Book Synopsis The Legacies of Law by : Jens Meierhenrich
Download or read book The Legacies of Law written by Jens Meierhenrich and published by Cambridge University Press. This book was released on 2008-10-13 with total page 387 pages. Available in PDF, EPUB and Kindle. Book excerpt: Focusing on South Africa during the period 1650–2000, this book examines the role of law in making democracy work in changing societies. The Legacies of Law sheds light on the neglected relationship between path dependence and the law. Meierhenrich argues that legal norms and institutions, even illiberal ones, have an important - and hitherto undertheorized - structuring effect on democratic outcomes. Under certain conditions, law appears to reduce uncertainty in democratization by invoking common cultural backgrounds and experiences. In instances where interacting adversaries share qua law reasonably convergent mental models, transitions from authoritarian rule are shown to be less intractable. Meierhenrich's historical analysis of the evolution of law - and its effects - in South Africa during the period 1650–2000, compared with a short study of Chile from 1830–1990, shows how, and when, legal norms and institutions serve as historical causes to both liberal and illiberal rule.

Available in PDF, EPUB and Kindle. Book excerpt: The "African Yearbook of International Law" provides an intellectual forum for the systematic analysis and scientific dissection of issues of international law as they apply to Africa, as well as Africa's contribution to the progressive development of international law. It contributes to the promotion, acceptance of and respect for the principles of international law, as well as to the encouragement of the teaching, study, dissemination and wider appreciations of international law in Africa. A clear articulation of Africa's views on the various aspects of international law based on the present realities of the continent as well as on Africa's civilization, culture, philosophy and history will undoubtedly contribute to a better understanding among nations. The "African Yearbook of International Law" plays an important role in examining the tensions underlying the State in Africa, and by shedding more light on the causes of the fragility of African State institutions so as to facilitate the identification of appropriate remedies. The tension and interrelationships among issues such as territorial integrity, self determination, ethnic diversity and nation-building are constantly addressed. Development, human rights and democratization in Africa are also the subject of continuous attention and examination. The Special Theme of this volume is Human Rights and Development in Africa'.

Book Synopsis International Mediation in Civil Wars by : Timothy D Sisk
Download or read book International Mediation in Civil Wars written by Timothy D Sisk and published by Routledge. This book was released on 2009-01-08 with total page 266 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book evaluates the role of international mediators in bringing civil wars to an end and makes the case for ‘powerful peacemaking’ – using incentives and sanctions – to leverage parties into peace. As internal violence within countries is a hugely significant threat to international peace in the post-Cold War era, the question of how these wars end has become an urgent research and policy question. This volume explores a critical aspect of peacemaking that has yet to be sufficiently evaluated: the turbulent period beyond the onset of formal or open negotiations to end civil wars and the clinching of an initially sustainable negotiated settlement. The book argues that the transnational flow of weapons, resources, and ideas means that when civil wars today end, they are more likely to do so at the negotiating table than on the battlefield. It uses bargaining theory to develop an analytical framework to evaluate peace processes – moving from stalemate in wars to negotiated settlement – and it rigorously analyses the experiences of five cases of negotiated transitions from war and the role of international mediators: South Africa, Liberia, Burundi, Kashmir, and Sri Lanka.

Download or read book Rethinking the Rise and Fall of Apartheid written by Adrian Guelke and published by Bloomsbury Publishing. This book was released on 2017-03-16 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: Providing a much-needed antidote to recent revisionist attempts to 'rehabilitate' apartheid, this major new text by a leading authority offers a considered and substantive reassessment of the nature, endurance and significance of apartheid in South Africa as well as the reasons for its dramatic collapse. Paying particular attention to the international dimension as well as the domestic, the author assesses the impact of anti-apartheid protest, of changing attitudes of Western governments to the apartheid regime and the evolution of South African government policies to the outside world.
