Book excerpt: Sex selection in India and China is fostered by a limiting social structure that disallows women from performing the roles that men perform, and relegates women to a lower status level. Individual parents and individual families benefit concretely from having a son born into the family, while society, and girls and women as a group, are harmed by the widespread practice of sex selection. Sex selection reinforces oppression of women and girls. Sex selection is best addressed by ameliorating the situations of women and girls, increasing their autonomy, and elevating their status in society. One might argue that restricting or prohibiting abortion, prohibiting sex selection, and prohibiting sex determination would eliminate sex selective abortion. But this decreases women's autonomy rather than increases it. Such practices will turn underground. Sex selective infanticide, and slower death by long term neglect, could increase. If abortion is restricted, the burden is placed on women seeking abortions to show that they have a legally acceptable or legitimate reason for a desired abortion, and this seriously limits women's autonomy. Instead of restricting abortion, banning sex selection, and sex determination, it is better to address the practice of sex selection by elevating the status of women and empowering women so that giving birth to a girl is a real and positive option, instead of a detriment to the parents and family as it is currently. But, if a ban on sex selective abortion or a ban on sex determination is indeed instituted, then wider social change promoting women's status in society should be instituted simultaneously.

Book excerpt: Some of the most hotly contested international women's rights issues today arise from the movement of peoples from one country to another and the practices they purportedly bring with them. In Women's Human Rights and Migration, Sital Kalantry focuses on immigrants of Asian descent living in the United States who are believed to abort female fetuses because they do not want a female child. While sex-selective abortion is a human rights concern in India, should we, for that reason, assume that the practice undermines women's equality in the United States? Although some pro-choice feminists believe that these prohibitions on sex-selective abortion promote women's equality, other feminists fiercely oppose such laws, characterizing them as a Trojan horse in the larger pursuit to overturn the reproductive rights guaranteed by Roe v. Wade. Nearly half of state legislatures in the United States have proposed laws restricting sex-selective abortion since 2009 and nine have adopted them. Kalantry argues that traditional feminist legal theories and international human rights law fail to provide adequate guidance in examining the human rights implications of the reproductive practices of immigrant women, evidenced by the fact that both supporters and opponents ground their claims in women's equality. She advocates instead for a context-based approach that is open to the possibility that sex-selective abortion practices will have significantly different human rights implications when they emerge in different national contexts. The product of extensive empirical and interdisciplinary research, Kalantry's book investigates the actual occurrence of sex-selective abortion among Asian Americans, the social and cultural contexts in which women in the United States and India practice sex-selective abortion, and the consequences of the laws in each country for women's equality. Women's Human Rights and Migration develops a transnational feminist legal approach to examining and legislating contested acts that result from migration.

I conclude that under some circumstances governments may justify or even require sex-selective abortion of females under the guise of scientifically-based eugenics. My thesis in this paper is developed through a case study of China.

With the increasing availability of ultrasound in the mid-1980s sex determination followed by sex-selective abortion began to become widespread as well. The following paper introduces this Roundtable and discusses the following questions: Is sex selection a part of women's right to free choice and control over their reproduction? What is the role of the medical profession? Are all manifestations of sex selection equally unethical? Are there solutions? Do the solutions themselves pose new ethical dilemmas? Following this paper, four respondents put different points of view on sex selection as a gender-based preference for a pregnancy; progress in getting the Supreme Court of India to implement a 1994 law regulating the use of antenatal diagnostic technology; why sex selection should be available as a form of reproductive choice; and why sex selection may be empowering for women and justify their actions in the short run, given the demands on them. All agree that only improved status for women and girls will reduce the demand for sex selection.

In Gender before Birth, Rajani Bhatia takes on the double standard of how similar practices in the West and non-West are divergently named and framed. Bhatia’s extensive fieldwork includes interviews with clinicians, scientists, biomedical service providers, and feminist activists, and her resulting analysis extends both feminist theory on reproduction and feminist science and technology studies. Book excerpt: Abortion is a sensitive issue around the world. Acting as a clear dividing line in American politics, countries around the world treat abortion policy with a range of approaches. From near complete prohibition to encouraging its use as a tool of population control, countries utilize a variety of approaches to abortion policy. An abortion and technological issue of ethical concern is the practice of parental sex selection of the fetus. Ignoring basic questions of incentives for agents has overlooked key factors of the factors driving sex selective abortion. The economic incentives and clear decision making principles behind sex selective abortion, access to family planning, and reproductive services has not been widely studied. In this paper, I provide a theoretical economic defense to the practice of sex selective abortion given the existing ethical framework. Rather than proceeding from a moral position, this paper will defend the practice of sex selective abortion using the accepted ethical precepts of society and the economics of family planning. Analysis of the practice of sex selective abortions fails to account for value discrimination of human life and choice fungibility. I find that opposition to sex selective abortion establishes significant inequalities based upon inconsistent standards between individual agents, fetuses, technological standards, and income levels. This has four primary implications. First, agents in societies which engage in sex selective do so out of economic incentives not gender preference. Second, in developed economies which do not face the economic constraints of parents in lesser developed countries, parents have distinct non-distortionary aggregative gender preferences. Third, the ethical dilemma of gender preferences of potential parents in developed countries concerns the methods by which they seek to obtain their preferred gender or other characteristics. Fourth, at its core, ethical arguments against the practice of sex selection abortion are not arguing against sex selection, abortion, or sex selective abortion. Critics of sex selective abortion are arguing against societal gender imbalance.

Book excerpt: Previous research on sex-selective abortions has ignored the interactions between fertility, birth spacing, and sex selection, despite both fertility and birth spacing being important considerations for parents when deciding on the use of sex selection. This paper presents a novel approach that jointly estimates the determinants of sex-selective abortions, fertility, and birth spacing, using data on Hindu women from India's National Family and Health Surveys. Women with eight or more years of education in urban and rural areas are the main users of sex-selective abortions and they also have the lowest fertility. Predicted lifetime fertility for these women declined 11 percent between the 1985-1994 and 1995-2006 periods, which correspond to the periods of time before and after sex selection became illegal. Fertility is now around replacement level. This decrease in fertility has been accompanied by a 6 percent increase in the predicted number of abortions during the childbearing years between the two periods, and sex selection is increasingly used for earlier parities. Hence, the legal steps taken to combat sex selection have been unable to reverse its use. Women with fewer than eight years of education have substantially higher fertility and do not appear to use sex selection.
