Available in PDF, EPUB and Kindle. Book excerpt: At the start of the 21st century, some 2 million Europeans were detained against their will in prisons, police stations, mental health institutions or other detention centres. It is generally recognised that protection against the arbitrary deprivation of liberty and the prevention of ill-treatment reflect the extent to which states respect human rights and human dignity, when these can be jeopardised by demands for security and efficiency. This book describes the European system for the protection of people deprived of their liberty and how this has evolved over the past fifty years. It discusses the different initiatives taken by the Council of Europe in this area, of which the European Convention on Human Rights and the Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment are the most significant.

Available in PDF, EPUB and Kindle. Book excerpt: Protecting human rights and promoting democracy are the Council of Europe's two main tasks. But to what extent do the 47 member states live up to their commitments in these two crucial areas? The Parliamentary Assembly of the Council of Europe tried to answer this questionin an unprecedented political debate during its April 2007 session. This first debate was attended by parliamentarians from throughout Europe, the main partners in the global human rights community - the UN High Commissioner for Human Rights, Amnesty International and Human Rights Watch - and the managers of the main Council of Europe monitoring mechanisms. The texts contained in this publication show that despite undoubted progress, Europe is still afflicted by serious human rights violations, including enforced disappearances, extra-judicial executions, torture and secret detentions, as well as shortcomings in democratic processes.

Available in PDF, EPUB and Kindle. Book excerpt: This volume addresses interrogation and torture at a unique moment. Emerging scientific research reveals non-coercive methods to be the most effective interrogation techniques. And efforts are now being made to integrate this science and practice into international law and global policing initiatives. Contributors present cutting-edge research on non-coercive interrogation techniques and show how this knowledge is brought to bear on the realm of international law. Such advancements have the potential to transform the conversation on interrogation and torture in many disciplines, and the contributions in this edited volume are meant to spark those discussions. Moreover, this book can serve as a guide for policymakers who seek lawful, ethical, human-rights compliant--and the most effective--methods to obtain reliable information from those perceived to pose a threat to public safety. To achieve these aims the editors have brought together highly experienced practitioners and leading scholars in law, philosophy, psychology, neuroscience, social science, national security, and government.

By covering the 20 years between July 1999 and June 2019, this book updates a study done 20 years ago.

Book excerpt: International anti-terrorism measures existed long before 11 September 2001 but have increased markedly since. A myriad of norms in different branches of law are now deployed to confront transnational and domestic terrorism. There is also a proliferating body of 'soft law' addressing terrorism, stemming from United Nations organs, specialised international bodies and regional organisations. It is timely to draw together these diverse legal developments over time into a single reference work. Bringing the original documents together provides for ease of reference and enables scholars, practitioners and students to more easily compare and contrast various sources. The book's coverage is comprehensive (thematically, organisationally, geographically and temporally) and open to a balance of sources (hard and soft), but is judicious in its selection and prioritisation of the most significant and representative documents - in a field where there are many repetitive or insubstantial documents. Importantly, the book looks beyond the traditional trans-Atlantic bias towards European, British and American sources in this area to include materials from Asia, Africa, Latin America and the Middle East. Taken as a whole, the book aids in evidencing the emerging field of international anti-terrorism law.

Available in PDF, EPUB and Kindle. Book excerpt: In the past three decades, international and regional human rights bodies have developed an ever-lengthening list of measures that states are required to adopt in order to prevent torture. But do any of these mechanisms actually work? This study is the first systematic analysis of the effectiveness of torture prevention. Primary research was conducted in 16 countries, looking at their experience of torture and prevention mechanisms over a 30-year period. Data was analysed using a combination of quantitative and qualitative techniques. Prevention measures do work, although some are much more effective than others. Most important of all are the safeguards that should be applied in the first hours and days after a person is taken into custody. Notification of family and access to an independent lawyer and doctor have a significant impact in reducing torture. The investigation and prosecution of torturers and the creation of independent monitoring bodies are also important in reducing torture. An important caveat to the conclusion that prevention works is that is actual practice in police stations and detention centres that matters - not treaties ratified or laws on the statute book.
