Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.

Book excerpt: ITAR, which controls defense trade, includes the U.S. Munitions List (USML) which specifies categories of defense articles and services covered by the regulations. In 1999, space satellites were added to the USML. In 2002 ITAR was amended to exclude U.S. universities from having to obtain ITAR licenses when performing fundamental research involving foreign countries and/or persons. Despite this provision, there remains considerable uncertainty among university researchers about whether the regulations apply to their research leading to a rather conservative interpretation of the regulations and the imposition of burdens that might not be necessary. To explore this concern, NASA asked the NRC to organize a workshop of all stakeholders on the implications of ITAR for space science. This book presents a summary of the workshop discussions including those on perspectives on recent developments and implementation of ITAR; overarching issues; problems arising from ITAR's implementation; and opportunities for near-term actions and improvements.

Book excerpt: Weaknesses in the National Aeronautics and Space Administration (NASA) export control policy and implementation of foreign national access procedures at some centres increase the risk of unauthorised access to export-controlled technologies. NASA policies provide Center Directors the ability to implement export controls at their centres. NASA develops sophisticated technologies and shares with them its international partners. U.S. export control regulations require NASA to identify and protect its sensitive technology; NASA delegates implementation of export controls to its 10 research and space centres. Recent allegations of export control violations at two NASA centres have raised questions about NASA's ability to protect its sensitive technologies. GAO was asked to review NASA's export control program. This book assesses NASA's export control policies and how centres implement them; and the extent to which NASA Headquarters and CEAs apply oversight of centre compliance with its export control policies.

Book excerpt: The "homeland" security mission of the Department of Homeland Security (DHS) is paradoxical: Its mission space is uniquely focused on the domestic consequences of security threats, but these threats may be international in origin, organization, and implementation. The DHS is responsible for the domestic security implications of threats to the United States posed, in part, through the global networks of which the United States is a part. While the security of the U.S. air transportation network could be increased if it were isolated from connections to the larger international network, doing so would be a highly destructive step for the entire fabric of global commerce and the free movement of people. Instead, the U.S. government, led by DHS, is taking a leadership role in the process of protecting the global networks in which the United States participates. These numerous networks are both real (e.g., civil air transport, international ocean shipping, postal services, international air freight) and virtual (the Internet, international financial payments system), and they have become vital elements of the U.S. economy and civil society. Export Control Challenges Associated with Securing the Homeland found that outdated regulations are not uniquely responsible for the problems that export controls post to DHS, although they are certainly an integral part of the picture. This report also explains that the source of these problems lies within a policy process that has yet to take into account the unique mission of DHS relative to export controls. Export Control Challenges Associated with Securing the Homeland explains the need by the Department of Defense and State to recognize the international nature of DHS's vital statutory mission, the need to further develop internal processes at DHS to meet export control requirements and implement export control policies, as well as the need to reform the export control interagency process in ways that enable DHS to work through the U.S. export control process to cooperate with its foreign counterparts.

Book excerpt: The recent broad political rapprochement between the United States and the nations of the Former Soviet Union (FSU) has transformed the environment for cooperation on space projects, and led to cooperative programs in space with Russia and other FSU states that would have been unimaginable just a few years ago. Chief among these are the high-profile human spaceflight cooperative activities involving the Space Shuttle-Space Station Mir dockings and the International Space Station. This report surveys the potential benefits and drawbacks of expanded cooperation with Russia and other nations of the FSU in space activities, and examines the impacts of closer cooperation on U.S. industry and U.S. national security concerns. Such cooperation has begun to yield scientific, technological, political, and economic benefits to the United States. However, the political and economic risks of cooperating with the Russians are higher than with the United States' traditional partners in space. Cooperation in robotic space science and earth remote sensing is proceeding well, within the stringent limits of current Russian (and U.S.) space budgets. Including Russia in the International Space Station program provides technical and political benefits to the space station partners, but placing the Russian contribution in the critical path to completion also poses programmatic and political risks.

It is a dream of mankind and a multi-billion industry likewise. It is subject to a distinct branch of law – and moreover part of modern pop culture. In short: spaceflight is fascinating. “Outer Space in society, politics and law” is an inter-disciplinary approach to the understanding of modern space law. Technical, cultural and historical aspects lay the foundation for a sound comprehension why space law norms have been established and what they mean in practice. The reader will realize the impact space and spaceflight have on society – from Stonehenge to climate change. A new approach to presenting space law: comprehensive and illustrative. “We live in a society absolutely dependent on science and technology and yet have cleverly arranged things so that almost no one understands science and technology. That's a clear prescription for disaster.” Carl Sagan

Available in PDF, EPUB and Kindle. Book excerpt: This handbook is a reference work providing a comprehensive, objective and comparative overview of Space Law. The global space economy reached $330 billion in 2015, with a growth rate of 9 per cent vis-à-vis the previous year. Consequently, Space Law is changing and expanding expeditiously, especially at the national level. More laws and regulations are being adopted by space-faring nations, while more countries are adapting their Space Laws and regulations related to activities in outer space. More regulatory bodies are being created, while more regulatory diversity (from public law to private law) is being instituted as increasing and innovative activities are undertaken by private entities which employ new technologies and business initiatives. At the international level, Space Law (both hard law and soft law) is expanding in certain areas, especially in satellite broadcasting and telecommunications. The Routledge Handbook of Space Law summarises the existing state of knowledge on a comprehensive range of topics and aspires to set the future international research agenda by indicating gaps and inconsistencies in the existing law and highlighting emerging legal issues. Unlike other books on the subject, it addresses major international and national legal aspects of particular space activities and issues, rather than providing commentary on or explanations about a particular Space Law treaty or national regulation. Drawing together contributions from leading academic scholars and practicing lawyers from around the world, the volume is divided into five key parts: • Part I: General Principles of International Space Law • Part II: International Law of Space Applications • Part III: National Regulation of Space Activities • Part IV: National Regulation of Navigational Satellite Systems • Part V: Commercial Aspects of Space Law This handbook is both practical and theoretical in scope, and may serve as a reference tool to academics, professionals and policy-makers with an interest in Space Law.

Book excerpt: As space continues to attract substantial public and private investment and has become ever more active, the third edition of this book has been updated to cover recent developments. This includes the legal bases of UN Resolution 76/3, the Space3030 Agenda, which envisages ‘space as a driver of sustainable development’ and sets out an extensive programme for the future. The work also takes account of adaptations and augmentations to basic space treaties. It examines the increasing commercialisation of space in areas such as space tourism and space mining, for which four states have already adopted relevant legislation. The impact of new technologies such as satellite constellations and micro-satellites are also scrutinised. At a time when space tourism is available to those who can afford it and when the moon will shortly be revisited with a prospect of permanent bases, this third edition provides a firm base for the next generation of space lawyers. As with previous editions, the work draws from governmental, international organisational and other authoritative sources as well as the relevant literature in the field. The book will be an essential and comprehensive resource for students, academics and researchers as well as space agencies, governments and space-active companies. It will also be of value to technical operatives and managers who need to know the legal context within which they work.
