Book excerpt: Consumers routinely enter into long-term contracts with providers of goods and services - from credit cards, mortgages, cell phones, insurance, TV, and internet services to household appliances, theatre and sports events, health clubs, magazine subscriptions, transportation, and more. Across these consumer markets certain design features of contracts are recurrent, and puzzling. Why do sellers design contracts to provide short-term benefits and impose long-term costs? Why are low introductory prices so common? Why are the contracts themselves so complex, with numerous fees and interest rates, tariffs and penalties? Seduction by Contract explains how consumer contracts emerge from the interaction between market forces and consumer psychology. Consumers are short-sighted and optimistic, so sellers compete to offer short-term benefits, while imposing long-term costs. Consumers are imperfectly rational, so sellers hide the true costs of products and services in complex contracts. Consumers are seduced by contracts that increase perceived benefits, without actually providing more benefits, and decrease perceived costs, without actually reducing the costs that consumers ultimately bear. Competition does not help this behavioural market failure. It may even exacerbate it. Sellers, operating in a competitive market, have no choice but to align contract design with the psychology of consumers. A high-road seller who offers what she knows to be the best contract will lose business to the low-road seller who offers what the consumer mistakenly believes to be the best contract. Put bluntly, competition forces sellers to exploit the biases and misperceptions of their customers. Seduction by Contract argues that better legal policy can help consumers and enhance market efficiency. Disclosure mandates provide a promising avenue for regulatory intervention. Simple, aggregate disclosures can help consumers make better choices. Comprehensive disclosures can facilitate the work of intermediaries, enabling them to better advise consumers. Effective disclosure would expose the seductive nature of consumer contracts and, as a result, reduce sellers' incentives to write inefficient contracts. Developing its explanation through a general framework and detailed case studies of three major consumer markets (credit cards, mortgages, and cell phones), Seduction by Contract is an accessible introduction to the law and economics of consumer contracts, and a powerful critique of current regulatory policy.

Available in PDF, EPUB and Kindle. Book excerpt: Contractual and fiduciary relationships are the two primary mechanisms through which the law facilitates coordinated pursuit of our personal interests. These fields are often represented in oppositional terms, and many accept the distinction that contract law allows an individual to pursue their interests independently, while fiduciary law allows an individual to pursue their interests in a dependent or interdependent way. Relying on this distinction, however, seems to suggest that the boundaries between the fields of contract and fiduciary law are fixed rather than fluid. Bringing together leading theorists to analyse critically important philosophical questions at the intersection of contract and fiduciary law, Contract, Status, and Fiduciary Law demonstrates that popular characterizations of the relationship between contract and fiduciary law are overly simplistic. By considering how contract and fiduciary law interact, and not just how they differ, the contributors to this volume offer new insights into a range of topics, including: status relationships, voluntary undertakings, duties of loyalty, equity, employment law, tort law, the law of remedies, political theory, and the theory of the firm.

Available in PDF, EPUB and Kindle. Book excerpt: "This is a must-read book for anyone ready to transcend fear and imagine a new reality."--Tikkun Disposable Futures makes the case that we have not just become desensitized to violence, but rather, that we are being taught to desire it. From movies and other commercial entertainment to "extreme" weather and acts of terror, authors Brad Evans and Henry Giroux examine how a contemporary politics of spectacle--and disposability--curates what is seen and what is not, what is represented and what is ignored, and ultimately, whose lives matter and whose do not. Disposable Futures explores the connections between a range of contemporary phenomena: mass surveillance, the militarization of police, the impact of violence in film and video games, increasing disparities in wealth, and representations of ISIS and the ongoing terror wars. Throughout, Evans and Giroux champion the significance of public education, social movements and ideas that rebel against the status quo in order render violence intolerable. "Disposable Futures poses, and answers, the pressing question of our times: How is it that in this post-Fascist, post-Cold War era of peace and prosperity we are saddled with more war, violence, inequality and poverty than ever? The neoliberal era, Evans and Giroux brilliantly reveal, is defined by violence, by drone strikes, 'smart' bombs, militarized police, Black lives taken, prison expansion, corporatized education, surveillance, the raw violence of racism, patriarchy, starvation and want. The authors show how the neoliberal regime normalizes violence, renders its victims disposable, commodifies the spectacle of relentless violence and sells it to us as entertainment, and tries to contain cultures of resistance. If you're not afraid of the truth in these dark times, then read this book. It is a beacon of light."--Robin D. G. Kelley, author of Freedom Dreams: The Black Radical Imagination "Disposable Futures confronts a key conundrum of our times: How is it that, given the capacity and abundance of resources to address the critical needs of all, so many are having their futures radically discounted while the privileged few dramatically increase their wealth and power? Brad Evans and Henry Giroux have written a trenchant analysis of the logic of late capitalism that has rendered it normal to dispose of any who do not service the powerful. A searing indictment of the socio-technics of destruction and the decisions of their deployability. Anyone concerned with trying to comprehend these driving dynamics of our time would be well served by taking up this compelling book."--David Theo Goldberg, author of The Threat of Race: Reflections on Racial Neoliberalism "Disposable Futures is an utterly spellbinding analysis of violence in the later 20th and early 21st centuries. It strikes me as a new breed of street-smart intellectualism moving through broad ranging theoretical influences of Adorno, Arendt, Bauman, Deleuze, Foucault, Zizek, Marcuse, and Reich. I especially appreciated a number of things, including: the discussion of representation and how it functions within a broader logics of power; the descriptions and analyses of violence mediating the social field and fracturing it through paralyzing fear and anxiety; the colonization of bodies and pleasures; and the nuanced discussion of how state violence, surveillance, and disposability connect. Big ideas explained using a fresh straightforward voice."--Adrian Parr, author of The Wrath of Capital: Neoliberalism and Climate Change Politics Brad Evans and Henry A. Giroux are internationally renowned educators, authors, and intellectuals. Together, they curate a forum for Truthout.com that explores the theme of "Disposable Futures." Evans is director of histories of violence project at the University of Bristol, United Kingdom. Giroux holds McMaster University Chair for Scholarship in the Public Interest, and is the Paulo Freire Distinguished Scholar in Critical Pedagogy.

Available in PDF, EPUB and Kindle. Book excerpt: Written by one of the leading contributors to the relational theory of contract, Contractual Relations authoritatively explains the form of the existing law of contract by relating it to its economic, legal, and sociological foundations. This volume demonstrates that economic exchange and legal contract rest on a moral relationship by which each party legitimately pursues its self-interest through recognition of the self-interest of the other. This essential relationship of mutual recognition is in stark contrast to the pursuit of solipsistic self-interest that is central to the classical law of contract. Self-interest of this sort is not morally defensible, nor does it enhance economic welfare. It is for these reasons that the classical law is legally incoherent. The fundamental inadequacies of the classical law's treatment of agreement, consideration, and remedy have emerged as the doctrines of the positive law of contract have been progressively developed to give effect to the relationship of mutual recognition. The welfarist criticism of the classical law has, however, failed to develop a workable concept of self-interest, and so is at odds with what must be retained from the classical law's facilitation of economic exchange and the market economy. The relational law of contract restates self-interest in a morally, economically, and legally attractive manner as the foundation of the social market economy of liberal socialism. Contractual Relations is a fundamental critique of the classical law of contract and the welfarist response to the classical law, and a major statement of the relational theory of contract. This is an essential work for academics, advanced students, and others wishing to understand the fundamental law, economics and sociology of contract and exchange.

Book excerpt: Sexually active young people urgently need this book. A 2009 Book of the Year, USA Book News “It can’t happen to me.” Many high school students and young adults, seduced by their sense of invincibility, are stunned when they are diagnosed with a sexually transmitted infection (STI). But the fact is that anyone can catch an STI: no age group, social class, economic class, culture, religion, gender, or ethnic group is immune. To drive home the risks and realities of unprotected sex, Dr. Jill Grimes shares real-life stories of young people—medical students, college freshmen, teenagers, young parents, talented entrepreneurs—who have gotten an STI. Dr. Grimes narrates the story of Liz, who got syphilis; Sofia, diagnosed with gonorrhea and chlamydia; and Zoe, with pubic lice. She describes how Justin got herpes, Sean got trichomoniasis, and Luke contracted hepatitis C. The accounts of these young men and women and their exam-room conversations with their doctors evoke both the physical symptoms and complicated emotional reactions that often go together with infection. Fact sheets throughout the book explain each sexually transmitted infection and answer frequently asked questions about symptoms, treatment, and prevention. Used in high schools for the past five years, this new edition of Seductive Delusions shows how technological advances have speeded doctor-patient communication, including test results and treatment recommendations. It explains simplified STI testing, explores the frighteningly high incidence of date sexual assault, examines dramatic changes in cervical cancer prevention and Pap tests, and clarifies why HPV vaccines are now routinely recommended for all children—boys and girls. Whether reading the book from cover to cover or jumping directly to a specific disease, readers will relate to the dramatic stories while learning medically reliable information. Making emotionally and physically safe decisions about sex is easier when you know how STIs are spread, how to avoid getting one, what their symptoms are, and how they are diagnosed and treated.
