It examines variations in the relationship between police powers and citizens’ rights inside police detention in cities in four jurisdictions (in Australia, England, Ireland and the US), exploring in particular the relative influence of discretion, the law and other rule structures on police practices, as well as seeking to explain why these variations arise and what they reveal about state-citizen relations in neoliberal democracies. This book draws on data collected in a multi-method study in five cities in Australia, England, Ireland and the US. This entailed 480 hours of observation, as well as 71 semi-structured interviews with police officers and detainees. Aside from filling in the gaps in the existing research, this book makes a significant contribution to debates about the links between police practices and neoliberalism. In particular, it examines the police, not just the prison, as a site of neoliberal governance. By combining the empirical with the theoretical, the main themes of the book are likely to be of utmost importance to contemporary discussions about police work in increasingly unequal societies. As a result, it will also have a wide appeal to scholars and students, particularly in criminology and criminal justice.

Today, these innovations remain largely intact and form the basis of current American criminal procedure law, even in the face of considerable criticism and an increasing conservative domination of the Court. But despite the survival of the Warren Court doctrine, everyone involved in the system--police, prosecutors, crime victims, academic commentators, and judges, including the Supreme Court Justices themselves—regard the current body of Supreme Court law in this area as a failure. In The Failure of the Criminal Procedure Revolution, Craig M. Bradley persuasively argues that no shift in ideology, no commitment of resources, and no refinement of Supreme Court jurisprudence would resolve the inadequacies of the current system. These problems arose from a constitutional system that has allowed the United States to develop its rules of criminal procedure on a piecemeal, case-by-case basis, rather than through a unified code of criminal procedure, as other countries have done. Only the United States expects its police to follow a set of rules so cumbersome, and so complex, that one area of criminal procedure alone—search and seizure—requires a four-volume treatise to explicate. Bradley proposes that the United States should, in keeping with the international trend, regulate police procedures through a comprehensive and nationally applicable code. He examines why the present system is a failure and how other countries have developed their criminal procedure law. He further argues that a national code would be constitutional and outlines what its features should be, how it would function, and what alternative approaches are possible and practicable. Book excerpt: The Police and Criminal Evidence Act 1984 (PACE) places a limit of 96 hours on the period someone may be detained by the police before they have to be either charged or released. Since the provisions of PACE came into force on 1 January 1986, the police have operated the detention provisions on the basis that only the time spent in police detention counts towards the application of the 96-hour limit and that the 'detention clock' is paused when an individual is released on police bail. This interpretation of the way the detention provisions of PACE operated was challenged in the case of Paul Hookway who was arrested by Greater Manchester Police in November 2010 on suspicion of murder and subsequently bailed. On 5 April 2011, a District Judge refused a routine application by Greater Manchester Police for a warrant of further detention of Mr Hookway on the grounds that the maximum detention limit had expired while the suspect was on bail. In effect, the District Judge held that time spent on police bail counted towards the 96-hour limit on detention under PACE. The decision of the District Judge was upheld by the High Court on 19 May 2011. The Government announced on 30 June that in view of the serious impact of the judgment on the police's ability to investigate crime and protect the public, it intended to bring forward fast-track legislation to reverse the effects of the judgment. This Bill is the fast-track legislation.
