Book excerpt: The general labour and employment laws of many countries do not necessarily take into account the special circumstances of those who work in the agriculture, forestry and fisheries sectors, whereas legislation governing these sectors tends not to integrate appropriate labour standards. This becomes even more of a concern where there is a general weakness in inter-sectoral and inter-institutional coordination mechanisms. This Legislative Study seeks to respond to these challenges by providing guidance on the integration of internationally accepted labour standards into national legislation in the agriculture, forestry and fisheries sectors. It identifies the standards that apply to these sectors and shows how they have been or could be integrated into regulatory frameworks governing organic production and other agricultural commodities, contract farming, pesticide management, forestry, fisheries and other related sectors. The overall aim of the study is to improve relevant regulatory frameworks with regard to the protection of the rights of people who derive their livelihoods in these sectors.

Book excerpt: The agriculture, forestry, and fishing sectors are the cornerstone of industries that produce food, fiber, and biofuel. The National Institute for Occupational Safety and Health (NIOSH) conducts research in order to improve worker safety and health in these sectors. This National Research Council book reviews the NIOSH Agriculture, Forestry, and Fishing Program to evaluate the 1) relevance of its work to improvements in occupational safety and health and 2) the impact of research in reducing workplace illnesses and injuries. The assessment reveals that the program has made meaningful contributions to improving worker safety and health in these fields. To enhance the relevance and impact of its work and fulfill its mission, the NIOSH Agriculture, Forestry, and Fishing Program should provide national leadership, coordination of research, and activities to transfer findings, technologies, and information into practice. The program will also benefit from establishing strategic goals and implementing a comprehensive surveillance system in order to better identify and track worker populations at risk.

Book excerpt: International Trade, Labor Relations, and Bargaining Power: International Strawberry Commodity Networks examines power in the commercial food system through the history of always available strawberries. Applying an interdisciplinary approach to case studies on strawberry production and sales in Mexico, Spain, and the United States, the author untangles the symbiotic relationships between the economic boom and labor strife in the sector. By comparing workers’ struggles in the sector, he develops a novel model of workplace bargaining power in which the process of dignity catalyzes change. Since international trade in strawberries began three decades ago, the sector’s growth has paralleled the rise of retailer dominance of food sales. Highlighting inequitable gains from the sales boom, workers have organized mass strikes, boycotts, and pressure campaigns. The divergent results ranged from ephemeral acknowledgments of workers’ concerns to the establishment of union collective bargaining and steadily improving working conditions. Grounded in extensive research, the book provides fresh analytical approaches to understanding the social dimensions of international trade and workplace bargaining power. The book unpacks the relationship between poor working conditions and economic growth by applying a new method, international commodity network analysis, which builds on prior global supply chain approaches. It explains differences in workers’ initiatives to improve employment conditions by identifying the process of dignity in the creation of solidarity.

Available in PDF, EPUB and Kindle. Book excerpt: Natural gas, a vital primary source of energy for the twenty-first century economy, is poised to play a major role in the medium- to long-term outlook of energy systems worldwide. Its supply to power markets for electricity generation and other energy purposes through the stages of exploration, production, gathering, processing, transmission, and distribution have been a key driver in gas commercialisation over the past two to three decades. This book discusses insights from law and economics pertaining to gas and energy supply contracts, regulation, and institutions. It provides an in-depth ‘law-in-context’ analysis of the approaches to developing competitive and secure gas-to-power markets in an increasingly international, interrelated, and interconnected value chain. Recognising a general move towards structural reforms and economic regulation of gas and energy markets globally, the author incisively addresses the following questions: – Is there a single ‘ideal’ model or approach for ensuring effectiveness in the restructuring and regulation of gas supply to power markets? If not, then what constitutes the matrix of models and approaches? – What are the underlying principles, assumptions, and institutional structures that will enhance the modern approaches to developing competitive, secure, and sustainable gas supply to power markets? – What are the factors that determine or affect the effectiveness and efficiency of such approaches and regulatory frameworks? The book critically explores the instrumental role of regulation and organisational institutions in the restructuring and development of gas supply markets. It examines the evolution of economic approaches to regulation, competitiveness, and security of gas supply in the United States and the United Kingdom. It considers the EU as a supranational union of developed economies and Nigeria as a developing economy, in the process of applying these paradigms of economic regulation and restructuring of gas-to-power markets. In a law and policy environment where training and educational centres, lawyers, and public and corporate energy advisors are becoming more concerned about competitiveness and efficiency in gas resource allocation and pricing – and about high-quality governance frameworks for industries that depend on reliable gas supplies – this vital book will be warmly welcomed by lawyers, policymakers, energy consultants, analysts, regulators, corporate investors, academics, and institutions concerned with and engaged in the business of exploration, production, and supply of gas for energy purposes.

Book excerpt: This edited collection examines the labour laws of seven industrializing East Asian societies - China, Indonesia, Malaysia, South Korea, Taiwan, the Philippines and Vietnam - and discusses the variation in their impact across the whole region. Leading scholars from each country consider both laws pertaining to working conditions and industrial relations, and those that regulate the labour market as a whole. Legislation concerning migrant labour, gender equality, employment creation and skills formation is also examined. Adopting their own distinct theoretical perspectives, the authors trace the historical development of labour regulation and reveal that most countries in the region now have quite extensive frameworks. This book will be particularly useful to people interested in the place of labour law, and law in general, in contemporary East Asian societies.

This book was released on 2018-11-09 with total page 116 pages. Available in PDF, EPUB and Kindle. Book excerpt: The SSF Guidelines are based on internationally accepted human rights standards and are to be interpreted and implemented in accordance with those standards. Their objectives are to be met through the promotion of a human rights-based approach (HRBA). This approach seeks to ensure the participation of small-scale fishing communities in non-discriminatory, transparent and accountable decision-making processes by putting particular emphasis on the needs of vulnerable and marginalized groups and developing countries. While the HRBA has been recognized by FAO as a principle that informs the design, implementation, monitoring and evaluation of programmes and projects,1 there is still limited experience in its practical application in the context of small-scale fisheries (SSF). It is therefore important to explore how the approach could support the implementation and monitoring of the SSF Guidelines. Accordingly, the workshop on “Exploring the human rights-based approach in the context of the implementation and monitoring of the SSF Guidelines” explored what the human rights-based approach means within the context of small-scale fisheries in general and the thematic areas covered by the SSF Guidelines in particular. It discussed what the HRBA entails in terms of the conduct of the various state and non-state actors to whom the SSF Guidelines are addressed as well as the needs of the different stakeholders in the various policy areas, with a view to developing guidance materials for the application of the HRBA in the implementation and monitoring of the SSF Guidelines.

Book excerpt: Even though Corporate Social Responsibility (CSR) has become a widely accepted concept promoted by different stakeholders, business corporations' internal strategies, known as corporate self-regulation in most of the weak economies, respond poorly to this responsibility. Major laws relating to corporate regulation and responsibilities of these economies do not possess adequate ongoing influence to insist on corporate self-regulation to create a socially responsible corporate culture. This book describes how the laws relating to CSR could contribute to the inclusion of CSR principles at the core of the corporate self-regulation of these economies in general, without being intrusive in normal business practice. It formulates a meta-regulation approach to law, particularly by converging patterns of private ordering and state control in contemporary corporate law from the perspective of a weak economy. It proposes that this approach is suitable for alleviating regulators' limited access to information and expertise, inherent limitations of prescriptive rules, ensuring corporate commitment, and enhance the self-regulatory capacity of companies. This book describes various meta-regulation strategies for laws to link social values to economic incentives and disincentives, and to indirectly influence companies to incorporate CSR principles at the core of their self-regulation strategies. It investigates this phenomenon using Bangladesh as a case study.
