Das ist eine Steigerung von 2,5 % im Vergleich zum Vorjahr, wo mit 190 000 jede 3. Ehe geschieden wurde (7 % mehr als 1996). Schon damals waren mehr als 150 000 Kinder von der Scheidung ihrer Eltern betroffen. Obwohl im letzten Jahr noch 70 % aller Ehen stabil waren, leiden die restlichen 30 % der Familien unter einer hohen Belastung für alle am Scheidungsgeschehen Beteiligten. Solch eine Entscheidung zur Trennung bedeutet eine Auflösung des Familienbundes nicht nur in rechtlicher und sozioökonomischer Hinsicht, sondern auch psychosoziale Bindungen bestehen nicht mehr so wie vorher. Das hat natürlich auch Auswirkungen auf die Kinder, die eine Auflösung der eigenen Familie miterleben. Es wird davon ausgegangen, dass ein Drittel der betroffenen Kinder mittel- bzw. langfristig einen problematischen Entwicklungsverlauf nehmen (1). Die Reaktionen und Bewältigungsstrategien sind abhängig vom Charakter, vom Alter, vom Geschlecht der Kinder, ihrer Familiensituation und dem Umfeld, in dem sie aufwachsen. Auch bei den rechtlichen Regelungen und dem juristischen Verfahren sind die Bedürfnisse und Belange der betroffenen Ehepartner meist zentral. Oft gerät dabei in den Hintergrund, dass eine Trennung die Auflösung einer gesamten Familie bedeutet, in die das gemeinsame Kind unweigerlich mit verstrickt ist. Dadurch bleiben die Emotionen des Kindes oftmals ungeachtet und werden unterdrückt. In Wahrheit stellt die Scheidung jedoch für jedes einzelne Kind einen Schicksalsschlag und Einschnitt in seiner Biographie dar, wenngleich auch jedes Kind mit der Situation unterschiedlich gut oder schlecht zurechtkommt; denn letztendlich ist wie jede Scheidung, auch jedes Scheidungskind einzigartig. Dennoch möchte ich in dieser Arbeit auf das tendenzielle Erleben einer Scheidung aus Kindersicht eingehen und meinen Schwerpunkt auf die möglichen Folgewirkungen richten, die diese belastendende Krisensituation mit sich bringen können. Auf theoretischer Ebene werde ich hierfür zunächst auf das veränderte Konzept und die Bedeutung der Ehe auf soziologischer, als auch auf wissenschaftlicher Ebene eingehen und anschließend einen Überblick über die aktuellen Scheidungszahlen liefern. Darauf folgend werde ich auf das Drei-Phasen-Modell einer Scheidung vorstellen und gleichzeitig der Frage nachgehen, wie betroffene Kinder diese akuten Scheidungsphasen erleben und welche Emotionen damit verknüpft sind. Die Perspektive der Eltern wird hierbei weitestgehend ausgeblendet. Im weiteren Verlauf der Arbeit widme ich mich den unmittelbaren und langfristigen Folgen einer Scheidung für das Kind. Welche tendenziellen kurzfristigen Symptome weisen Kinder, abhängig von Alter und Geschlecht auf? Welche Faktoren tragen zu traumatischen, langfristigen Wirkungen bei und wie sehen diese aus? Aber auch die versöhnliche, positive Seite einer Scheidung wird abschließend im Blick der Arbeit stehen und einen hoffnungsvollen Ausblick liefern. Hierfür werde ich einige Faktoren nennen, die einen positiven Verarbeitungsprozess begünstigen und somit die Frage nachgehen, was dazu beiträgt, dass betroffene Kinder die Scheidung unbelastet und zufrieden überstehen.

Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language.
