Book excerpt: This Green Paper sets out plans for fundamental changes to the criminal justice system and addresses the three priorities of punishing offenders, protecting the public and reducing reoffending. It seeks to set out an intelligent sentencing framework, coupled with more effective rehabilitation. Despite a 50% increase in the budget for prisons and managing offenders in the last ten years, almost half of all adult offenders released from custody reoffend within a year as well as 75% of youth custody offenders. These proposed reforms will seek to make prisons places of hard work and industry. There will be a greater use of strenuous, unpaid work as part of a community sentence alongside tagging and curfews. There will also be a greater focus on the enforcement and collection of fines, and a much stronger emphasis on compensation for victims of crime. Six new rehabilitation programmes will be piloted on a payment by results basis. Treatment rather than prison will be the option for the less serious offenders with mental illness and drug dependency. The proposals also seek to introduce more straightforward sentencing alongside greater transparency from the courts. The publication is divided into seven chapters, covering the following areas: punishment and payback; rehabilitating offenders to reduce crime; payment by results; sentencing reform; youth justice and working with communities to reduce crime, along with two annexes.

Book excerpt: One of the alleged benefits of the recent global movement to strengthen intellectual property rights (IPRs) is that such reforms accelerate transfers of technology between countries. Branstetter, Fisman, and Foley examine how technology transfer among U.S. multinational firms changes in response to a series of IPR reforms undertaken by 12 countries over the 1982-99 period. Their analysis of detailed firm-level data reveal that royalty payments for intangibles transferred to affiliates increase at the time of reforms, as do affiliate research and development (R & D) expenditures and total levels of foreign patent applications. Increases in royalty payments and R & D expenditures are more than 20 percent larger among affiliates of parent companies that use U.S. patents more extensively prior to reform and therefore are expected to value IPR reform most. This paper--a product of Trade, Development Research Group--is part of a larger effort in the group to understand the global impact of stronger intellectual property rights.

Later that day he became unwell and was taken to hospital, where he was treated for urinary sepsis as well as a grade 4 necrotic (dead tissue) pressure ulcer on his sacrum. He was treated with antibiotics and recovered somewhat, but he died on 23 November 2009. Mrs L was not satisfied with the responses to her complaints to the Council and the Trust, and complained to the Ombudsmen. Their investigations find service failure by both Council and Trust for the care provided in the home and by the nurse. They also found failings in record keeping at the home and maladministration by both Council and Trust in dealing with Mrs L's complaints. The Council and the Trust's successor (Wakefield Clinical Commissioning Group) are instructed, within three months: to write to Mrs L apologising for the service failures and distress caused by the maladministration; to compensate her for the poor complaint handling; and to prepare action plans that describe what they have done to ensure they have learnt the lessons from the failings identified and what they have done or plan to do to avoid a recurrence.
