Il est vrai que l'intelligence artificielle conduira parfois à une diminution des risques. Il suffit de songer au robot chirurgien dont la précision des actes est sans égal ou encore au véhicule autonome bien plus fiable qu'un conducteur humain et donc potentiellement moins accidentogène, jusqu'à 80 % prédisent même certaines experts. Mais d'autres fois, elle pourra se révéler source de dommages dans des circonstances inédites, en particulier dans les hypothèses où cette technologie sera dotée de fonctions cognitives, et pourra pour cette raison s'adapter à son environnement, progresser, prendre des initiatives et à cette occasion provoquer des préjudices. Qui dans ce cas devra assumer la charge de la réparation ? L'ouvrage ici présenté entend faire le point sur les différentes interférences existantes entre la responsabilité civile et l'intelligence artificielle. Il est issu d'un séminaire du Groupe européen de recherche en droit de la responsabilité et des assurances (GRERCA) qui s'est tenu en octobre 2021 à l'Université de Lyon 3 et qui a été organisé par l'Équipe de recherche Louis Josserand avec le support de la Chaire-Miroir Lyon-Ottawa. Il propose de manière inédite, à notre connaissance, de comparer l'appréhension par les différents droits européens (allemand, anglais, belge, espagnol, français, Italien, roumain, suisse) des défis liés à l'intelligence artificielle dans le domaine de la responsabilité civile et de l'assurance avec parfois un regard nord-américain venant enrichir la réflexion. Des rapports de synthèse viennent coiffer les rapports nationaux sur les différentes thématiques abordées dans ce livre.
