Book Synopsis Under the Ancestors’ Eyes by : Martina Deuchler
Download or read book Under the Ancestors’ Eyes written by Martina Deuchler and published by BRILL. This book was released on 2020-05-11 with total page 631 pages. Available in PDF, EPUB and Kindle. Book excerpt: Under the Ancestors’ Eyes presents a new approach to Korean social history by focusing on the origin and development of the indigenous descent group. Martina Deuchler maintains that the surprising continuity of the descent-group model gave the ruling elite cohesion and stability and enabled it to retain power from the early Silla (fifth century) to the late nineteenth century. This argument, underpinned by a fresh interpretation of the late-fourteenth-century Koryŏ-Chosŏn transition, illuminates the role of Neo-Confucianism as an ideological and political device through which the elite regained and maintained dominance during the Chosŏn period. Neo-Confucianism as espoused in Korea did not level the social hierarchy but instead tended to sustain the status system. In the late Chosŏn, it also provided ritual models for the lineage-building with which local elites sustained their preeminence vis-à-vis an intrusive state. Though Neo-Confucianism has often been blamed for the rigidity of late Chosŏn society, it was actually the enduring native kinship ideology that preserved the strict social-status system. By utilizing historical and social anthropological methodology and analyzing a wealth of diverse materials, Deuchler highlights Korea’s distinctive elevation of the social over the political.
Book Synopsis The Oxford Handbook of International Trade Law by : Daniel L. Bethlehem
Download or read book The Oxford Handbook of International Trade Law written by Daniel L. Bethlehem and published by . This book was released on 2009 with total page 856 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past 10 years, the content and application of international trade law has grown dramatically. The WTO created a binding dispute settlement process and in resolving disputes, the judicial organs of the WTO have built up a substantial amount of new international trade law. Emerging from this new WTO process is an international trade law system that is in some respects self-contained and in other respects overlapping and linked to other international legal, economic and political regimes. The 'boundaries' of trade law are now generating enormous interest and controversy which, at a broader level, is subsumed within the debate over globalization. The detailed development of the rules of international trade is being examined with increasing frequency by scholars, government officials and trade law practitioners. But how does it fit with existing systems? How it is modified by them? How does the international trade law system affect and modify other regimes? This Handbook places international trade law within its broader context, providing comment and critique on contemporary thinking on a range of questions both related specifically to the discipline of international trade law itself and to the outside face of international trade law and its intersection with States and other aspects of the international system. It examines the economic and institutional context of the world trading system, its substantive law (including regional trade regimes) and the settlement of disputes. The final part of the book explores the wider framework of the world trading system, considering issues including the relationship of the WTO to civil society, the use of economic sanctions, state responsibility, and the regulation of multinational corporations.
Book Synopsis Governing the Extractive Sector by : Jeffrey Bone
Download or read book Governing the Extractive Sector written by Jeffrey Bone and published by Bloomsbury Publishing. This book was released on 2021-02-25 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers, and offers solutions to, the problems faced by local communities and the environment with respect to global mining. The author explores the idea of grievance mechanisms in the home states of the major mining conglomerates. These grievance mechanisms should be functional, pragmatic and effective at resolving disputes between mining enterprises and impacted communities. The key to this provocative solution is twofold: the proposal harnesses the power of industry-sponsored dispute mechanisms to reduce the costs and other burdens on home state governments and judicial systems. Critically, civil society actors will be given a role as both advocates and mediators in order to achieve a fair result for those impacted abroad by extractive enterprises. Compelling, engaging and timely, this book presents an innovative approach for regulating the foreign conduct of the extractive sector.

Book Synopsis AAA Handbook on International Arbitration Practice by : American Arbitration Association
Download or read book AAA Handbook on International Arbitration Practice written by American Arbitration Association and published by Juris Publishing, Inc.. This book was released on 2010-09-01 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: Assembled from Dispute Resolution Journal - the flagship publication of the American Arbitration Association - the chapters in the Handbook have all, where necessary, been revised and updated prior to publication. The book is succinct, comprehensive and a practical introduction to the use of arbitration and ADR, written by leading practitioners and scholars. The Handbook has discussions of such topics as confidentiality in arbitration, tips for beginning practitioners, cultural issues in arbitration, and the contrast of civil and common law approaches. International forum selection is discussed, including whether national or regional centers are viable options, and how to save time and money in cross-border disputes. A range of other issues are discussed, such as interim and emergency relief, the use of a preliminary hearing letter, time-management techniques, and discovery and evidence. Ethical concerns are also discussed, including a comparison of arbitrator standards of conduct in international trade and investment disputes, dealing with arbitrator conflicts, and arbitrator disclosure standards. Finally, the work addresses the topics of damages and the review and enforcement of international arbitration awards, including interpretations under the New York Convention. The chapters were selected from an extensive body of writings and, in the main, represent world-class assessments of arbitration and ADR practice. All the major facets of the field are addressed and provide the reader with comprehensive and accurate information, lucid evaluations, and an indication of future developments. They not only acquaint, but also ground the reader in the field.
