Book excerpt: This open access book represents the first comprehensive, Australia-focused treatment of the problem of false election information disseminated for the purpose of gaining an electoral advantage. It explores cautious legal regulation as the most effective and decisive approach to the issue. In doing so, the book demonstrates that, although experiments with such remedies have met with mixed success elsewhere, they are nevertheless viable, especially in Australia where they have strong public support and are able to withstand constitutional challenge.

Available in PDF, EPUB and Kindle. Book excerpt: Australia has a proud history of being an international leader in electoral administration, and Australian electoral commissions continue to have a professional, non-partisan approach to the management of elections. Yet their independence is constrained by the electoral laws they need to administer, and parliamentary committees charged with the oversight of the conduct of elections do so with a clear partisan bias. Elections are all about winners, but who decides who the winners will be? Voters definitely have a big say, but it is the electoral system that determines how votes translate into seats in parliament. Any changes to the electoral system require the support of those in power, and it is important to question who benefits from electoral reforms. It is not surprising that partisanship plays a role and that governing parties usually benefit, although that is not always the case. This book assesses Australian electoral reforms of the past 30 years using personal interview data and parliamentary debates, to provide a picture of the reform process as well as the outcomes. These issues, such as who gets to vote, the use of postal voting, party registration and vote weighting, have a profound impact on who wins elections. The book also examines Australia's electoral administration, testing for professionalism, independence and integrity.

This book was released on 2012-04-23 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of reform of the House of Lords has a long history since the Parliament Act 1911, and since the House of Lords Act 1999 removed the right of all but 92 hereditary peers to sit in the Lords, there has been a number of initiatives to further the debate on reform. The latest proposals are contained in the draft Bill (Cm. 8077, ISBN 9780101807722) published in May 2011, which was referred to the Joint Committee. In this report the Joint Committee acknowledges the controversial aspects of certain of the proposals and the members of the Committee reflect wider differences of opinion, many of the report's recommendations being decided by a majority. The majority supports the need for an electoral mandate, provided the House has commensurate powers. The current functions and role would continue, but the House would probably seek to be more assertive, to an extent that cannot be predicted. The Committee recommends a House of 450 members, 80% elected on a system of Single Transferable Voting (preferably that used in New South Wales, not the one proposed in the Bill) for a 15 year term. The main sections of the report cover: functions, role, primacy of the Commons and conventions; electoral system, size, voting system and constituencies; appointments, bishops and ministers; transition, salaries, IPSA, disqualification. The Committee recommends that, in view of the significance of the constitutional change, the Government should submit the decision to a referendum.

Available in PDF, EPUB and Kindle. Book excerpt: Political Parties and Elections presents a comparative analysis of the ways in which advanced industrial democracies seek to regulate the activities of political parties in electoral contests. Actual political practice suggests that parties are crucial actors in democratic elections, yet the nature and extent to which parties are regulated, or even recognized, as participants in the electoral process varies greatly among nations. Author Anika Gauja analyzes the electoral laws of five key common law democracies with similar parliamentary and representative traditions, similar levels of economic and political development, yet with significantly different electoral provisions: the United States, the United Kingdom, Canada, Australia, and New Zealand. Using the relationship between law and politics as a lens, the book focuses specifically on the ways in which these jurisdictions seek to regulate the behavior of their political parties as the product of a broader normative vision of how representative democracy ought to function. In its subject matter, comparative scope, and interdisciplinary theoretical framework, this book examines not only electoral law but also ancillary legislation such as funding regulations, associations and corporations law, and constitutional provisions. It also analyzes the case law that guides the interpretation of this legislation. Political Parties and Elections represents an innovative body of research, comparing for the first time the electoral-legal regimes of a significant number of common law nations.

Book excerpt: This book, the 17th in the federal election series and the ninth sponsored by the Academy of the Social Sciences in Australia, provides a comprehensive account of the 2019 Australian election, which resulted in the surprise victory of the Coalition under Scott Morrison. It brings together 36 contributors who analyse voter behaviour, campaign strategies, regional variations, polling, ideology, media and the new importance of memes and digital campaigning. Morrison’s victory underlined the continuing trend toward the personalisation of politics and the loss of trust in political institutions, both in Australia and across western democracies. Morrison’s Miracle is indispensable for understanding the May 2019 Coalition victory, which surprised many observers and confounded pollsters and political pundits.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the problems associated with regulating the funding of political parties and election campaigns in a timely assessment of a topic of great political controversy. From interest in Obama's capacity to raise vast sums of money, to scandals that have rocked UK and Australian governments, party funding is a global issue, reflected in this text with case studies from Australia, Canada, New Zealand, United Kingdom, and the United States. Taking an interdisciplinary approach with leading scholars from politics, geography and law, this text addresses key themes: contributions, spending controls, the role of broadcasters and special interests, and the role of the state in funding political parties. With regulatory measures apparently unable to change the behaviour of parties, why have existing laws failed to satisfy the demands for reform, and what kind of laws are necessary to change the way political parties behave? The Funding of Political Parties: Where Now? brings fresh comparative material to inform this topical and intractable debate, and assesses the wider implications of continuing problems in political funding. This book will be of interest to students and scholars of political science, political theory, policy and law.
