Book excerpt: Excerpt from Studies in the Constitutional History of Tennessee I am not unconscious of the peril of writing of the events of the last forty-five years, but the work would have been incomplete without the considera tion of that period, and I have endeavored to be fair in all respects. I have regarded it as a duty to discuss frankly the insufficiency of the Constitution of 1870, for the present needs of the State, and to criticise freely the excessive conservatism of the people in re taining it so long. I am indebted for valuable assistance to Mrs. John C. Brown and Mr. W. S. Morgan of Nashville. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: In this first comprehensive history of the Tennessee Supreme Court, seven leading scholars explore the role played by the Court in the social, economic, and political life of the state. Charting the evolution and organization of the Court (and its predecessor, the Superior Court of Law and Equity), the authors also assess the work of the Court within the larger context of the legal history of the South. Arranged chronologically, this volume covers the period from statehood in 1796 through the judicial election of 1998 and traces the range of contentious issues the Court has faced, including slavery, Reconstruction, economic rights, the regulation of business, and race and gender relations. The authors also outline the Court's relationship with the Supreme Court of the United States and chronicle the achievements of the Court in public and private law, state constitutional law, property law, criminal justice, and family law. The central themes that emerge include the nature of federalism, the search for judicial independence, and the practice of judicial review. As the authors demonstrate, the work of the Tennessee Supreme Court highlights the importance of state courts to the federal system and illuminates the interplay between regionalism and national norms in shaping a state's legal culture. Indeed, as mediator of conflicts between traditional southern values and national economic and social trends, the Court has generally, if sometimes belatedly, adopted national legal standards. Further, while the Court has tended to defer to the state's legislative decision-making process, it has on occasion assumed a more activist role in order to assert individual rights for Tennessee's citizens. Sponsored by the Tennessee Supreme Court Historical Society, this book is written for anyone interested in Tennessee history in general or legal history in particular. Appendixes include a comprehensive table of cases and biographical information about all the Court's judges. The Editor: James W. Ely Jr. is Milton R. Underwood Professor of Law and professor of history at Vanderbilt University. His books include The Chief Justiceship of Melville W. Fuller, 1888-1910 and The Guardian of Every Other Right: A Constitutional History of Property Rights. He is also the series editor of the six-volume Property Rights in American History.

Available in PDF, EPUB and Kindle. Book excerpt: Tennesseans pioneered innovations in self-government beginning in 1772, and they have continued to do so since the enactment of their first formal constitution in 1796. Over time, Tennessee has adopted, abolished, and changed it's constitution as political and social needs demanded and allowed. In The Tennessee State Constitution, Lewis L. Laska provides a comprehensive introduction to Tennessee's constitution including a history of its development beginning in the 1700s, article-by-article commentary on the constitution itself, and an extensive bibliography of Tennessee constitutional history. This essential guide to the Tennessee constitution also presents valuable commentary on the constitution's preamble and 11 articles including the declaration of rights, the distribution of powers, the executive department, elections, impeachments, the judicial department, state and county officers, militia, disqualification, oaths, bribery of electors, new counties, and miscellaneous provisions. Also included are an annotated bibliography of Tennessee constitutional history including references to pre-statehood compacts, the constitutions of 1796 and 1835, the Civil War, Reconstruction and the 1865 amendments, the constitution of 1870, attempted constitutional reform, and five constitutional conventions from 1953 to 1977. A table of cases completes this unsurpassed reference guide that will be referred to and relied upon by constitutional scholars and students as well as legal historians. Previously published by Greenwood, this title has been brought back in to circulation by Oxford University Press with new verve. Re-printed with standardization of content organization in order to facilitate research across the series, this title, as with all titles in the series, is set to join the dynamic revision cycle of The Oxford Commentaries on the State Constitutions of the United States. The original constitution of Tennessee came into effect on June 1, 1796, concurrent with the state's admission to the Union. A second version of the constitution was adopted in 1835. A third constitution was adopted in 1870 and is the one still in use today, with subsequent amendments.

Book excerpt: Early settlers of the lands destined to become the state of Tennessee proved themselves to be independent thinkers whose actions previewed the coming break with Britain. As early as 1772 the residents worried the British by forming the Watauga Association—a move that an official of the crown called “a dangerous example to the people of America.” This fascinating booklet details the background, proceedings in Congress, and the manifest partisanship behind the disparity in treatment experienced by the 16th state.

Book excerpt: Excerpt from State Constitution-Making, With Especial Reference to Tennessee Correspondents residing in every portion of Tennessee have responded courteously to questions concerning the present tendencies of public opinion in the state in regard to constitutional matters. Dean Charles W. Turner and Dr. J. R. Neal, of the University of Tennessee Law School, Dr. T. W. Glocker of the economics department of the University of Tennessee, Mr. Malcolm McDermott of the Knoxville Bar, and Dr. St. George L. Sioussat, of Vanderbilt University, have very kindly read portions of the manuscript and offered valuable suggestions. Mr. Robert Eugene Cushman, of the Political Science Faculty of the University of Illinois, has not only made possible for the writer the use of the library and other facilities of that University, but has been tireless in his help toward putting in final shape almost every portion of the book. Finally to the writer's mother is due his gratitude for a great deal of incidental assistance, to his father for much helpful criticism, and, most of all, to his sister. Marguerite McClure, for constant and indispensable helpfulness at every stage of the work. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Most Americans are more aware of the workings of the federal government than of their own state government. But these "laboratories of democracy" constitute perhaps the most creative and successful component of the American political experiment. Like each of the states, Tennessee state government has a distinct history and a political culture that reflects that history. This book places Tennessee's modern political institutions in the context of the history and personalities that formed them. They pay special attention to the period after 1978, when three governors left a lasting impression on the direction and culture of the state government. Separate chapters examine the legislative, executive, and judicial branches, explaining how and why Tennessee's political culture differs from other states. The book also explores the ways in which education, health care, corrections, and economic development define much of the government agenda. Additional chapters on the media, political campaigns, and local government provide a backdrop that elucidates more fully how the state government functions. The authors profile many of the personalities who have shaped the state's political agenda. Among these are longtime Senate Democratic Speaker John Wilder; his close ally, Senate Republican Leader Ben Atchley; House Speaker Jimmy Naifeh, son of a Lebanese immigrant; and Bill Snodgrass, who served as State Comptroller for forty-seven years. The book explains how each of these individuals related to three Tennessee governors, Republicans Lamar Alexander and Don Sundquist and Democrat Ned McWherter, whose administrations presided over the state's greatest period of growth and prosperity. Illustrated with photographs and tables, and featuring anecdotal sidebars that illuminate key issues, this book will become the standard text on Tennessee state government and politics for years to come. The Authors: William Lyons is a professor of political science at the University of Tennessee and coauthor of such books as American Government: Politics and Political Culture. John M. Scheb II is a professor of political science and director of the Social Science Research Institute at the University of Tennessee and coauthor of American Constitutional Law, among other books. In partnership with Dr. Lyons, he provides campaign consulting for political candidates and applied survey research for businesses and organizations. Billy Stair is director of communication and community outreach at Oak Ridge National Laboratory. He served for eighteen years in the legislative and executive branches of state government, including eight years as senior policy advisor to the Governor.
