions of 'process' and 'substance' play out in relation to and inform adjudication in public law cases. The essays contained in this volume address those issues from a variety of perspectives. While the bulk of the chapters consider topical issues in judicial review, either on common law or human rights grounds, or both, other chapters adopt more theoretical, historical, empirical or contextual approaches. Concluding chapters reflect generally on the papers in the collection and the value of facilitating cross-jurisdictional dialogue.

Book excerpt: The fourth edition of Burrows, Finn and Todd's Law of Contract provides definitive coverage of the law of contract in New Zealand. The clarity and the comprehensive nature of the discussion make this book the first point of reference for the legal practitioner, the law student, and all who are interested in this core field of law. This latest edition maintains and builds upon the exemplary standards set by its predecessors. The fourth edition includes many new and significant cases. Examples include: Nielsen v Dysart Timbers Ltd (2009) (lapse and termination of offers); Vector Gas Ltd v Bay of Plenty Energy Ltd (2010) and Wholesale Distributors Ltd v Gibbons Holdings Ltd (2008) (use of prior negotiations and subsequent conduct in the interpretation of contracts); Attorney-General of Belize v Belize Telecom Ltd (2009) (implication of terms); Tercon Contractors Ltd v British Columbia (2010) (exclusion of liability); Laidlaw v Parsonage (2010) (privity of contract); Sunset Terraces (2011) (privity and third party claims in negligence); Gustav and Co Ltd v Macfield Ltd (2008) (unconscionable bargains); S B Properties Ltd v Holdgate (2011) (assignment of the burden of a contract); Ingram and Knee v Patcroft Properties Ltd (2011) and Mana Property Trustees Ltd v James Development Ltd (2010) (cancellation of contracts); Golden Strait Corporation v Nippon Yusen Kubishika Kaisa (2007) (damages); and Transfield Shipping Inc v Mercator Shipping Inc (The Achilleas) (2009) (remoteness of damage). New legislation also has been enacted. In particular, chapter 8 has been substantially revised in the light of the requirements of the Property Law Act 2007; and the discussion of limitation of actions in chapter 21 now includes the provisions of the Limitation Act 2010. All of the chapters have been revised and updated to take account of these and other developments. Examples where there have been recent and helpful decisions include the discussions of certainty of contract, of conditional contracts after Steele v Serepisos, of misrepresentation and the Fair Trading Act, and of undue influence in the light of Royal Bank of Scotland v Etridge.

Available in PDF, EPUB and Kindle. Book excerpt: The scope of arrangements which provide for some degree of "autonomy" is almost unlimited, as are the norms and means which have been adopted to protect minority rights. Documents on Autonomy and Minority Rights offer examples of some of the unique structures which have been developed to respond to geographic, political, ethnic, linguistic, and other differences under a single sovereignty. They present a broad spectrum of domestic constitutional provisions, statutes, and political agreements, as well as a comprehensive collection of relevant international instruments. The first section includes documents adopted on a global or regional basis to set standards for the protection of minority rights and the rights of indigenous peoples. The second section includes a wide range of national documents related to minority rights and/or autonomy. The last section contains historical documents. The author has written a brief introduction to each document to give the reader unfamiliar with the situation to which a document pertains enough information to consider its context. No single text can be used as a model of autonomy, for every situation is unique. At the same time, however, greater knowledge of a broad range of successful and unsuccessful arrangements may inspire new ideas with which to address conflicts which have claimed tens of thousands of lives in recent years. At the very least, the ingenuity evidenced in some of the documents should encourage experimentation and underscore the need of going beyond the mere recitation of definitions of federalism, consociation, devolution, or other constitutional models. The great variety of institutional arrangements, the detailed provisions developed to resolve particularly difficult local problems, and the flexibility in addressing issues such as revenue-sharing or participation in international organizations, demonstrate that neither "sovereignty" nor "self-determination" need stand in the way of innovative solutions.
