La dernière réforme, en deux temps - loi du 26 juillet 2005 sur la sauvegarde des entreprises et ordonnance du 18 décembre 2008, complétées par les décrets d'application du 28 décembre 2005 et du 12 février 2009 - a tout particulièrement mis l'accent sur la nécessité : de favoriser le redressement des entreprises en difficulté par un traitement amiable de ces difficultés, négocié avec ses partenaires ; de faire bénéficier de la protection de la justice le débiteur qui le demande, dès lors qu'il subit des difficultés qu'il n'est pas en mesure de surmonter. Ainsi est réorganisée la procédure de conciliation (ancien règlement amiable) en même temps que créée une nouvelle procédure collective - la procédure de sauvegarde - qualifiée de préventive parce qu'ouverte en l'absence d'une cessation des paiements du débiteur. Dans les deux cas cependant, il s'agit plus d'une adaptation des procédures antérieures dans un contexte nouveau que d'une véritable création ex nihilo. La nouvelle édition de cet ouvrage présente le droit positif, à la gestation compliquée, en intégrant les dernières applications et interprétations jurisprudentielles aussi bien du droit interne que du règlement européen sur les procédures d'insolvabilité. Sont également prises en compte les réformes, importantes et intervenues dans un certain désordre ces dernières années, qui affectent directement ou indirectement le droit des entreprises en difficulté (par exemple la réforme des sûretés et de la fiducie, en trois étapes au moins, ou encore la loi de modernisation de l'économie du 4 août 2008). Pour rester fidèle à l'esprit de la loi, l'auteur a choisi d'ordonner la présentation de la matière autour d'une double distinction : d'abord celle du traitement amiable (1ère partie) et du traitement judiciaire des difficultés (2e, 3e et 4e parties), ensuite celle des procédures judiciaires tendant à la sauvegarde (procédure préventive) ou au redressement (procédure curative) internes de l'entreprise débitrice (2e et 3e parties), et des procédures judiciaires tendant à la liquidation (4e partie).
