Book excerpt: Excerpt from Responsibility in Law: An Inquiry Into the Meaning of Law and of Responsibility IN the elaboration of this Treatise, the endeavour has been made to keep it within very modest limits, to state the arguments as concisely as possible, and to refer to well-known works either by way of illustration of the line of thought or of support to the views that are intended to be expressed. By these means it is hoped that the tediousness of a dry subject may be lessened to the reader, and at the same time that, by means of the many references in footnotes, it may be easy to follow out the processes of reasoning by which some of the conclusions have been arrived at. Book excerpt: In the wake of the adoption by the International Law Commission of a complete set of articles on state responsibility in international law in 2001, this collection assembles a number of essays tracing key debates which have marked the evolution of this field over the last fifty years. These include explorations of the general theory of state responsibility (link between ’primary’ and ’secondary’ rules, the place of due diligence, the link between liability and wrongfulness), the consequences of an internationally wrongful act (nature of remedies, suitability of countermeasures, third states and the shift from bilateralism to community interests in the law of state responsibility), the debate over criminalizing state responsibility, and the continuing relevance of the law of injuries to aliens. The collection also contains a series of essays offering critical perspectives on state responsibility, including feminist and developing world perspectives. It is completed by an extensive and up-to-date bibliography.

Available in PDF, EPUB and Kindle. Book excerpt: Recent decades have witnessed an enthusiastic retrieval of eudaimonism, according to which the virtuous life is the happy life. But the critique launched by Kant - that eudaimonism is egoistic and distorts the character of duty or obligation - has persisted. Should I develop the virtues because these are the traits I need in order to flourish? Is it facts about my own happiness that determine my obligations to others? In this book, Jennifer Herdt deftly sifts through these debates, showing why we should embrace 'ecstatic' or 'goodness-prior' eudaimonism while rejecting 'welfare-prior' forms of eudaimonism. Grasping the character of ecstatic eudaimonism, she argues, has major implications, overcoming the common assumption of a sharp break between pagan and Christian eudaimonism, as well as of a late medieval or Protestant repudiation of eudaimonism in favor of divine command theory. Agents cannot rightly respond to the goods they encounter unless they respond to them precisely as good, and not merely as a means to promoting their own welfare; in responding well, their agency is thereby necessarily perfected. In conversation with vital strands of contemporary moral philosophy, Herdt goes on to articulate the distinctive character of obligation as a feature of accountability relations among agents. Assuming Responsibility offers a fresh point of departure for theological and philosophical approaches to virtue ethics, moral agency, and the contested relationship between the good and the right.

Available in PDF, EPUB and Kindle. Book excerpt: autonomy principally in tenns of the agent's conscious choice of ends or conduct. From this, the cognitivist emphasis on mental states and their contents naturally follows. The presence of specified mental states, as signifying agent choice, thus becomes the hallmark of responsible conduct. Capacities model theorists, by contrast, interpret personal autonomy and agent responsibility in tenns of the looser notion of 'control'. From this perspective, conscious choosing is but one (highly responsible) instance of such control, and the presence or absence of mental states is primarily relevant to detennining degrees of responsibility. The examination of these two models occupies the bulk of this manuscript. Exploration of the capacities model and criticism of the orthodox view also generate treatment of legal issues such as the use of negligence liability, the nature of criminal omissions, the character of various legal defenses, and so on. Chapters 2 and 3 set out some of the thematic arguments outlined above and introduce tenninology and useful distinctions. Chapters 4 through 7 provide substantive analyses of agent responsibility and of standards of criminal liability. In these chapters, I argue for the comparative superiority of the capacities model of responsibility and offer recommendations for changes in current legal conceptions and standards of liability. Each chapter centers on an element of individual responsibility and related legal concerns. The final chapter, Chapter 8, comprises an overview of the integrated theory of responsibility and liability and its comparison with the traditional view.
