Available in PDF, EPUB and Kindle. Book excerpt: In The Laws of Late Medieval Italy Mario Ascheri examines the features of the Italian legal world and explains why it should be regarded as a foundation for the future European continental system. The deep feuds among the Empire, the Churches unified by Roman papacy and the flourishing cities gave rise to very new legal ideas with the strong cooperation of the universities, beginning with that of Bologna. The teaching of Roman law and of the new papal laws, which quickly spread all over Europe, built up a professional group of lawyers and notaries which shaped the new, 'modern', public institutions, including efficient courts (like the Inquisition). Politically divided, Italy was partly unified by the legal system, so-called (Continental) common law (ius commune), which became a pattern for all of Europe onwards. Early modern Europe had for long time to work with it, and parts of it are still alive as a common cultural heritage behind a new European law system.

Book excerpt: This book presents a broad overview of succession law, encompassing aspects of family law, testamentary law and legal history. It examines society and legal practice in Europe from the Middle Ages to the present from both a legal and a sociological perspective. The contributing authors investigate various aspects of succession law that have not yet been thoroughly examined by legal historians, and in doing so they not only add to our knowledge of past succession law but also provide a valuable key to interpreting and understanding current European succession law. Readers can explore such issues as the importance of a father’s permission to marry in relation to disinheritance, as well as inheritance transactions and private, dynastic and cross-border successions. Further themes addressed by the expert contributors include women’s inheritance rights, the laws of succession for the prince in legal consulting, and succession in the Rota Romana’s jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: The Normans have long been recognised as one of the most dynamic forces within medieval western Europe. With a reputation for aggression and conquest, they rapidly expanded their powerbase from Normandy, and by the end of the twelfth century had established themselves in positions of strength from England to Sicily, Antioch to Dublin. Yet, despite this success recent scholarship has begun to question the ’Norman Achievement’ and look again at the degree to which a single Norman cultural identity existed across so diverse a territory. To explore this idea further, all the essays in this volume look at questions of Norman traditions in some of the peripheral Norman dominions. In response to recent developments in cultural studies the volume uses the concepts of ’tradition’ and ’heritage’ to question the notion of a stable pan-European Norman culture or identity, and instead reveals the degrees to which Normans adopted and adapted to local conditions, customs and requirements in order to form their own localised cultural heritage. Divided into two sections, the volume begins with eight chapters focusing on Norman Sicily. These essays demonstrate both the degree of cultural intermingling that made this kingdom an extraordinary paradigm in this regard, and how the Normans began to develop their own distinct origin myths that diverged from those of Norman France and England. The second section of the volume provides four essays that explore Norman ethnicity and identity more broadly, including two looking at Norman communities on the opposite side of Europe to the Kingdom of Sicily: Ireland and the Scandinavian settlements in the Kievan Rus. Taken as a whole the volume provides a fascinating assessment of the construction and malleability of Norman identities in transcultural settings. By exploring these issues through the tradition and heritage of the Norman’s ’peripheral’ dominions, a much more sophisticated understanding can be gained, not only of th

How have women fared in the hands of historians? And, what is the current state of research about women in the Middle Ages? Susan Mosher Stuard addresses these questions in a collection of essays that delve in to the history and historiography of women in medieval England, France, Italy, and Germany. Contributors include Barbara Hanawalt, Diane Owen Hughes, Suzanne Wemple, Denise Kaiser, and Martha Howell. One of the most interesting observations made in Women in Medieval History and Historiography is the way in which the history of women in each country has followed a distinct course that is in rhythm with other concerns of national historical writing. Women in Medieval History and Historiography will interest historians, scholars of women's studies, and medievalists.

Available in PDF, EPUB and Kindle. Book excerpt: For fifty years, the first edition of The Italian Legal System has been the gold standard among English-language works on the Italian legal system. The book's original authors, Mauro Cappelletti, John Henry Merryman, and Joseph M. Perillo, provided not only an overview of Italian law, but a definition of the field, together with an important contribution to the general literature on comparative law. The book explains the unique "Italian style" in doctrine, law, and interpretation and includes an extremely well-written introduction to Italian legal history, government, the legal profession, and civil procedure and evidence. In this fully-updated and revised second edition, authors Michael A. Livingston, Pier Giuseppe Monateri, and Francesco Parisi describe the substantial changes in Italian law and society in the intervening five decades—including the creation and impact of the European Union, as well as important advances in comparative law methodology. The second edition poses timely, relevant questions of whether and to what extent the unique Italian style of law has survived the pressures of European unification, American influence, and the globalization of law and society in the intervening period. The Italian Legal System, Second Edition is an important and stimulating resource for those with specific interest in Italy and those with a more general interest in comparative law and the globalization process.

Available in PDF, EPUB and Kindle. Book excerpt: The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. An understanding thus improved will enable them to operate with the shared skills, knowledge, and values that can bring to fruition the different processes of European integration.

It sheds light on how far these societies were the heirs of the Empire and how they imagined a new part-Roman, part-Italian identity in the centuries after their imperial links were severed.
