Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the nature of the challenges that have confronted European democracies in recent years. In the past decade, the rule of law in Europe has been put under strain by both external and internal factors. The term “illiberal democracies” is sometimes used to describe the rise of a phenomenon in which the fundamental values of the European legal order, as enshrined in the European Convention of Human Rights and in the Charter of Fundamental Rights of the European Union, are called into question. The preservation of the independence of the judiciary, of the freedom of expression and the protection of journalists are among the values under threat. But these challenges are also present within the older democracies in which emergency regimes have become more common. As the European Union’s sanctions regime shows, striking a balance between security and the rule of law, of which fundamental rights are an intrinsic part, is a constant challenge. Focusing on the European courts’ responses to these threats, the book discusses how courts could provide the ultimate line of defense. The acid test of the rule of law might indeed be how it safeguards the judicial guarantees designed to protect core European values beyond the discretion of government.

At the same time, it offers a unique and stimulating analysis of the development of a common body of law in the wider Europe. The twenty-nine articles contained in this volume are grouped together under five headings: - commitment to democratic standards; - protection of human rights and fundamental freedoms; - the Council of Europe in context; - the common legal space; - common problems of democracy and transatlantic relations.

Book excerpt: This volume presents a wide selection of studies on the issues of law, land dispute and conflict (mediation) in Africa, reconsidering the role of state agents and other actors in these matters. The focus is on analyzing how citizens, state institutions and concerned (inter)national actors aim to find solutions to disputes, tension and conflict that are part of social life. The authors have approached the subject of Land, Law and Politics in Africa from a variety of disciplinary angles. The issues at stake comprise land access and land use, state politics and democratization efforts, the relationship between constitutional/state law and customary law, the challenges of urban and rural conflicts, border issues and the conceptions of (human) rights. On the basis of new empirical studies, the authors plead for a more holistic perspective on the above issues and on developmental policy in general. The book has 15 chapters in four thematic parts, focusing on historical and cultural aspects of politics and authority; land law and land disputes; constitutionalism and politics; and conflict studies. The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.

Available in PDF, EPUB and Kindle. Book excerpt: The past fifteen years in France have seen a remarkable flourishing of new work in political philosophy. This anthology brings into English for the first time essays by some of the best young French political thinkers writing today, including Marcel Gauchet, Pierre Manent, Luc Ferry, and Alain Renaut. The central theme of these essays is liberal democracy: its nature, its development, its problems, its fundamental legitimacy. Although these themes are familiar to American and British readers, the French approach to them--which is profoundly historical and rooted in the tradition of continental philosophy--is quite different from our customary one. Included in this collection is a series of reconsiderations of French critics of liberal society (Lévi-Strauss, Foucault, Bourdieu) and of classical European liberals (Kant, Constant, Tocqueville). The continuing controversies over the nature of the modern era and the place of religion within it play a central role throughout the collection. The book includes a debate on the foundations of human rights and on the nature of a liberal political order. The concluding section presents some of the new sociological writing on modern individualism, its pleasures and its discontents. An introduction by Mark Lilla provides the historical background to the revival of French political thought about liberalism, and offers an analysis of what American and English readers might learn from it. Originally published in 1994. In 2019, 40 years after the first election of members of the European Parliament by direct universal suffrage in 1979, the citizens of the Union were called to the polls for the ninth time. Between these two dates, the European Parliament changed dramatically, from a mere consultative assembly to the ordinary co-legislator of a European Union plagued by many crises. This book draws on an international conference held at the University of Bordeaux on May 9 and 10, 2019. The various contributions therein intend to take stock, examine the challenges and envisage the prospects, not only of the 2019 European elections but also of representative European democracy in general.

* * * This Liber Amicorum, which pays tribute to Gilles de Kerchove, EU counter-terrorism coordinator from 2007 to 2021, takes stock of what has been achieved in this field in recent years and looks at the challenges ahead. After an introduction tracing the recipient’s background, the first part looks at different aspects of cooperation within the European Union, ranging from the European arrest warrant, to the protection of fundamental rights and the role of certain EU institutions or agencies. The second part deals with cooperation between the EU and the rest of the world, both with global organisations and with specific States, such as the United States. The third, cross-cutting part brings together various contributions relating to the Islamic State, the financing of terrorism, victims and new technologies. The book concludes with a fourth part on prevention, the fight against radicalisation, values, freedom of the press and literature. The authors come from various parts of the world and present a wide range of profiles, including prominent political figures, EU officials, academics, magistrates and journalists. The book was coordinated by Dr. Christiane Höhn, Principal Advisor to Gilles de Kerchove, Isabel Saavedra, his Personal Assistant and Prof. Anne Weyembergh, Professor at the Université libre de Bruxelles (ULB).
