Ciò sotto un duplice profilo, sia quello degli obblighi dei datori di lavoro (d.lgs. n. 81/2008), sia quello, diverso, dell’adempimento degli obblighi scaturenti dal rispetto della normativa in tema di Responsabilità Amministrativa degli Enti, di cui al d.lgs. 231/01. Il volume effettua, quindi, in un’ottica penalistica d’impresa, un’analisi quanto più dettagliata ed operativa del quadro normativo/sanzionatorio scaturito dall’emergenza epidemica in atto, così da fornire, da un lato, un’interpretazione sistematica delle norme e, dall’altro, “spunti operativi” che agevolino le imprese nel difficile compito di apprestare gli strumenti necessari per tutelare la salute e la sicurezza dei lavoratori rispetto al contenimento del rischio di contagio da COVID-19, anche in relazione all’utilizzo di sistemi digitali di “contact tracing”. L’opera consente inoltre di affrontare le principali tematiche e criticità connesse alla prova di una responsabilità penale in capo al datore di lavoro in conseguenza di eventuali contestazioni derivanti dall’omesso adempimento degli obblighi precauzionali allo stesso imposti dalle norme.?
