Valerie Braithwaite makes a major contribution to regulatory theory by mapping the psychological processes of defiance. At the heart of the analysis is the concept of motivational posturing signals sent to indicate how favourably an authority is viewed and readiness to defer to an authority's demands. The author explains how resistant defiance expresses disapproval of the way an authority operates and signals to government the need to improve performance to win back public confidence. Resistance weakens as the authority claws back its institutional integrity. Dismissive defiance, on the other hand, is challenging and undermining, and is not so responsive. The book argues for institutional reforms that are both mindful of grievance and of alternative authorities that challenge power. It illustrates that in delivering institutional reform, commitment to democratic principles and integrity of government will enable authorities to argue their case for community co-operation where appropriate. Finally, the book goes on to show that power sharing is likely to be a more apt remedy when dismissive defiance is entrenched. Safeguarding these deliberations in mature democracies are moral obligation and social capital, both of which are likely to erode when authorities show neither justice nor wisdom in handling defiance. The local government made me a political target which destroyed both my reputation and business. I had put up with the city creating misinformation about me and my business. I was harassed, segregated, and ostracized and they put me in a position that forced me to consider packing up and moving out of town or to fight back. This book goes through many of the battles I went through. It also goes through many of the policies that I have sent to local, state, and federal lawmakers to help promote change. I also go through several research analyses that I had conducted. I hope that this book will help serve as inspiration for people to keep fighting and if that doesn’t work, then fight smart.

Book excerpt: Unlike many other trade regimes, the European Union forbids the use of inter-state retaliation to enforce its obligations, and rules out the use of common 'escape' mechanisms such as anti-dumping between the EU member states. How does the EU do without these mechanisms that appear so vital to the political viability of other international trade regimes, including the World Trade Organization? How, therefore, is the European legal order, with the European Court of Justice at its centre, able to be so much more binding and intrusive than the legal obligations of many other trade regimes? This book puts forward a new explanation of a key part of the European Union's legal system, emphasising its break with the inter-state retaliation mechanisms and how Europe's special form of legal integration is facilitated by intra-industry trade, parliamentary forms of national government, and European welfare states. It argues first that the EU member states have allowed the enforcement of EU obligations by domestic courts in order to avoid the problems associated with enforcing trade obligations by constant threats of trade retaliation. It argues second that the EU member states have been able to accept such a binding form of dispute settlement and treaty obligation because the policy adjustments required by the European legal order were politically acceptable. High levels of intra-industry trade reduced the severity of the economic adjustments required by the expansion of the European market, and inclusive and authoritative democratic institutions in the member states allowed policy-makers to prioritise a general interest in reliable trading relationships even when policy changes affected significant domestic lobbies. Furthermore, generous national social security arrangements protected national constituents against any adverse consequences arising from the expansion of European law and the intensification of the European market. The European legal order should therefore be understood as a legalized dispute resolution institution well suited to an international trade and integration regime made up of highly interdependent parliamentary welfare states.

Goldstein examines the development of the European Union by blending comparative and historical institutionalist approaches. She argues that the most useful framework for understanding the kinds of "supra-state" formations that are increasingly apparent in the beginning of the third millennium is comparative analysis of the formative epochs of federations of the past that formed voluntarily from previously independent states. In Constituting Federal Sovereignty: The European Union in Comparative Context Goldstein identifies three significant predecessors to today's European Union: the Dutch Union of the 17th century, the United States of America from the 1787 Constitution to the Civil War, and the first half-century of the modern Swiss federation, beginning in 1848. She examines the processes by which federalization took place, what made for its success, and what contributed to its problems. She explains why resistance to federal authority, although similar in kind, varied significantly in degree in the cases examined. And she explores the crucial roles played by such factors as sovereignty-honoring elements within the institutional structure of the federation, the circumstances of its formation (revolt against distant empire versus aftermath of war among member states), and notably, the internal culture of respect for the rule of law in the member states.

People who are defiant can present perplexing challenges etiologically, diagnostically, and responsively. But in order to understand accurately when defiant behaviour is good, or bad, or neither (when it emerges out of mental illness), a fresh perspective on defiance is needed. This book offers a nuanced and complex look at defiance, taking seriously issues of dysfunction while also attending to social contexts in which defiant behaviour may arise. Those living in adverse conditions such as oppression, systematic disadvantages, and disability may act defiantly for good reasons. This perspective places defiance squarely within the moral domain; thus, it should not be assumed that when professionals come across defiant behaviour, it is a sign of mental dysfunction. Potter argues that defiance sometimes is a virtue, meaning that a disposition to be ready to be defiant when the situation calls for it is part of living a life with a realistic understanding of the aim of flourishing and its limits in our everyday world. Her work also offers theoretical work on problems in knowing that can impede understanding and responsiveness to those who are, or seem to be, defiant. Clinicians, teachers, social workers, nurses, and others working in helping professions are invited to engage in different ways with defiance so as to better understand and respond to people who express that defiance. Case studies, a framework for differentiating different forms of defiance, a realistic picture of phronesis-practical reasoning-and an explanation of how to give uptake well are some of the topics covered. The voices of service users strengthen the author's claims that defiance that is grounded in phronesis is just as much a part of moral life for those living with mental disabilities as for anyone else.
