Book excerpt: The increasing Europeanisation of the law of delict/torts has produced textbooks, casebooks, monographs, and also sets of model rules of a genuinely European character. A major gap still existing today relates to the experiences gathered in the national legal systems over the past decades. The present work attempts to fill this gap for one key element of tort law: the notion of damage. It thus does what the previous volume in the ‘Digest of European Tort Law’ series did for another key element, ie natural causation. Once again, the publication contains a selection of the most important cases decided in 26 states across Europe as well as by the European Court of Justice. For each case the facts and the relevant court decision are presented, and the decision is analysed within the wider context of the development of the respective legal system. In addition, the editors provide comparative analyses of the case law reported in this volume concerning all the specific problems raised under the heading of damage. The publication also looks into how key cases would be resolved under the European model rules drafted in the field of tort law; and it also highlights cases from earlier periods of legal history. The editors believe that the material gathered here may provide guidance for an organic convergence of the national legal systems in Europe. It constitutes the basis of an acquis commun that is infinitely richer (though also much more complex) than the rather bland and abstract concepts contained in national codifications, European legislation, and the modern model rules.

Bringing together a team of leading scholars, this book fills the gap by providing an in-depth analysis of key issues in the history of urban planning and discussing the key challenges confronting contemporary urban planning in these countries. The book argues that urban planning is a non-neutral and non-value free kind of public action and, therefore, ideology, planning theories, urban models and the ideological role urban planning has played are some of the key issues addressed. For that reason, the practice of Urban Planning is also seen as the outcome of a complex interrelationship between structure and agency, with the role of key planers being examined in some of the chapters. The findings and insights presented by the contributing authors confirm previous research on urban planning in the colonial and postcolonial periods in Lusophone African countries and at the same time break fresh ground and offer additional insights as new evidence has been collected from archives and in fieldwork carried out by a new generation of researchers. Book excerpt: The present legal report on the EAF used the diagnostic tool to assess the alignment of selected policy and legal instruments of Angola with the EAF. This assessment analysed the extent to which 82 EAF legal requirements are reflected in Angola' policies and legislation relevant to the country’s fisheries sector and other sectors that interact with fisheries (such as environment, wildlife and ecosystems, maritime). Based on this preliminary diagnosis, gaps were identified in the assessed instruments, and recommendations on specific areas that need further improvement. Legislating for an ecosystem approach to fisheries (EAF) is complex, due to the holistic nature of EAF involving multiple factors that underpin the social, economic, environmental, and institutional aspects of fisheries sustainability. These factors include ecosystems integration, risks, inter-sectoral collaboration, research, participatory processes, monitoring, control, surveillance, and enforcement, among others. To assess how the EAF is being implemented through national policy and legal frameworks, FAO developed A diagnostic tool for implementing an ecosystem approach to fisheries through national policy and legal frameworks. This report was elaborated following a participatory approach with the involvement of the national competent authorities of Angola. Drafted in July 2021, the report was submitted to the national authorities of Angola in October 2021. The Ministry of Agriculture and Fisheries of Angola endorsed this EAF Legal Report of Angola in June 2022.

The global commons have always been understood as geographical spaces that exist only outside the political borders of states. A vital good such as a stable climate exists both within and outside all states, and shows traditional legal approaches to be ecological nonsense. With the recent possibility of measuring and monitoring the state and functioning of the Earth System through the Planetary Boundaries framework, it is now possible to define a “Safe Operating Space of Humankind” corresponding to a biogeophysical state of Earth. In this sense, the Common Home of Humanity is not a planet with 510 million square kilometres, but is a specific favourable state of the Earth System. Recent major scientific advances anticipate a legal paradigm shift that could overcome the disconnection between ecological realities and existing legal frameworks. If we recognize this qualitative and non-geographic space as a Common Natural Intangible Heritage of Humankind, all positive and negative “externalities” end up being included within a new maintenance system of the Common Home.
