Book excerpt: L'analyse économique de la responsabilité civile s'est développée autour de l'idée que cet outil juridique peut ex ante fournir des incitations à prévenir les risques d'accident. En présence de risques technologiques de grande ampleur, cette littérature a notamment mis en avant les inefficiences du régime de responsabilité limitée. Voulant protéger les investisseurs pour faciliter l'afflux de capitaux nécessaires à l'émergence des activités modernes de production, ce régime peut fournir des incitations sous optimales à prévenir un risque dont le dommage n'est pas intégralement internalisé. Dans le chapitre 1, nous dressons un état des lieux de cette littérature et mettons en évidence le fait qu'un rapprochement avec des analyses menées en économie de l'environnement est nécessaire. Un tel rapprochement, ouvrant l'analyse à la possibilité de changement technologique induit, a été amorcé dans un cadre de régulation d'émissions polluantes. Notre thèse montrera alors qu'un tel rapprochement est souhaitable et porteur de nouveaux résultats pour l'analyse économique de la prévention des risques technologiques de grande ampleur. Le chapitre 2 montre que la possibilité de changement technologique permet de relativiser la portée des inefficiences de la responsabilité limitée. Nous mettons en avant le fait qu'un tel régime de responsabilité peut amener les firmes à procéder à du changement technologique permettant de réduire la probabilité d'accident et mieux internaliser le risque. En outre, l'instauration d'une taxe assise sur le niveau de production renforce l'efficience de ce régime. Les chapitres 3 et 4 étendent l'analyse à la présence de risques imparfaitement connus, qui peut survenir en présence de nouvelles technologies. Nous comparons responsabilité limitée et illimitée, et montrons que cette dernière fournit davantage d'incitations à la recherche d'informations sur le risque tout en ayant le plus faible impact sur le choix technologique. Enfin, le chapitre 5 aborde la thématique de l'innovation, lorsque le progrès technique peut modifier à la fois le coût de prévention et la probabilité d'accident. Nous montrons que le type d'innovation et le rôle du Régulateur sont essentiels : la règle de responsabilité sans faute est toujours préférable à la règle de négligence en présence d'un Régulateur conformiste, mais cette dernière peut être préférable en présence d'un Régulateur proactif si le progrès technique modifie essentiellement le coût de prévention.

Book excerpt: The 2018 FAO-OIE-WHO (Tripartite) zoonoses guide, “Taking A Multisectoral, One Health Approach: A Tripartite Guide to Addressing Zoonotic Diseases in Countries” (2018 TZG) is being jointly developed to provide member countries with practical guidance on OH approaches to build national mechanisms for multisectoral coordination, communication, and collaboration to address zoonotic disease threats at the animal-human-environment interface. The 2018 TZG updates and expands on the guidance in the one previous jointly-developed, zoonoses-specific guidance document: the 2008 Tripartite “Zoonotic Diseases: A Guide to Establishing Collaboration between Animal and Human Health Sectors at the Country Level”, developed in WHO South-East Asia Region and Western Pacific Region. The 2018 TZG supports building by countries of the resilience and capacity to address emerging and endemic zoonotic diseases such as avian influenza, rabies, Ebola, and Rift Valley fever, as well as food-borne diseases and antimicrobial resistance, and to minimize their impacts on health, livelihoods, and economies. It additionally supports country efforts to implement WHO International Health Regulations (2005) and OIE international standards, to address gaps identified through external and internal health system evaluations, and to achieve targets of the Sustainable Development Goals. The 2018 TZG provides relevant country ministries and agencies with lessons learned and good practices identified from country-level experiences in taking OH approaches for preparedness, prevention, detection and response to zoonotic disease threats, and provides guidance on multisectoral communication, coordination, and collaboration. It informs on regional and country-level OH activities and relevant unisectoral and multisectoral tools available for countries to use.
