Book excerpt: The essays presented in The Ian Willock Collection on Law and Justice in the Twenty-First Century by those who knew Ian Willock, as well as those who have been inspired by his concerns, represent the wide compass of Ian’s interests. These range from a concern with the development of legal regulation to the relationship between social change and the justice system, as well as his particular interest in the accessibility of the justice system. This tribute provides a microcosm of the changes and shifts which occurred in legal education and the legal profession in the years between 1964 and the current century. The profound impact of Ian Willock’s life work is evident through the wide-ranging essays in this collection.

Available in PDF, EPUB and Kindle. Book excerpt: In Western culture, law is dominated by textual representation. Lawyers, academics and law students live and work in a textual world where the written word is law and law is interpreted largely within written and printed discourse. Is it possible, however, to understand and learn law differently? Could modes of knowing, feeling, memory and expectation commonly present in the Arts enable a deeper understanding of law's discourse and practice? If so, how might that work for students, lawyers and academics in the classroom, and in continuing professional development? Bringing together scholars, legal practitioners internationally from the fields of legal education, legal theory, theatre, architecture, visual and movement arts, this book is evidence of how the Arts can powerfully revitalize the theory and practice of legal education. Through discussion of theory and practice in the humanities and Arts, linked to practical examples of radical interventions, the chapters reveal how the Arts can transform educational practice and our view of its place in legal practice. Available in enhanced electronic format, the book complements The Moral Imagination and the Legal Life, also published by Ashgate.

Book excerpt: This title was first published in 2001: Welfare law is a legal field integral to most jurisprudential formulations, whether artificially designated as doctrinal, theoretical or practical. At its core, legal discourse regarding welfare challenges the formulations traditionally viewed as ’pre-legal’, the ’background rules’ of property, tort and contract law. In addition, it affects a large percentage of the world’s population, highlights the social construction of identities and perhaps more than any other area of law, graphically epitomizes the intersection of class, race and gender distinctions. However, within both the legal academy and practice, welfare law has been marginalized and viewed as a field that does not connect to any but a small sector of lawyers and legal clients. Isolated as an arcane domain of either statutory and regulatory legal minutiae or jurisprudential insignificance, welfare law has never realized its potential as a major hub for legal theoretical discourse. The articles in this volume seek to expose the roots of the essentialized view of welfare law as nonessential and re-establish its value and importance.

Available in PDF, EPUB and Kindle. Book excerpt: Sexuality and the Politics of Violence offers a timely and critical exploration of issues of safety and security at the centre of responses to violence. Through a multi-disciplinary analysis, drawing on feminism, lesbian and gay studies, sociology, cultural geography, criminology and critical legal scholarship, the book offers to transform the way we understand and respond to the challenges raised by violence. It breaks new ground in its examination of the rhetoric and politics of violence, property, home, cosmopolitanism and stranger danger in the generation of safety and security. Using interviews, focus groups and surveys with lesbians and gay men, Sexuality and the Politics of Violence draws upon 'real life' experiences of safety and security. It raises some fundamental challenges to the law and order politics of existing scholarship and activism on homophobic hate crime.

Available in PDF, EPUB and Kindle. Book excerpt: Thomas Erskine (1750-1823) was one of the greatest advocates ever to appear in an English court of law. As King’s Counsel he was involved in many celebrated trials, including the prosecution of John Horne Took for seditious libel and of Queen Caroline for adultery. His other notable achievements include the successful defence of Thomas Paine’s Rights of Man, which cost him the post of Attorney-General to the Prince of Wales. Erskine also served as Member of Parliament for Portsmouth and for just one year as Lord Chancellor. Latterly the First Baron Erskine, this book covers his controversial career and rise to high office. An ideal companion to Sir William Garrow (Waterside Press 2010). Reviews 'This commendable study by John Hostettler deserves a wide readership as the Scots may still reasonably take pride in the achievements of Lord Erskine of Restormel Castle (in the Fowey Valley, Cornwall) and English lawyers may understandably recall with respect his marked abilities amongst other great lawyers of the era': SCOLAG 'Almost 200 years after Thomas Erskine's death most barristers and solicitor advocates still aspire to his legendary oratorical and forensic skills. Those who are not familiar with the man would be well advised to read this biography without delay': Law Society Gazette 'This work is of more than historical interest. It shows how the advocate can affect the law, and by doing so, the constitution': Counsel 'Thomas Erskine was one of the bar's greatest names. Few however know this extraordinary story of the man who traced his way from poverty through the navy all the way to the bar and Parliament to the House of Lords and the Woolsack. John Hostettler's biography explores this astonishing man and his even more astonishing life': Litigation 'With eloquent invective Erskine mesmerized juries': Justice of the Peace Author John Hostettler is one of the 1st’s leading legal biographers. He was a practising solicitor in London for thirty-five years as well as undertaking political and civil liberties cases in Nigeria, Germany and Aden An ideal companion to Sir William Garrow (Waterside Press 2010).

Available in PDF, EPUB and Kindle. Book excerpt: British and Canadian Perspectives on International Law examines the impact of public international law on the United Kingdom’s and Canada’s domestic legal systems. It also analyses the contributions of British and Canadian practice to the development of international norms. Topics addressed include international criminal law, international humanitarian law, human rights and human security, asylum, trade, jurisdiction, ‘reception law’ and media portrayals of international law. Whereas international law scholarship usually takes a global, regional or national approach, this book's chapters are written by leading scholars and practitioners from both countries and provide unique comparative views. While there remains much in common between the two states' understandings of international law, recent developments have shown significant points of departure.
