Book excerpt: Es objeto de la presente obra el régimen de las denominadas viviendas protegidas, esto es, aquéllas para cuya construcción o adquisición han sido beneficiarias de medidas que se suelen concretar, especialmente, con la concesión de determinados beneficios de diverso tipo que a lo que tienden es que, al final del proceso, el precio de la vivienda sea asequible. Los adquirientes, por lo demás, asumen como contrapartida una serie de limitaciones que tienen que ver, principalmente, con prohibiciones en cuanto a la venta de la vivienda durante determinado tiempo y limitaciones respecto del precio que pueden exigir, entre otras que constituyen el núcleo duro de su régimen jurídico. Régimen este que se ha ido concretando a lo largo del tiempo en una serie de normas que remitían a las conocidas como VPO o «viviendas de protección oficial», como modalidad de viviendas protegidas que se impuso poco antes de la aprobación de la Constitución. El mandato constitucional del artículo 47 de nuestra Norma Fundamental, la asunción de competencias de las Comunidades Autónomas y el papel del Estado en este ámbito, junto con una normativa preconstitucional de aplicación supletoria, convierte este sector de la intervención administrativa en uno de los de mayor complejidad. Al objeto de acercar el entramado normativo de aplicación se tratan los más relevantes aspectos de esta institución, como el vigente Plan Estatal de Vivienda y Rehabilitación 2009-2012, el régimen de infracciones y sanciones y la vertiente urbanística de la vivienda protegida, atendiendo muy especialmente a los pronunciamientos de la Jurisprudencia sobre los distintos conflictos que se han plantado.

En la primera se incluyen exposiciones relativas a la evolución de las experiencias europeas que nos resultan más cercanas (Francia, Inglaterra, Italia y Portugal), así como de la correspondiente a España. En la segunda parte se recogen trabajos sobre los diversos aspectos que inciden en el régimen general del derecho a la vivienda, de manera que se analizan la calidad de la edificación, la protección jurídica del comprador de vivienda, la utilidad de las fórmulas arrendaticias y la incidencia de la fiscalidad en la disponibilidad de vivienda. La tercera parte se dedica a las viviendas protegidas, incluyendo colaboraciones sobre su régimen jurídico general, la planificación, las reservas de suelo y el régimen de acceso, uso y transmisión.
