Book excerpt: Die vorliegende Textsammlung enthält die Satzung der Europäischen Investitionsbank (EIB) und verschiedene die EIB betreffende Bestimmungen des Vertrags über die Europäische Union, des Vertrags über die Arbeitsweise der Europäischen Union sowie der Protokolle Nr. 6, 7 und 28 zu diesen Verträgen. Die EIB besitzt Rechtspersönlichkeit, ist finanziell autonom und verfügt über eigene Entscheidungsorgane. Die Satzung der EIB ist dem Vertrag über die Europäische Union und dem Vertrag über die Arbeitsweise der Europäischen Union als Protokoll (Nr. 5) beigefügt. Gemäß Artikel 51 des Vertrags über die Europäische Union ist sie Bestandteil beider Verträge. Gemäß Artikel 308 Absatz 3 des Vertrags über die Arbeitsweise der Europäischen Union kann der Rat die Satzung der EIB ändern. Er beschließt im Rahmen eines besonderen Gesetzgebungsverfahrens einstimmig entweder auf Antrag der Europäischen Investitionsbank und nach Anhörung des Europäischen Parlaments und der Kommission oder auf Vorschlag der Kommission und nach Anhörung des Europäischen Parlaments und der Europäischen Investitionsbank. Die Satzung und die oben erwähnten sonstigen Bestimmungen betreffend die EIB wurden im Rahmen des Vertrags von Lissabon verabschiedet. Der aktuelle Text der Satzung berücksichtigt auch i) die gemäß Artikel 4 Absatz 3 der Satzung durch Beschluss des Rates der Gouverneure der EIB vom 31. Dezember 2012 geänderten Artikel 4 Absatz 1 und Artikel 5 Absatz 1, wodurch das Kapital der EIB um 10 000 000 000 EUR erhöht wurde, ii) die Änderungen infolge des Vertrags über den Beitritt der Republik Kroatien zur Europäischen Union am 1. Juli 2013 und iii) den Beschluss des Rates der Gouverneure der EIB vom 1. Juli 2013, den Anteil des von Kroatien gezeichneten Kapitals an die Erhöhung des Kapitals der EIB im Jahre 2012 anzupassen.
