The financial provisions represent a substantial body of work and it is recognised that their implementation must be carefully managed over a period of time. The financial provisions will be implemented over a number of years, to ensure that appropriate transitional arrangements are put in place. In order that both the UK and Scottish Parliaments are fully informed through this process, section 33 of the Scotland Act 2012 requires the Secretary of State for Scotland and Scottish Ministers to report annually on the implementation of this part of the Act. This is the first of these annual reports and concludes that the implementation of Part 3 of the Scotland Act 2012 is progressing effectively and efficiently

Book excerpt: During the Committee's investigation into the devolution of public finances, Lord Palmerston's assessment of the Schleswig-Holstein question has often sprung to mind. Funding of devolved administrations, particularly with regards to Scotland, is a complex mix of social, economic and political questions; "You would not start from here", has been the lament of many of our witnesses. This inquiry was prompted by the Smith Commission agreement. The Scottish cross-party Smith Commission was established by the Prime Minister, following the September 2014 referendum on Scottish independence, to agree further powers which should be devolved to Scotland. The Committee was particularly interested in the proposals that seek to increase the financial accountability of the Scottish Parliament. The Smith Commission agreement will be delivered through the Scotland Bill 2015 and the renegotiation of the 'fiscal framework' by the UK and Scottish Governments. The fiscal framework sets out how Scotland, Wales and Northern Ireland receive funding from the UK Government and the institutional arrangements that govern the process. The renegotiation of the fiscal framework may also have implications for future funding arrangements for Wales and Northern Ireland. Negotiations on the fiscal framework have yet to be concluded. This report draws attention to certain problems we have identified that the UK Government and devolved administrations need to address: (1) The Absence of the Fiscal Framework; (2) Funding of Devolved Administrations in the UK; (3) Adjustment of the block grant for Scotland to reflect devolved income tax receipts; (4) the second 'no detriment' principle; (5) choice of devolved taxes; (6) borrowing powers; (7) transparency and scrutiny.

The Smith Commission, set up in the wake of the 2014 referendum on Scottish independence, recommended that further powers be devolved to the Scottish Parliament. The Bill is currently being considered in the UK Parliament and soon the Scottish Parliament will do the same when it is invited to scrutinise and give its consent to the legislation. However, the Scotland Bill 2015 is only part of the process of further devolution. In order for the tax and spending provisions contained in the Bill to be successfully devolved, the way in which Scotland is funded must change. The fiscal framework for Scotland underpins the devolution settlement. The success of this latest round of devolution will depend to a large extent on the outcome of negotiations over the framework. Both governments have agreed not to comment on the negotiations while they are ongoing but this has led to concerns of a lack of debate over the appropriate degree of risk and incentives that Scotland should face as a result of the new settlement. As we aim to set out in this Report, these questions are fundamental to the whole process.

The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.

While this is being considered, the Committee calls on the Government to suspend application of the Bedroom Tax for all those tenants to whom a reasonable alternative offer cannot be made. There are not enough smaller houses available for tenants to transfer into. The lack of any alternative offers means that tenants have no choice but to go into arrears if they simply cannot afford the extra costs. Other amendments proposed for the operation of the tax include: exemptions for those disabled people who require a room to store or use equipment or aids; non application where it would be financially perverse to do so - eg where removing fixed aids and adaptations, and then reinstalling them in a smaller home, would be more expensive than the savings over two years; all children of secondary school age should be allowed a bedroom of their own to allow quiet study; all disabled children, of whatever age, should have a bedroom of their own. The Committee also calls for changes to the system of Discretionary Housing Payments, which have been designed by the Government to mitigate the worst impacts of the Bedroom Tax. There should be a standard nationwide entitlement system, across the UK as a whole, rather than the present postcode lottery. The UK and Scottish Governments should make longer term commitments to the provision of DHP payments in order to allow local authorities to plan and structure their budgets.
