This book was released on 2023-10-05 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: The implicit topology of international institutional complexes varies greatly across policy areas. In some areas, the lion's share of everyday policy cooperation is shaped by a single institution with alternative and more regional institutions operating in its shadow. In other policy fields, institutional structures appear to be different, seeing a range of non-hierarchical, decentralized, alternative institutions. The Institutional Topology of International Regime Complexes: Mapping Inter-Institutional Structures in Global Governance provides a systematic conceptualization and explanation of the evolution of these varying institutional topologies underlying regime complexes across five issue areas of Global Governance: Intellectual Property Protection, Tax Avoidance, Financial Stability, Development Aid, and Energy Governance. By providing an empirically grounded, network-based conceptualization and mapping of institutional topologies, as well as a theoretical explanation for their variation across policy space and time, the book offers a comprehensive analysis of both the empirical manifestation of inter-institutional structures across various policy fields of Global Governance and the issue specific factors that shape the varying institutional trajectories spurring (de-) centralization. Daßler combines quantitative network analyses with qualitative case studies to trace institutional decentralization processes across five highly relevant issue areas of Global Governance. This volume shows how the nature of issue-specific cooperation problems translates into disparate structures among multilateral institutions occupying the same regime complex. In light of growing concerns about the future trajectories of Global Governance in times of heightened geopolitical tensions, Daßler offers a fresh perspective to comparatively capture the profoundly varying institutional landscapes across different issue areas and their associated challenges and benefits of multilateral cooperation. Transformations in Governance is a major academic book series from Oxford University Press. It is designed to accommodate the impressive growth of research in comparative politics, international relations, public policy, federalism, and environmental and urban studies concerned with the dispersion of authority from central states to supranational institutions, subnational governments, and public-private networks. It brings together work that advances our understanding of the organization, causes, and consequences of multilevel and complex governance. The series is selective, containing annually a small number of books of exceptionally high quality by leading and emerging scholars. The series is edited by Liesbet Hooghe and Gary Marks of the University of North Carolina, Chapel Hill, and Walter Mattli of the University of Oxford.

This book was released on 2023-09-21 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: The intersection between fiscal state aid and taxation has become more topical than ever. Mounting financial crises have left EU Member States scrambling to increase their tax revenue, balance their budgets, and attract capital. Taking advantage of these trends, multinational enterprises have lobbied for favourable tax arrangements, raising questions about the breadth of control the Commission can and should practise. To address egregious instances of favourable taxation, the Commission has tried to simultaneously use soft law and deploy Treaty rules on state aid. Fiscal State Aid Law and Harmful Tax Competition in the EU examines the use of state aid rules against national tax measures. Kyriazis's book presents a targeted investigation of these measures in two parts. The first part addresses Commission decisions and ECJ judgments of the early 2000s, which the author calls the "first wave". The second part consists of all the recent Commission decisions and investigations into tax schemes and individual tax rulings, most notably the Apple, Fiat, Starbucks, and Amazon investigations, which Kyriazis labels the "second wave". The characteristics and common threads of each wave are set out, their similarities and differences dissected, and their nexus to the EU's fight against harmful tax competition explored. Containing a thorough analysis of the legal concept of fiscal state aid under Article 107(1) of the Treaty on the Functioning of the European Union, this book will be of interest to scholars of European and International Tax law and practitioners working in the field of European competition law.

Available in PDF, EPUB and Kindle. Book excerpt: This book explains how transnational policy entrepreneurs have contributed to the transfer of the contested concept of ‘Policy Coherence for Sustainable Development’ (PCSD) in global policy. Tracing the processes by which the PCSD concept has been diffused in an international epistemic community linked to the EU and the OECD, the book offers new insights on international public administrations’ influence on global decision-making. It highlights the dynamic and multi-directional character of knowledge circulation in policy transfer. Drawing on case studies from France, the United Kingdom and Germany, the book contributes to current debates on sustainable development, revealing the role of actors and the logics behind ‘policy coherence’. Thus, it allows to understand the challenges involved in implementing SDG 17. Given its scope, the book will be of considerable interest to academic audiences and students of international relations and policy analysis, as well as practitioners and public officials whose work involves global sustainability policy.

Available in PDF, EPUB and Kindle. Book excerpt: For the first time, Human Rights and Tax in an Unequal World brings together works by human rights and tax law experts, to illustrate the linkages between the two fields and to reveal their mutual relevance in tackling economic, social, and political inequalities. Against the backdrop of systemic corporate tax avoidance, the widespread use of tax havens, persistent pressures to embrace austerity policies, and growing gaps between the rich and poor, this book encourages readers to understand fiscal policy as human rights policy, with profound consequences for the wellbeing of citizens around the world. The essays collected examine where the foundational principles of tax law and human rights law intersect and diverge; discuss the cross-border nature and human rights impacts of abusive practices like tax avoidance and evasion; question the role of states in bringing transparency and accountability to tax policies and practices; highlight the responsibility of private sector actors for the consequences of tax laws; and critically evaluate certain domestic tax rules through the lens of equality and non-discrimination. The contributing scholars and practitioners explore how an international human rights framework can anchor debates around international tax reform and domestic fiscal consolidation in existing state obligations. They address what human rights law requires of state tax policies, and what a state's tax laws and loopholes mean for the enjoyment of human rights within and outside its borders. Ultimately, tax and human rights both turn on the relationship between the individual and the state, and thus both fields face crises as the social contract frays and populist, illiberal regimes are on the rise.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers the first comprehensive analysis of MINURSO (the United Nations Mission for the Referendum in Western Sahara), focused on its activities, composition, purpose, and operational future in Western Sahara, the world’s last colony. The book’s focus is broad, examining MINURSO from key historical, legal, military and political angles whilst assessing the future of UN peacekeeping missions in the Western Sahara. Supported by a diverse, international mix of perspectives and professions—including academics, lawyers, soldiers, and humanitarian aid workers—an in-depth view of MINURSO is provided, rooted in practical Western Saharan field experience. The authors reveal the complexities of the region and of the mission locally, but also analyze MINURSO through a global lens, focusing on relations with the United States, China, Russia, France, and African states. This approach emphasizes the importance of the region as a site of international struggle while remaining conscious of local contexts. A landmark contribution to peacekeeping studies, the book is vital reading for practitioners and academics focused on the Western Saharan conflict and the MENA region, but will also be of interest to those engaged in international relations, international law, and security studies.
