Jedoch wird auch deutlich, dass sexuelle Belästigung in weiten Teilen der Gesellschaft tabuisiert wird – sowohl von den Betroffenen selbst, da sie aus Angst und Scham oftmals schweigen, als auch von den Organisationen. Betriebliche Ansprechpartner sowie Vorgesetzte stehen im Verruf, nicht offen mit dem Thema umzugehen und so zur Tabuisierung des Themas beizutragen, da ansonsten ein schlechtes Bild nach außen entstehen könnte. Die Anzahl der Betroffenen dürfte demnach in der Realität höher sein, da sexuelle Belästigung mit "so einem starken Tabu belegt" ist, wie kaum ein anderes Thema in Unternehmen.

Im Recht der Vereinigten Staaten begegnet man diesem Problem damit, daß dem Opfer ein zivilrechtlicher Anspruch gegen den Arbeitgeber an die Hand gegeben wird.Der Autor zeigt in der vorliegenden Arbeit auf, daß auch im deutschen Recht das Zivilrecht dazu eingesetzt werden kann, verhaltenssteuernd auf Schädiger einzuwirken und Rechtsgutsverletzungen zu verhindern. Dies gilt insbesondere bei sexueller Belästigung, da die bestehenden straf- und öffentlich-rechtlichen Bestimmungen sowie das speziell hierzu erlassene Beschäftigtenschutzgesetz allein einen hinreichenden Schutz der belästigten Arbeitnehmer nicht gewährleisten können.Als Anspruchsgrundlagen stehen dem belästigten Opfer § 823 Abs. 1 BGB wegen Verletzung des allgemeinen Persönlichkeitsrechts, § 823 Abs. 2 BGB in Verbindung mit dem Beschäftigtenschutzgesetz sowie das Rechtsinstitut der positiven Vertragsverletzung zur Verfügung. Hierbei haftet der Arbeitgeber nicht nur, wenn er selbst oder ein Vorgesetzter sexuell belästigt hat, sondern unter Umständen auch bei Belästigung durch Kollegen des Opfers.Neben dem Ersatz seines materiellen Schadens kann das Opfer in schweren Fällen auch eine Geldentschädigung wegen immaterieller Schäden verlangen. Hier wird der Gedanke der zivilrechtlichen Prävention besonders relevant. Unter diesem Gesichtspunkt sind bei der Bemessung der Höhe der Geldentschädigung folgende Faktoren zu berücksichtigen: die Intensität des Eingriffs in das Persönlichkeitsrecht des Opfers, der Grad des Verschuldens des Arbeitgebers sowie die finanzielle Situation des Arbeitgebers.
