Book excerpt: The Directive on Restructuring and Insolvency sets minimum standards for restructuring and certain insolvency matters, but its harmonization effect will be limited given multiple options for implementation, likely leading to divergent restructuring models in Europe. These options reveal different policy approaches to the regulation of restructuring and insolvency. The analysis in this paper aims to illustrate the breadth of the policy choices and their consequences for restructuring activity. States should carefully design restructuring procedures to avoid the negative economic effects of certain options that could undermine creditors’ rights or result in unpredictable outcomes, particularly in cross-border cases.

Book excerpt: The global financial crisis has left a large private sector debt overhang and high levels of non- performing loans (NPLs) in several European countries. Small and medium-size enterprises (SMEs) represent a significant and weak segment of the nonfinancial corporate sector. SMEs face a number of legal, financial, and regulatory challenges to restructuring that differ from those of larger corporates, such as a rigid and costly insolvency regime, a higher fixed cost to loan restructuring, and the lack of alternative sources of financing. Given SMEs’ large presence and close links to the banking system, addressing the SME loan problem in Europe will be critical for strengthening bank and corporate balance sheets and supporting a more robust and sustained recovery.

Book excerpt: Examining the current trends in regional economic development in Europe, Restructuring Industry and Territory explores ways in which the restructuring of industry and territorial development relate to each other, their emergent interdependency and role in economic development. The book argues that the structural and cultural features of regions play an important part in helping or hindering concerted policies for regional development. Using case studies from different industries in a variety of regions, the contributors show that the pressures for restructuring, such as internationalisation or even 'globalisation', have been mediated by formerly nationally rooted industries in Europe becoming increasingly integrated, due to the ongoing processes of technological and organisational innovation, and political regulation.

Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays offers a survey of restructuring processes in Europe and their outcomes. . . Given the likelihood of increased dislocation in labor markets, the book is a timely contribution. Recommended. R.L. Hogler, Choice This detailed, comprehensive study on downsizing in Europe is underpinned by cross-national, interdisciplinary empirical research on restructuring management in five European countries: Belgium, France, Germany, Sweden, and the United Kingdom. It contains systematic national comparative overviews, and transversal analyses of more than 30 in-depth case studies, taking into account a broad range of perspectives across professional human resources managers, unions representatives, local and national civil servants, social workers and physicians. The authors examine strategic choices and practices in national and local contexts, showing that the practice of restructuring is not as heterogeneous as many previous studies have indicated or predicted. Systematic policy proposals for better economic and social management of restructuring are also prescribed. This team of well-known economists and social scientists have prepared a book that will appeal to consultants and human resource managers and employees, especially in transnational firms, as well as to students in industrial relations, in labour economics, and in sociology. It will also be of special interest to members of the European Commission and policymakers involved in employment and social affairs.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a series of extremely stimulating analyses of the process of corporate restructuring in the new Member States of the EU. Particularly noteworthy is the book's focus on the Central and Eastern European Countries (CEECs) that have joined the EU since 2004, an area which has not been prominent in the research on corporate restructuring conducted in Western Europe in the last twenty years. As with their Asian counterparts, these States have generally been perceived as a threat to employment in Western Europe due to the former's benefiting from outsourcing away from the latter. By moving east, the book allows for a different perspective on the restructuring process, by placing it in the context of both Europe and the numerous changes affecting the CEECs. The book seeks to understand the impact of European- and national-level policies on the concept of restructuring, the role of the «acquis communautaire», and the place of social and political actors in the process of change in the context of new Member States, where multinational firms have developed mobility and establishment strategies within the context of broader European and global ones. The density of this collection, its wealth in terms of substantive teachings, and its use of a comparative and multidisciplinary approach that links law, political science, sociology and economics make it an essential resource for those wishing to understand restructuring in the European space after the enlargements of 2004 and 2007 and the impact of European policies and the European Social Model.

This book was released on 2013-01-11 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1999. Small businesses now constitute the most dynamic element of growth in the emerging markets of the Central and Eastern European region. This book argues that the small and medium sized enterprise (SME) sector has contributed more to the growth of these countries in transition than have privatized state enterprises and the public sector. In 1989 most of the countries of Eastern and Central Europe were still under an economic system dominated by state-owned enterprises. Since then a process of liberalization has been unleashed to promote free market policies. This has involved programs of privatization and restructuring of public enterprises, as well as the promotion of policies to enable a private sector to develop. Small businesses are creating thousands of new jobs while large companies are "retrenching and downsizing" their work force. In some countries of the region this process is much further along than in others. However, the SME sector has developed at a more rapid pace than has the privatization of the large public companies. There has been a flurry of new enterprises springing up throughout the region which are "trickling up" in a frequently hostile environment against tremendous odds, and yet managing to have a pronounced impact on their respective economies. Small businesses have taken over in sectors that used to be dominated by big enterprises, primarily in services and consumer products. They have provided a crucial outlet for pent-up entrepreneurial talent that had remained dormant during the long period of state domination. This work urges legislators, policy-makers, and development agencies alike to take account of the importance of the SME's in their legislation and planning. Given a more favorable environment, these small businesses will provide even greater impetus for economic growth. Equally important is for entrepreneurs themselves to be convinced of the rightness of their path in societies that have traditionally looked down upon profit-seekers as unscrupulous and selfish. If the CEE region is to achieve its full potential of economic growth, policies and support mechanisms to promote the SME sector will be needed to assure a favorable environment.

Book excerpt: The COVID-19 pandemic has increased insolvency risks, especially among small and medium enterprises (SMEs), which are vastly overrepresented in hard-hit sectors. Without government intervention, even firms that are viable a priori could end up being liquidated—particularly in sectors characterized by labor-intensive technologies, threatening both macroeconomic and social stability. This staff discussion note assesses the impact of the pandemic on SME insolvency risks and policy options to address them. It quantifies the impact of weaker aggregate demand, changes in sectoral consumption patterns, and lockdowns on firm balance sheets and estimates the impact of a range of policy options, for a large sample of SMEs in (mostly) advanced economies.
