Available in PDF, EPUB and Kindle. Book excerpt: A history of the successes of the human rights movement and a case for why human rights work Evidence for Hope makes the case that yes, human rights work. Critics may counter that the movement is in serious jeopardy or even a questionable byproduct of Western imperialism. Guantánamo is still open and governments are cracking down on NGOs everywhere. But human rights expert Kathryn Sikkink draws on decades of research and fieldwork to provide a rigorous rebuttal to doubts about human rights laws and institutions. Past and current trends indicate that in the long term, human rights movements have been vastly effective. Exploring the strategies that have led to real humanitarian gains since the middle of the twentieth century, Evidence for Hope looks at how essential advances can be sustained for decades to come.

Available in PDF, EPUB and Kindle. Book excerpt: Over the past sixty years the regional human rights systems have surpassed the UN human rights bodies in affording protection to the victims of human rights violations. Most of these systems have courts that are empowered to issue legally binding judgments and reparations for violations of human rights, which states have been unwilling to accord the UN system. The essays selected for this volume examine the structure and functioning of the principal regional human rights systems in the world today: 1) the Inter-American Commission and Court of Human Rights, 2) the European Court of Human Rights, 3) the African Commission and Court of Human and Peoples’ Rights and 4) the ASEAN Intergovernmental Human Rights Commission. These systems guarantee primarily civil and political rights. Central to all four systems is the necessity of a democratic form of government to guarantee these rights, although not all governments, parties to these regional treaties, are democracies. These articles trace the history of these systems, in particular, the expansion of their membership to include almost all independent countries in the region, and their evolution towards recognition of a 'right to democracy'.

Heinz and published by BRILL. This book was released on 2021-09-27 with total page 902 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the gross human rights violations that characterized the military repression in Argentina, Brazil, Chile and Uruguay from the 1960s to the 1980s. Dr Wolfgang Heinz, the author of three of the four case studies is a German scholar. The second author, Dr Hugo Frühling, is a Chilean researcher. Both are renowned human rights specialists who have done in-depth research on the causes of gross human rights violations in these countries. They have interviewed generals and officers directly involved in the repression. They have unearthed secret documents and, building on existing scholarship, they have managed to draw a unique picture of the mechanisms of repressive domestic social control. They have investigated international factors as well as the dynamics of the interaction between guerrilleros and urban terrorists on the one hand, and the military, the police forces and the death squads on the other. The result is a comprehensive volume, broad and comparative in scope, and written with clinical detachment but also with humanitarian sympathy for the victims of repression.

Available in PDF, EPUB and Kindle. Book excerpt: This book addresses current developments in transitional justice in Latin America – effectively the first region to undergo concentrated transitional justice experiences in modern times. Using a comparative approach, it examines trajectories in truth, justice, reparations, and amnesties in countries emerging from periods of massive violations of human rights and humanitarian law. The book examines the cases of Argentina, Brazil, Chile, Colombia, Guatemala, El Salvador, Paraguay, Peru and Uruguay, developing and applying a common analytical framework to provide a systematic, qualitative and comparative analysis of their transitional justice experiences. More specifically, the book investigates to what extent there has been a shift from impunity towards accountability for past human rights violations in Latin America. Using ‘thick’, but structured, narratives – which allow patterns to emerge, rather than being imposed – the book assesses how the quality, timing and sequencing of transitional justice mechanisms, along with the context in which they appear, have mattered for the nature and impact of transitional justice processes in the region. Offering a new approach to assessing transitional justice, and challenging many assumptions in the established literature, this book will be of enormous benefit to scholars and others working in this area.
