Book excerpt: Leonard Levy's new book, a compendium of his law review articles, book chapters, and basic shorter writings on themes with which he has long been identified, is a treasure chest of sound and reasonable analysis of American constitutional history. As one reviewer of the manuscript put matters: "There is not a clinker amongst them." For anyone who thinks that liberal analysis has grown soft and flabby, a good dose of Levy's book should set the record straight. Seasoned Judgments is divided into three parts: Rights, Constitutional History, and The Marshall Court. In this progression from the general to the concrete, Levy never ignores the context as well as the content of the judicial process. Indeed, it is this linkage that separates him from nearly all other commentators and writers on the subjects covered. Whether discussing why the original Constitution lacked a Bill or Rights, or why the Fourth Amendment uses the imperative form "shall not" rather than the conditional form "ought not," the reader enters a world of explanation rich in detail and carful scholarly elaboration. Well-known as editor in chief of the multivolumed Encyclopedia of the American Constitution, this new volume extracts some of Levy's own contributions to that effort. As a result, one can, for the first time, gain a clear sense of the author's own profound sense of the major issues confronting American law from the founding fathers to the present. The analysis of such still unresolved issues as flag desecration, the exclusionary rule, testimonial compulsion, taxation without representation, and the nature of the Constitution itself, will be of tremendous appeal to historians and political scientists as well as attorneys and judges.

Available in PDF, EPUB and Kindle. Book excerpt: The modern law of search and seizure permits warrantless searches that ruin the citizenry's trust in law enforcement, harms minorities, and embraces an individualistic notion of the rights that it protects, ignoring essential roles that properly-conceived protections of privacy, mobility, and property play in uniting Americans. Many believe the Fourth Amendment is a poor bulwark against state tyrannies, particularly during the War on Terror. Historical amnesia has obscured the Fourth Amendment's positive aspects, and Andrew E. Taslitz rescues its forgotten history in Reconstructing the Fourth Amendment, which includes two novel arguments. First, that the original Fourth Amendment of 1791—born in political struggle between the English and the colonists—served important political functions, particularly in regulating expressive political violence. Second, that the Amendment’s meaning changed when the Fourteenth Amendment was created to give teeth to outlawing slavery, and its focus shifted from primary emphasis on individualistic privacy notions as central to a white democratic polis to enhanced protections for group privacy, individual mobility, and property in a multi-racial republic. With an understanding of the historical roots of the Fourth Amendment, suggests Taslitz, we can upend negative assumptions of modern search and seizure law, and create new institutional approaches that give political voice to citizens and safeguard against unnecessary humiliation and dehumanization at the hands of the police.

Book excerpt: Business revolves around making decisions, often risky decisions, usually with incomplete information and too often in less time than we need. Executives at every level, in every industry, are confronted with information overload, less leeway for mistakes, and a business environment that changes rapidly. In light of this increased pressure and volatility, the old-fashioned ways of making decisions–depending on intuition, common sense, and specialized expertise–are simply no longer sufficient. Distilling over thirty years of groundbreaking research, Winning Decisions, written by two seasoned business advisers and world leaders in behavioral decision studies, is a comprehensive, one-of-a-kind guide to the proven methods of making critical business decisions confidently, quickly–and correctly. Decision-making is a business skill which managers often take for granted in themselves and others–but it's not as easy as some might think. The authors, whose expertise has been sought out by over a hundred companies, including Arthur Andersen, Hewlett-Packard, IBM, and Unilever, contend that decision-making, like any other skill, must be developed and honed if it is to be used effectively. Winning Decisions offers step-by-step analyses of how people typically make decisions, and provides invaluable advice on how to improve your chances of getting your next big decision right the first time. The book is packed with worksheets, tools, questionnaires, case studies, and anecdotes analyzing major decisions made by organizations like British Airways, NASA, Shell Oil, and Pepsi. Some of the proven, straightforward techniques covered in Winning Decisions include how to: Reframe issues to ensure that the real problem is being addressedImprove the quality and quantity of your options Convert expert yet conflicting opinions into useful insights Make diversity of views and conflict work to your advantage Foster efficient and effective group decision-making Learn from past decisions--your own and those of others With Winning Decisions, managers and other professionals now have access to a proven set of skills and strategies they need for making the right decision, right away.

Book excerpt: The only reporter present at the mythic Paris Tasting of 1976 for the first time introduces the eccentric American winemakers and records the tremendous aftershocks of this historic event that changed forever the world of wine. The Paris Tasting of 1976 will forever be remembered as the landmark event that transformed the wine industry. At this legendary contest—a blind tasting—a panel of top French wine experts shocked the industry by choosing unknown California wines over France’s best. George M. Taber, the only reporter present, recounts this seminal contest and its far-reaching effects, focusing on three gifted unknowns behind the winning wines: a college lecturer, a real estate lawyer, and a Yugoslavian immigrant. With unique access to the main players and a contagious passion for his subject, Taber renders this historic event and its tremendous aftershocks—repositioning the industry and sparking a golden age for viticulture across the globe. With an eclectic cast of characters and magnificent settings, Judgment of Paris is an illuminating tale and a story of the entrepreneurial spirit of the new world conquering the old.

Sayers, Dietrich Bonhoeffer, Desmond Tutu, and Marilynne Robinson.

Written by John Jay, James Madison, and Alexander Hamilton, these 85 texts were published between 1787 and 1788 to convince the state of New York to ratify the Constitution. Today, the Papers are studied in courses on American government, American political thought, and constitutional law. However, the size and organization of the full text, notwithstanding its complex political concepts and context, make it difficult for students to apprehend. The Reader's Guide will be a key tool to help them understand the issues at hand and the significance of the Papers then and now. Organized around key issues, such as the branches of the government, the utility of the Union, or skepticism of a national regime, the work will walk the reader through the 85 Papers, providing them with the needed intellectual and historical contexts. Designed to supplement the reading of The Federalist Papers, the guide will help elucidate not only their contents, but also their importance and contemporary relevance.
