Book Synopsis Great Australian Dissents by : Andrew Lynch
Download or read book Great Australian Dissents written by Andrew Lynch and published by Cambridge University Press. This book was released on 2016-09-08 with total page 393 pages. Available in PDF, EPUB and Kindle. Book excerpt: When judges disagree, those in the minority write a dissenting opinion. This book considers the great dissents in Australian law. Their worth may derive from numerous factors, including their rhetorical force as a piece of legal reasoning or emotive power as a judicial lament for the 'error' into which the majority has fallen; the general importance of the issue at stake; as a challenge to the orthodoxy; and, sometimes, the subsequent recognition of a dissenting opinion's correctness and its ultimate vindication. On some occasions, all these features may be strongly present, on others only some. Through a diverse selection of memorable dissenting opinions, this book illuminates the topic of judicial disagreement more generally - not only through examples of instances when minority opinions have been distinctly valuable, but by drawing out a richer understanding of the attributes and circumstances which lead some dissents to become iconic, while so many lie forgotten.

Book Synopsis Freedom of the Press Vs. Public Access by : Benno C. Schmidt (Jr.)
Download or read book Freedom of the Press Vs. Public Access written by Benno C. Schmidt (Jr.) and published by Praeger Publishers. This book was released on 1976 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book surveys the implications of freedom of the press for a constitutionally rooted public right of access to electronic and print media. Part one provides general perspectives on access to the media, including discussions of access in relation to the Supreme Court, to First Amendment history and theory, to current perceptions of the press, and to a possible remedy for concentration of the media. Part two focuses on access and First Amendment developments in libel and the "public forum." Access to television and radio is the topic of part three; specific investigations of broadcast regulations, the political ramifications of access (the "Equal Opportunities" provision of the Communications Act), the Fairness Doctrine, and the role of public interest are provided. Part four details the significance of the Miami Herald Publishing Company V. Tornillo decision for the future of public access and furnishes concluding remarks on the relationship between access, autonomy, and the First Amendment. (Ks).

Book Synopsis Broadcasting Law and Policy in Australia by : Mark Armstrong
Download or read book Broadcasting Law and Policy in Australia written by Mark Armstrong and published by . This book was released on 1982 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book is vital to anyone connected with the media: students, broadcasters, lawyers, executives, academics, and citizens. It offers the first and only analysis of this important area. More than a text on the letter of the law, it explains what the law is supposed to do, what it actually does, and where it is heading. The book outlines the departments, tribunals, federations and other bodies concerned with communications, and places them in perspective with a history of broadcasting law. It gives access to a range of sources and documents which have been almost impenetrable until now." -- back cover.
