Book excerpt: Presidents Lyndon Johnson and Richard Nixon dramatically expanded the federal government's domestic security apparatus to cope with social unrest that rocked their administrations. By the mid-1970s, the Justice Department and Army maintained some 400 databanks containing nearly 200 million files on supposedly subversive individuals and organizations. Katherine Scott chronicles the subsequent public response to that government action: a determined citizens' movement to rein in the state. She details the efforts of a group of unheralded heroes who battled to reinvigorate judicial, legislative, and civic oversight of the executive branch in order to curtail and prevent future abuses by government agencies. Working closely with allies in Congress, they challenged state power, instituted open government policies, and protected individual privacy rights. Scott has assembled a cast of characters with compelling stories: Russ Wiggins of the Washington Post, who organized a citizens' campaign for government transparency; Representative John Moss, who called attention to government censorship; ACLU Director Aryeh Neier, who created a legal strategy for judicial oversight of executive branch security measures; Senator Sam Ervin, a civil libertarian who demanded greater oversight of the executive branch; and Morton Halperin, a former NSC staff member, who called attention to the gross constitutional violations of the nation's top security agencies. Rejecting the agendas and methods of both the radical left and the antigovernment right, these progressive reformers sought to bring the American state in line with democratic practice. When Army Captain Christopher Pyle blew the whistle on the U.S. Army's domestic surveillance program, reformers had evidence of illegal domestic spying that they had long suspected but could not confirm. Scott explores how his action united liberals and conservatives to end such abuses. She also assesses how Watergate prompted broad debate in the public sphere about the problems of executive power, the need for greater transparency in domestic security policy, and greater oversight of the activities of the FBI and CIA. These reformers' efforts bore fruit with the passage of a series of major legislative reforms, including the 1974 Freedom of Information Act revisions, the 1974 Privacy Act, the 1976 Government in Sunshine Act, and the 1978 Foreign Intelligence Surveillance Act. Now that government surveillance of citizens has returned to public consciousness in the wake of 9/11, Scott's stirring account reminds us that power still resides with the people.

It examines the neo-progressive movement to institutionalize a new domestic policy regime, in an attempt to force government transparency, protect individual privacy from state intrusion, and create new judicial and legislative checks on domestic security operations. It proceeds chronologically, first outlining the state's overwhelming response to the domestic unrest of the 1960s. During this period, the Department of Justice developed new capacities to better predict urban unrest, growing a computerized databank that contained millions of dossiers on dissenting Americans and the Department of Defense greatly expanded existing capacities, applying cold war counterinsurgency and counterintelligence techniques developed abroad to the problems of protests and riots at home. The remainder of the dissertation examines how the state's secret response to unrest and disorder became public in the early 1970s. It traces the development of a loose coalition of reformers who challenged domestic security policy and coordinated legislative and litigative strategies to check executive power.

Wallison argues that the administrative agencies of the executive branch have gradually taken over the legislative role of Congress, resulting in what many call the administrative state. The judiciary bears the major responsibility for this development because it has failed to carry out its primary constitutional responsibility: to enforce the constitutional separation of powers by ensuring that the elected branches of government—the legislative and the executive—remain independent and separate from one another. Since 1937, and especially with the Chevron deference adopted by the Supreme Court in 1984, the judiciary has abandoned this role. It has allowed Congress to delegate lawmaking authorities to the administrative agencies of the executive branch and given these agencies great latitude in interpreting their statutory authorities. Unelected officials of the administrative state have thus been enabled to make decisions for the American people that, in a democracy, should only be made by Congress. The consequences have been grave: unnecessary regulation has imposed major costs on the U.S. economy, the constitutional separation of powers has been compromised, and unabated agency rulemaking has created a significant threat that Americans will one day question the legitimacy of their own government. To address these concerns, Wallison argues that the courts must return to the role the Framers expected them to fulfill.

Book excerpt: The Sustainable Sites Initiative (SSI) put forth by the American Society of Landscape Architects and the Lady Bird Johnson Wildflower Center is a set of standards which promotes sustainable land development and management practices. The SSI allows the role of the landscape architect to become increasingly important with society's push to be sustainable. This has become evident with the involvement of landscape architects in projects not traditionally associated with the profession. Equestrian facilities that were once designed solely by "horse people" are now being designed by architects and landscape architects. Equestrian facilities are complex developments that have multiple functions and needs, most importantly being the safety of the horse and rider. Kansas State University has determined a need for a new facility to host the equestrian needs of the campus and has chosen a site located near the corner of Kimball Avenue and Denison Avenue, north of the main campus. Using the location chosen by K-State as a hypothetical site, a program for the EquiCenter was developed to meet the needs of the Animal Science Program, the equestrian and rodeo teams and the Equine Assisted Human Development and Rehabilitation Program. Precedent studies informed the early stages of this project and a thorough review of the SSI led to a selection of credits for application in this project. The selected credits were then applied to the equestrian facility program and the site in a design process. Evaluation of the design concepts yielded a determination regarding the ability of this facility to receive a sustainability rating. Due to constraints of the site and the SSI, it has been determined that the K-State EquiCenter will not be eligible to be rated sustainable under the Sustainable Sites Initiative. The SSI presented unique challenges in developing the equestrian facility. These challenges presented opportunities to discuss limitations and recommend changes to the SSI that may allow equestrian facilities to receive a sustainability rating in the future.

Book excerpt: Alabamians in Blue offers an in-depth scholarly examination of Alabama’s black and white Union soldiers and their contributions to the eventual success of the Union army in the western theater. Christopher M. Rein contends that the state’s anti-Confederate residents tendered an important service to the North, primarily by collecting intelligence and protecting logistical infrastructure. He highlights an underappreciated period of biracial cooperation, underwritten by massive support from the federal government. Providing a broad synthesis, Rein’s study demonstrates that southern dissenters were not passive victims but rather active participants in their own liberation. Ecological factors, including agricultural collapse under levies from both armies, may have provided the initial impetus for Union enlistment. Federal pillaging inflicted further heavy destruction on plantation agriculture. The breakdown in basic subsistence that ensued pushed Alabama’s freedmen and Unionists into federal camps in garrison cities in search of relief and the opportunity for revenge. Once in uniform, Alabama’s Union soldiers served alongside northern regiments and frustrated Confederate General Nathan Bedford Forrest’s attempts to interrupt the Union supply efforts in the 1864 Atlanta campaign, which led to the collapse of Confederate arms in the western theater and the eventual Union victory. Rein describes a “hybrid warfare” of simultaneous conventional and guerilla battles, where each significantly influenced the other. He concludes that the conventional conflict both prompted and eventually ended the internecine warfare that largely marked the state’s experience of the war. A comprehensive analysis of military, social, and environmental history, Alabamians in Blue uncovers a past of biracial cooperation in the American South, and in Alabama in particular, that postwar adherents to the “Myth of the Lost Cause” have successfully suppressed until now.

Book excerpt: Despite an allegedly apolitical stance, the ARA’s agents could not separate their work from the politically-charged conditions within which they operated. The present study draws on archival evidence from five countries—Poland, Austria, the US, Germany, and Switzerland—to examine the logic (motivations) and logistics (mechanisms) that drove this significant portion of the massive relief apparatus directed by Herbert Hoover. Using the ARA as a lens through which to understand American humanitarianism in the postwar period, this dissertation argues that the ARA’s program is best understood not simply as self-interest or philanthropy, but rather as a social technology of relief, because it required the alignment of a complex array of motivations and systems (both military and civilian), the enrollment of various actors (again, both military and civilian), their motivations and skills, as well as the physical infrastructure of transportation, fuel, and food systems.

For over 100 years authorities have planned, built, and maintained our highways, managed our ports, and undertaken some of the world's most ambitious projects in planning. There can be no argument against the fact that public authorities have played a vital role in forging the identity of today's New York. Indeed, they have become so engrained as a part of the modus operandi through which state government gets things done, that while individual authorities have come under public scrutiny from time to time, until the passage of the Public Authority Accountability Act of 2005 (PAAA) and the Public Authority Reform Act of 2009 (PARA), the authority system itself had become relatively insulated from the critical lens.^In an era in which public demand for transparency in government and a stricter accounting of the public coffers is reaching a pinnacle, it is ironic that the authorities, which own 73 percent of the state's publicly backed debt, have received so little scrutiny. PAAA and PARA have sought to usher in a new era of transparency for public authorities in New York State. While the acts have implemented some important reforms, among which is the creation of an environment in which authorities are more accountable to the public, and through the implementation of measures that help to ensure that authorities are operating ethically, there are still areas of need that the laws fail to address. The laws do little to impart change on the authority system itself. There are no measures that limit the ability of authorities to amass debt, nor are there any that serve to meaningfully curb the growth and expansion of the system as a whole.^In addition, neither of the laws introduces measures for evaluating authority performance, nor do they force authorities to prove their worth to the public and justify their existence. There is no doubt that both the PAAA and PARA do a great job of ensuring that authorities are operating in an ethical manner within the system as it is currently constituted, but in terms of meaningful, structural reform, the laws come up short.
