Stefancic and Delgado argue that these professional demands are only symptoms of a deeper problem: the way lawyers are taught to think and reason. Reading the forty-year correspondence between MacLeish and Pound, Stefancic and Delgado draw lessons about the difficulties of attorneys trapped in worlds that give them power, prestige, and affluence but not personal satisfaction, much less creative fulfillment. Long after Pound had embraced fascism, descended into lunacy, and been institutionalized, MacLeish took up his old mentor’s cause, turning his own lack of fulfillment with the law into a meaningful crusade and ultimately securing Pound’s release from St. Elizabeths Hospital. Drawing on MacLeish’s story, Stefancic and Delgado contend that literature, public interest work, and critical legal theory offer tools to contemporary attorneys for finding meaning and overcoming professional dissatisfaction.

This Article is the first to empirically assess whether the recession has made law an unsatisfying career.Relying on survey data from over 11,000 active members of the State Bar of Texas, we find that only 13.5% of all attorneys and 11.5% of full-time attorneys are dissatisfied with their careers. Newer attorneys report greater career dissatisfaction than more experienced attorneys, yet they too are largely satisfied.We also determine using logistic regression that three factors are highly predictive of lawyers' career dissatisfaction: 1) comparatively low incomes; 2) working in private practice as opposed to in government or in a non-profit/public interest setting; and 3) law firm employment in a non-partnership role. Law school debt and lower class rank have only minor effects on career dissatisfaction whereas race, gender, years of practice experience, practice area, and firm size have no independent effects.

Although the proposals advanced by observers differ slightly, the basic premise of the suggested solutions requires law firms to replace (or at least modify) their partnerships with a rational management structure in favor of a centralized leader who can best maximize efficient client service and lawyer satisfaction.Although sound in theory, this paper argues that such a transformation is likely to be extremely difficult, given the current distribution of power within the large law firm. More specifically, a structural conflict exists between the best interests of the firm and the firm's most powerful rainmaking partners because the dominant rainmakers are both mobile and the most powerful actors within law firms. Law firms rely heavily on their most productive star lawyers because these individuals generate a significant amount of revenue and service the firm's most important clients. Consequently, these partners wield a considerable amount of power within the firm. But because the new model requires that power shift from the rainmaking partners to a centralized leader, it is unlikely that the powerful partners will easily relinquish the authority and influence they currently enjoy. Consequently, those attempting to modify the firm's management structure, and therefore alter the distribution of power within the firm, have the arduous task of garnering the approval of the firm's rainmakers since these are the lawyers who are in a position to thwart any proposed transformation.

Book excerpt: For forty years beginning in the late 1960s, the University of Michigan Law School conducted annual surveys of its alumni. The project included fifty successive graduating classes, with all but the most recent classes surveyed more than once. Over thirteen thousand alumni participated. Over the forty years, American legal education and the American legal profession underwent huge changes. When the study began, there were almost no women or minority students at Michigan and very few in the country as a whole. The vast majority of all students and lawyers were white and male. By the end, white men constituted far less than half of the students not only at Michigan but also at the huge majority of other law school in the United States. Similarly at the beginning of the survey, the overwhelming majority of Michigan graduates and law-school graduates in general began their careers in solo practice or in very small law firms. Few firms with more than one hundred lawyers even existed. By the end, more than half of Michigan students started their careers in firms of more than two hundred, and many started in firms of over a thousand.This article focuses on a theme that runs through all the graduating years - the varied satisfaction of graduates with their careers. Our findings, though necessarily limited to one school's graduates, seem likely to apply to the experiences of most practitioners regardless of the school from which they graduated. Some findings may be surprising. We have found, for example, that, among Michigan's graduates five, fifteen and twenty-five years out of law school, for both men and women, overall work satisfaction is much more closely related to perceptions of the social value of their work and the quality of their relations with co-workers than it is to their satisfaction with income or with their prestige in the community. This finding helps make more explicable another of our findings - that, on the whole, women practitioners are somewhat more satisfied than men - since it appears that, in general, women place a higher priority than men finding employment in settings where the work (as they view it) has comparatively high social value and where they are likely to have especially good relations with coworkers.
