Book excerpt: From Exception to Promotion: Re-Thinking the Relationship between International Trade and Environmental Law tells a new, unconventional story of the nexus between international trade and environmental law - a story in which the keyword is synergy rather than conflict, and where the trade regime was always meant for something greater than simply trade liberalization. This ‘something greater’ was peace in the first half of the 20th century. Today, it is sustainable development, environmental protection, and social inclusion. Environmental protection is therefore neither antithetical to the overarching purpose of the trading system nor simply a ‘non-trade’ issue to be incorporated within the trade regime, but rather part of its very nature and purpose. By telling this ‘untold’ story of the nexus, this book intends to raise historical awareness and open a constructive discussion on the future of the trade regime and of international economic law governance at large.

Available in PDF, EPUB and Kindle. Book excerpt: Published in 1997, this book is about the link between trade and the environment which has become a very important national issue for all countries, in particular, those countries which have been undergoing lengthy periods of trade and investment liberalization programmes recently. This has also become an international issue of tremendous current interest given its implications on the global environment and trading system. International organizations such as WTO, OECD, the UN and regional trading arrangements such as NAFTA, EEC and APEC have been actively involved in the policy debate. Despite the critical importance of trade-environment issues, less is known about the linkages between the two. This book presents a New Zealand perspective as a case-study of global interest for two reasons: firstly, many countries, both developed and developing, are taking the New Zealand economic reforms as a model for restructuring their economies. Secondly, New Zealand is going to become a member of APEC (Asia Pacific Economic Co-operation), together with 17 other countries in the area by 2010 (developed countries) and 2020 (developing countries). The book is expected to contribute significantly to the current debate and to assist in the process of reconciliation of trade and environmental policies for sustainable development within the context of APEC integration.

Book excerpt: In recent years the relationships between trade and the environment, and trade and development, have become increasingly complex. The need to reconcile the competing demands of economic growth, economic development, and environmental protection has become central to the multilateral trade agenda. In this volume various commentators debate the role of the World Trade Organization and other institutions in addressing these challenges. The book arises from the papers presented at two High Level Symposia hosted by the World Trade Organization in March 1999, on Trade and the Environment and Trade and Development. The first section of the work focuses on the relationship between trade and the environment. The issues addressed include the need for WTO members to pursue integrated trade and environmental policies in order to achieve sustainable development, ways in which the removal of trade restrictions and distortions can lead to positive environmental and development solutions, the relationship between WTO provisions and trade measures contained in environmental agreements, and the need for transparency and effective interaction between civil society and the trade community. The second section examines the growing importance of developing countries in the global trading system over the last 30 years, and the ways in which the inequalities which persist between countries may be addressed. The papers include discussion of the need for integration of the least-developed countries into the multilateral trading system, the ways in which international institutions may work together to realize the objective of development, the complex role of trade liberalization in development, and the importance of new technologies in accelerating integration between developing and developed countries.
