(1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.

Book excerpt: Universal Design in Higher Education looks at the design of physical and technological environments at institutions of higher education; at issues pertaining to curriculum and instruction; and at the full array of student services. Universal Design in Higher Education is a comprehensive guide for researchers and practitioners on creating fully accessible college and university programs. It is founded upon, and contributes to, theories of universal design in education that have been gaining increasingly wide attention in recent years. As greater numbers of students with disabilities attend postsecondary educational institutions, administrators have expressed increased interest in making their programs accessible to all students. This book provides both theoretical and practical guidance for schools as they work to turn this admirable goal into a reality. It addresses a comprehensive range of topics on universal design for higher education institutions, thus making a crucial contribution to the growing body of literature on special education and universal design. This book will be of unique value to university and college administrators, and to special education researchers, practitioners, and activists.

This book was released on 2005 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Educators who do not work directly with Section 504 often confuse this provision of federal law on disability discrimination with special education under the Individuals with Disabilities Education Act (IDEA). Accurate and practical information can be hard to find. In this short guide, legal scholar Perry Zirkel sorts out the issues. This book is designed to be a practical primer on the interrelated federal civil rights laws concerning disability discrimination, namely, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA) of 1990. Although an unfunded mandate, Section 504 applies to school districts because they receive federal funds. ADA, which uses the same definition of disability as Section 504, applies to "public entities" (for example, schools), in addition to private places of public accommodation. The definition of disability in IDEA differs from that used in Section 504 and ADA. This book specifically explores student issues in K-12 public education as they are affected by the requirements of Section 504 and ADA. In addressing student issues in K-12 public education, the focus is "504-alone" students, meaning those students who are not protected under the narrower definition of disability contained in IDEA. Students protected under IDEA have "double coverage" because they also are protected under Section 504.

Book excerpt: Federal law—Section 504 of the Rehabilitation Act of 1973— requires all schools receiving federal financial assistance to ensure that students with qualifying disabilities have equal opportunity as non-disabled students to participate in all the academic, nonacademic, and extracurricular activities the school has to offer. Section 504 accommodations, which are developed by a school team and documented in a written Section 504 plan, include adaptations, supports, and modifications that are designed to help students with disabilities access the curriculum and all school programs in the least restrictive environment (LRE). In this new and expanded second edition of Section 504: Classroom Accommodations, Sandra Rief presents dozens of effective and reasonable accommodations, organized by behavioral, learning and academic areas, which may be considered in the development of a student’s 504 plan. Practical suggestions for 504 accommodations are made in the areas of Attention and focusWork production and outputPlanning and organizingTime awareness and managementListening, recall and following directionsTest takingBehaviorAcademic areas Since under Section 504 students may also receive a variety of services and supports by providers other than classroom teachers, this guide also describes practical, easy-to-use accommodations for speech/language, occupational or physical therapists.

Book excerpt: Cyberpsychology is an emerging area of psychological study that aims to understand and explain all facets of online behaviour. This book brings together overviews from a number of leading authorities in the field, to suggest how academic theory and research can be applied to a variety of online behaviours. Both positive and negative behaviours are considered, including topics as diverse as parenting the online child, age-related internet usage and cultural considerations in online interactions. Psychological research can no longer view online and offline worlds as different entities, but must consider online behaviours as equally distinct as offline activities. This is especially apparent when looking at online dating, the role that social networks play in organisations and online consumer behaviours, and in a consideration of the role that psychological research plays in underpinning the multi-billion pound gaming industry. Focusing on these personal applications of the Internet, insight is also offered into the role that theory and research plays in training military personnel as well as the use of psychometric testing to select and retain employees.

Available in PDF, EPUB and Kindle. Book excerpt: The goal of these disability civil rights laws is to provide equal opportunity and fundamental fairness for students with disabilities, including access to special education and related aids and services at public elementary and secondary schools; academic adjustments at colleges and universities; accessible technology; accessible programs, services and facilities; and the right to equal treatment and benefits. A hallmark of these laws is that, in order to ensure that equal opportunity is provided to students with disabilities and to avoid discriminating on the basis of disability, the laws require schools, colleges and universities to sometimes treat students with disabilities differently from students without disabilities. Another hallmark is the imperative to address the particular needs of each student with a disability. Thus, these laws recognize that not only are there many different disabilities, but students with the same disability may not have the same needs. As we observe the 39th anniversary of Section 504 on September 26, 2012, we celebrate our nation's progress in the area of disability rights in education. We also recognize that equal opportunity for people with disabilities has not yet been achieved. Section 504 and Title II, along with the Individuals with Disabilities Education Act (IDEA), administered by the Department's Office of Special Education Programs, demonstrate our nation's commitment to providing quality education to all students with disabilities. To honor that commitment, OCR will continue to vigorously enforce Section 504 and Title II to ensure that students with disabilities receive the education that all students deserve.

Available in PDF, EPUB and Kindle. Book excerpt: Create campuses inclusive and supportive of disabled students, staff, and faculty Disability in Higher Education: A Social Justice Approach examines how disability is conceptualized in higher education and ways in which students, faculty, and staff with disabilities are viewed and served on college campuses. Drawing on multiple theoretical frameworks, research, and experience creating inclusive campuses, this text offers a new framework for understanding disability using a social justice lens. Many institutions focus solely on legal access and accommodation, enabling a system of exclusion and oppression. However, using principles of universal design, social justice, and other inclusive practices, campus environments can be transformed into more inclusive and equitable settings for all constituents. The authors consider the experiences of students, faculty, and staff with disabilities and offer strategies for addressing ableism within a variety of settings, including classrooms, residence halls, admissions and orientation, student organizations, career development, and counseling. They also expand traditional student affairs understandings of disability issues by including chapters on technology, law, theory, and disability services. Using social justice principles, the discussion spans the entire college experience of individuals with disabilities, and avoids any single-issue focus such as physical accessibility or classroom accommodations. The book will help readers: Consider issues in addition to access and accommodation Use principles of universal design to benefit students and employees in academic, cocurricular, and employment settings Understand how disability interacts with multiple aspects of identity and experience. Despite their best intentions, college personnel frequently approach disability from the singular perspective of access to the exclusion of other important issues. This book provides strategies for addressing ableism in the assumptions, policies and practices, organizational structures, attitudes, and physical structures of higher education.
