Book excerpt: One of the steps in criminal procedure deals with the role of the courts, executive, and administrative agencies in granting pardons and paroles to the tens of thousands of prisoners each year. Constitutional provisions can be found in both the Federal and State constitutions for executive clemency through pardon and/or parole by the President and/or governors as part of their constitutional powers. Presidents and governors have used their clemency authority throughout the history of the country. Every state contains both statutes and regulations dealing with pardon/parole. The statutes provide law for pardon and parole, but it is administrative agencies (agencies, boards, commissions) that actually draw up the regulations for the procedures of carrying out pardons and paroles. The text of these laws and regulations are quite long and I have had to restrict the content of both chapters to listing only the chapters under each state's statutes and regulations.--Publisher.

Book excerpt: Florida has nearly 101,000 inmates in 49 major state prisons and numerous correctional facilities called annexes and work camps.A clemency commutation of sentence and parole are alternate paths to the same goal, which is to release the inmate early. Both involve compassion, redemption, and forgiveness, and are the ultimate grant of a second chance. To get either, you must convince elected or appointed officials that the inmate will never commit another serious crime. However, clemency and parole involve different decision-makers, rules and timeframes. Here is the so-called secret sauce (the actual "how-to" steps to leave prison early), written by one of Florida's most distinguished clemency lawyers.

Book excerpt: During the 1930s in the United States, the Works Progress Administration developed the Federal Writers’ Project to support writers and artists while making a national effort to document the country’s shared history and culture. The American Guide series consists of individual guides to each of the states. Little-known authors—many of whom would later become celebrated literary figures—were commissioned to write these important books. John Steinbeck, Saul Bellow, Zora Neale Hurston, and Ralph Ellison are among the more than 6,000 writers, editors, historians, and researchers who documented this celebration of local histories. Photographs, drawings, driving tours, detailed descriptions of towns, and rich cultural details exhibit each state’s unique flavor. Published in 1941, the WPA Guide to Arkansas splendidly exhibits the varied environment of the Natural State. From the densely forested land in the Ozark Mountains and Arkansas Timberlands to the Mississippi River and the Arkansas Delta, the guide to the Land of Opportunity provides several photographs of, history on, and driving tours through the state’s grand geography.

Available in PDF, EPUB and Kindle. Book excerpt: In this long-awaited memoir, Kemba Smith shares her dramatic story, as it has never been told. Poster Child: The Kemba Smith Story chronicles how she went from college student to drug dealer's girlfriend to domestic violence victim to federal prisoner. Kemba shares her story of how making poor choices blinded by love and devotion can have long-term consequences. In 1994, Kemba was sentenced to a mandatory 24 1/2 years in federal prison, with no chance for parole, despite being a first-time, non-violent offender. Fortunately, she regained her freedom when President Clinton granted her executive clemency in December 2000 after having served 6 1/2 years. Kemba's case drew support from across the nation and the world. Often being labeled the "poster child" for the campaign to reverse a disturbing trend in the rise of lengthy sentences for first-time, non-violent drug offenders, Kemba's story has been featured on CNN, Court TV, "Nightline," "Judge Hatchett," "The Early Morning Show" and a host of other television programs. In addition, Kemba's story has been featured in several publications, such as The Washington Post, The New York Times and Emerge, JET, Essence, Glamour, and People magazines. Author Bio: Kemba Smith Pradia is a wife, mother, national motivational speaker, consultant, author, and criminal justice advocate. She has received numerous awards and recognition for her courage and determination to educate the public about the devastating social, economic, and political consequences of current drug policies. Available in PDF, EPUB and Kindle. Book excerpt: At the start of the twenty-first century, 1 percent of the U.S. population is behind bars. An additional 3 percent is on parole or probation. In all but two states, incarcerated felons cannot vote, and in three states felon disenfranchisement is for life. More than 5 million adult Americans cannot vote because of a felony-class criminal conviction, meaning that more than 2 percent of otherwise eligible voters are stripped of their political rights. Nationally, fully a third of the disenfranchised are African American, effectively disenfranchising 8 percent of all African Americans in the United States. In Alabama, Kentucky, and Florida, one in every five adult African Americans cannot vote. Punishment and Inclusion gives a theoretical and historical account of this pernicious practice of felon disenfranchisement, drawing widely on early modern political philosophy, continental and postcolonial political thought, critical race theory, feminist philosophy, disability theory, critical legal studies, and archival research into state constitutional conventions. It demonstrates that the history of felon disenfranchisement, rooted in postslavery restrictions on suffrage and the contemporaneous emergence of the modern “American” penal system, reveals the deep connections between two political institutions often thought to be separate, showing the work of membership done by the criminal punishment system and the work of punishment done by the electoral franchise. Felon disenfranchisement is a symptom of the tension that persists in democratic politics between membership and punishment. This book shows how this tension is managed via the persistence of white supremacy in contemporary regimes of punishment and governance.
