Book excerpt: As a teen, prosecutor Ben Santos fathered a daughter out of wedlock. Hell-bent on a career in law, he lost contact with her. A dozen years later, his failure to embrace fatherhood is his one abiding regret. Blood money claims the life of a pregnant woman. A jail snitch badgers her husband into implicating himself. Conviction seems a safe bet until the criminal lawyers go to work, bending the rules of evidence so as to profit from the husband's cellblock confidences. Santos is initially gun-shy about handling the case. His one previous murder trial ended in a hung jury. The rapist-killer, released on bail pending retrial, claimed the life of another victim. At trial, Santos parries the aggressive ploys of Vietnam Veteran-defense attorney Francisco Duran. Even so, Duran backs him into a corner. At the eleventh hour, Santos devises a strategy worthy of Solomon. Duran counters with a cynical plea-bargain proposal. Momentum turning, Santos insists on submitting the case to the jurors despite risk of another hung jury. On the home front, Santos and his teacher wife are working on a baby of their own. As trial nears its climax, Santos rushes Carmel to Delivery.

Book excerpt: The Thriller: Scripting Seat-Gripping Suspense plumbs nine-score thrillers for recurring features that build nape-prickling, heart-pounding suspense. Fodder for analysis embraces domestic and foreign fare, classic and contemporary, ranging from Ghost, Speed, Seven, Psycho, and The Silence of the Lambs to La Femme Nikita and Yogen [Premonition]. Text eschews a connecting-the-dots, painting-by-numbers approach, in belief that formulas drain the lifeblood of creativity and inevitably spawn a ho-hum product. That said, the eight factors culled from the covered films constitute useful tools in the screenwriter's arsenal. Perhaps the best groundwork for a thriller is infiltrating the ATF/FBI/IRA, or a brigade of arms-running mercenaries. Short of that, watching films and reading scripts will work wonders. In that spirit, the book debuts three feature-film scripts for critical scrutiny: mystery thriller "Stateline"; police thriller "Cashing Out"; supernatural thriller "Birthmarks."

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the fraught relationship between cultural heritage and intellectual property, in their common concern with the creative arts. The competing discourses in international legal instruments around copyright and intangible cultural heritage are the most obvious manifestation of this troubled encounter. However, this characterization of the relationship between intellectual and cultural property is in itself problematic, not least because it reflects a fossilized concept of heritage, divided between things that are fixed and moveable, tangible and intangible. Instead the book maintains that heritage should be conceived as part of a dynamic and mutually constitutive process of community formation. It argues, therefore, for a critically important distinction between the fundamentally different concepts of not only intellectual and cultural heritage/property, but also of the market and the community. For while copyright as a private property right locates all relationships in the context of the market, the context of cultural heritage relationships is the community, of which the market forms a part but does not – and, indeed, should not – control the whole. The concept of cultural property/heritage, then, is a way of resisting the reduction of everything to its value in the market, a way of resisting the commodification, and creeping propertization, of everything. And, as such, the book proposes an alternative basis for expressing and controlling value according to the norms and identity of a community, and not according to the market value of private property rights. An important and original intervention, this book will appeal to academics and practitioners in both intellectual property and the arts, as well as legal and cultural theorists with interests in this area.

This book was released on 2003 with total page 55 pages. Available in PDF, EPUB and Kindle. Book excerpt: The majority of the 1998 Wasatch Front landslides were likely triggered following a cumulative rise in ground-water levels resulting from four or more successive years of above-normal precipitation. Triggering of landslide movement likely coincided with a transient ground-water-level rise associated with the spring snowmelt and contemporaneous above-normal precipitation. In most Wasatch Front areas, 1998 was the wettest as well as the last year of the precipitation period. An increase in landslide activity began in 1997, following two to four successive years of above-normal precipitation. This study examines the relation between the 1998 landslides and the 1995-98 precipitation period (1993-98 in Spanish Fork Canyon). Accordingly, this study investigates the significance of the most recent precipitation period in relation to the historical precipitation record, and compares it with the 1980-86 period. In addition, other causes of the 1998 landsliding are explored, most importantly hillside modification related to residential development. This study also examines several issues, and their implications, related to the 1998 Wasatch Front landslides including the susceptibility to reactivation of pre-existing landslides, consideration of the state of landslide activity, and the possibility of developing landslide-movement prediction tools based on an instability threshold concept. The majority of the landslides discussed occurred near urbanized areas of the Wasatch Front and consisted of either translational or rotational earth slides in pre-existing landslide areas. The discussion and conclusions are limited to these landslides and locations. The case histories presented provide new data intended to further the understanding of landslide hazards in the Wasatch Front.
