Book excerpt: The resurgence of Islamic fundamentalism in the 1980s influenced many in the Islamic world to reject Western norms of liberal rationality and to return, instead, to their own tradition for political and cultural inspiration. This rejection of foreign thought threatens to end the centuries-long dialogue between Islam and the West, a dialogue that has produced a nascent Middle Eastern liberalism, along with many less desirable forms of discourse. With Islamic Liberalism, Leonard Binder hopes to reinvigorate that dialogue, asking whether political liberalism can take root in the Middle East without a vigorous Islamic liberalism. But, Binder asks, is an Islamic liberalism possible? The Islamic political community presents special problems to the development of an indigenous liberalism. That community is conceived of as divinely ordained, and its notions of the good are to be derived from scriptural revelation, not arrived at through rational discourse. Liberal politics would seem to stand little chance of surviving in such an atmosphere, let alone thriving. Binder responds to the challenge of Edward Said's critique of Orientalism, of a range of neo-Marxian development theorists, of Sayyid Qutb's fundamentalist vision, of Samir Amin's vision of Egypt's role in the Arab awakening, of Tariq al-Bishri's new populism, of Zaki Najib Mahmud's pragmatism, and the structuralism of Arkoun and Laroui. The deconstruction of these varied texts produces a number of persuasive hermeneutical conclusions that are sequentially woven together in a critical argument that refocuses our attention on the central question of political freedom and democracy. In the course of constructing this argument, Binder reopens the dialogue between Western modernity and Islamic authenticity and reveals the surprising extent to which there is a convergent interest in liberal, democratic, civil society. Finally, in a concluding chapter, he addresses the prospects for liberalism in the three major bourgeois states of Islam—Egypt, Turkey, and Iran.

Muslim scholars approached and used the Bible for a variety of purposes and in different ways. Thus Muslim historians regularly relied on biblical materials as their primary source for the pre-Islamic period when discussing the creation as well as the history of the Israelites and the prophets preceding Muḥammad. Authors seeking to polemicize against Jews and Christians were primarily interested in the presumed biblical annunciations of Muḥammad and his religion and / or in perceived contradictions and cases of internal abrogation in the Bible. These various concerns resulted from and had an impact on the ways in which Muslim authors accessed the scriptures.

I have undertaken this research on the thesis that modern Imāmī legal tradition on homosexuality is more flexible and dynamic than one might expect. To address this essential issue, I build the study around the following constructive question: what are the discursive spaces on homosexuality in contemporary reflections within modern Shiʿi legal scholarship? Responding to this central query, the study is premised on the notion that Imāmī legal sources consist of a tradition of sacred (textual) sources, intellectual reasoning, a vast stockpile of (often contrasting) interpretations of these sources, and a distinguished methodological repertoire called ijtihad. Following the same methodology, in this work, I describe, analyse, and critique such textual-exegetical and intellectual-rational discursive aspects concerning homosexuality.

Book excerpt: In Pragmatism in Islamic Law, Ibrahim presents a detailed history of Sunni legal pluralism and the ways in which it was employed to accommodate the changing needs of society. Since the formative period of Islamic law, jurists have debated whether it is acceptable for a law to be selected based on its utility, rather than weighing conflicting articulations of the law to determine the most likely expression of the divine will. Virtually unanimous opposition to the utilitarian approach, referred to as "pragmatic eclecticism," emerged among early Islamic jurists. However, due to a host of changing institutional and socioeconomic transformations, a trend toward the legitimization of pragmatic eclecticism arose in the thirteenth century. Subsequently, the Mamluk authorities institutionalized this pragmatism when Sultan Baybars appointed four chief judges representing the four Sunni schools in Cairo in 1265 CE. After a brief attempt to reverse Mamluk pluralism by imposing the Hanafi school in the sixteenth century, Egypt’s new rulers, the Ottomans, embraced this pluralistic pragmatism. In examining over a thousand cases from three seventeenth- and eighteenthcentury Egyptian courts, Ibrahim traces the internal logic of pragmatic eclecticism under the Ottomans. An array of archival sources documents the manner in which Egyptian society’s subaltern classes navigated Sunni legal pluralism as a tool to avoid more austere legal doctrines. The ensuing portrait challenges the assumption made by many modern historians that the utilitarian approaches adopted by nineteenth- and twentieth-century Muslim reformers constituted a clear rupture with early Islamic legal history. In contrast, many of the legal strategies exercised in Egypt’s partial codification of family law in the twentieth century were rooted in premodern Islamic jurisprudence.

Book excerpt: This handbook examines Pakistan’s 70-year history from a number of different perspectives. When Pakistan was born, it did not have a capital, a functioning government or a central bank. The country lacked a skilled workforce. While the state was in the process of being established, eight million Muslim refugees arrived from India, who had to be absorbed into a population of 24 million people. However, within 15 years, Pakistan was the fastest growing and transforming economy in the developing world, although the political evolution of the country during this period was not equally successful. Pakistan has vast agricultural and human resources, and its location promises trade, investment and other opportunities. Chapters in the volume, written by experts in the field, examine government and politics, economics, foreign policy and environmental issues, as well as social aspects of Pakistan’s development, including the media, technology, gender and education. Shahid Javed Burki is an economist who has been a member of the faculty at Harvard University, USA, and Chief Economist, Planning and Development Department, Government of the Punjab. He has also served as Minister of Finance in the Government of Pakistan, and has written a number of books, and journal and newspaper articles. He joined the World Bank in 1974 as a senior economist and went on to serve in several senior positions. He was the (first) Director of the China Department (1987–94) and served as the Regional Vice-President for Latin America and the Caribbean during 1994–99. He is currently the Chair of the Board of Directors of the Shahid Javed Burki Institute of Public Policy at NetSol (BIPP) in Lahore. Iftekhar Ahmed Chowdhury is a career Bangladeshi diplomat and former Minister of Foreign Affairs in the Government of Bangladesh (2007–08). He has a PhD in international relations from the Australian National University, Canberra. He began his career as a member of the civil service of Pakistan in 1969. Dr Chowdhury has held senior diplomatic positions in the course of his career, including as Permanent Representative of Bangladesh to the United Nations in New York (2001–07) and in Geneva (1996–2001), and was ambassador to Qatar, Chile, Peru and the Vatican. He is currently a visiting senior research fellow at the Institute of South Asian Studies, National University of Singapore. Asad Ejaz Butt is the Director of the Burki Institute of Public Policy, Lahore, Pakistan.
