In some companies business decline can be turned around or at least delayed. In many others there is no option other than business closure. Over the past twenty years the rate of business failure has accelerated. Insolvency rates are high not just for small businesses but also for large well known public companies. Identifying possible causes of business distress is now recognised as an important agenda item. Creating the capacity to bounce back from such distress – business resilience – has become a priority. The authors blend their own practical experience, academic research and a systematic analysis of recent high profile cases including Flybe Group Plc, Arcadia Group Ltd, Carillion Plc, NMC Health Plc and Thomas Cook Group Plc in a review of potential causes of business distress and key resilience drivers. This is presented in detail in separate chapters covering business purpose, board effectiveness, the quality of strategic planning, financial stewardship, risk management, business turnaround strategies and director duties in times of business distress. The book sets out a practical benchmarking framework in the form of a toolkit with a series of detailed evidences – performance indicators – that companies can use to assess potential business distress and build a resilient company.

Book excerpt: Is bullying really that bad? Why do some people just watch it happening? How do you know if it is bullying or strong management? What kind of leaders are able to create positive working environments? The effects of bullying on organisations and individuals can be devastating and can adversely affect both the workers themselves and the productivity of the organisation that they work for. This book explores the impact of bullying from the perspective of both the employee and the organisation in which they work. In addition to describing the negative outcome of bullying, Workplace Bullying also looks at ways to promote resilience and the opportunity for growth and learning to take place. Divided into four sections, this book covers: the impact and symptoms of workplace bullying individual interventions organisational interventions underlying causes and future considerations. Workplace Bullying is essential reading for anyone with responsibility to help and support workers involved in bullying as a victim, supporter, or investigator. It offers organisations a chance to create an environment that will not only build a more resilient workforce, providing appropriate and effective interventions, but also provides solutions that will lead to the possibility of individual and organisational growth and development.

Available in PDF, EPUB and Kindle. Book excerpt: The subject of bank stability has been under a great amount of political and legislative scrutiny since the mid-2007 to late-2009 global financial crisis. However, these efforts have centred on developed economies. Little coverage is given to strategies adopted by many developing economies. While there is a global discourse on the subject of insolvency generally, there is ample scope to contribute to the growing body of work on the narrow subject of bank insolvencies. This book provides a unique perspective on an emerging theme in at least two respects. First is the focus on selected developing economies and selected developed economies in the EMEA region alongside cross-border developments, with the objective of deciphering the regulatory approach to bank insolvencies. The second is the analytical consideration of methods that may be implemented to preclude or resolve bank insolvencies in developing economies. This book explores the nexus between developing economies and their banking institutions. Developing economies are acutely dependent on their banks for the functioning of their cash-based economies. Recent events, however, suggest a weakness in the long-term viability of some of their banks and a mixed-bag regulatory approach to redress this weakness. This book evaluates the effectiveness of regulatory frameworks in selected developing economies that are designed to prevent or resolve the insolvency of banks. At a time of global economic uncertainty, this book will prove to be a valuable resource to the discourse on the viability of banks, businesses, and economies in developing States.

Available in PDF, EPUB and Kindle. Book excerpt: A wholly new force is driving human behavior today, and it's turning the world as we know it upside down and inside out. Human behavior is now being driven by a new survival instinct -- a new primal desire -- that is invisibly but unstoppably reshaping the world, from the most intimate details of our private lives to the dynamics of the global marketplace. The New Culture of Desire reveals and chronicles this present and future brave new world -- the beginning of Human History Part II. According to futurist Melinda Davis, it is evolving right under our noses, and we need to adapt now to survive -- and to thrive. Described variously as "a secret weapon of the Fortune 100" and a "hired-gun visionary," Davis divulges the startling conclusions and once confidential details of The Human Desire Project, a six-year, multidisciplinary study to investigate what makes human beings want what they want and do what they do. Originally initiated as a landmark study for big business (Davis's client ranks include distinguished companies such as AT&T, Merck, Diageo, Procter & Gamble, L'Oréal, Unilever, and Lucent Technologies), The Human Desire Project evolved into an even larger phenomenon with far-reaching implications for all of our lives. In The New Culture of Desire, you learn to leverage for your own good fortune, today -- and into tomorrow -- the same insights and strategies that inform the future plans of some of the most powerful corporate movers and shakers around. Here are just some of the revelations of The New Culture of Desire: • The unconscious formula that we all use to make choices now • Why bliss beats sex, money, and power • The new peak experience: the State of O • The single greatest unmet consumer need • The battle for our interior lives • The five strategies we enlist to satisfy the new primal desire -- and what they mean for your life and your business Harvard-educated and street-smart, Davis examines the telltale signs of our rapidly morphing world with the nose of an MIT/MTV anthropologist and an arsenal of case histories. Quizzes and checklists appear throughout the book to help you diagnose your own desires. New marketing models provide new ways to speak more powerfully to the heart of your customers' true desires. This insider's analysis of the most powerful desire-driven trends of our time provides a strategic guide to the inside of the new millennial mind, to help you understand your own motivations and those of your colleagues, customers, and friends. Here are some of those cultural trends that you need to know about: • Magical Thinking: Looking for the simple, supernatural solution • The Third Sex: Having it all • Yoda-ism: New candidates for a god • Tribe Crashing: The ultimate insiderism • Hot-Blooded Spiritualism: Drumming up the saving graces • Raging Amazonianism: The rise of the butt-kicking babe • Pleasure Healing: Self-indulgence that does you good • P. Q.: The Performance Quotient: Upgrading the human processor A pioneering work that looks into what people want and why, The New Culture of Desire blows traditional future-planning theory and practice sky-high, and replaces it with groundbreaking strategies that really work.

Available in PDF, EPUB and Kindle. Book excerpt: In order to survive, a company in financial distress must approach its business and capital structure differently than a financially sound company. A company in financial distress may, for example, need to preserve cash by stretching accounts payable, to raise cash by selling assets, or to arrange for emergency liquidity from institutional lenders. The response of a company to its deteriorating financial condition will almost certainly affect, perhaps in material ways, a company's key constituents. Financially Distressed Companies Answer Book 2014 provides a broad overview of topics relating to financially distressed companies. It is intended to be an easy reference with respect to issues for the management of a company finding itself in financial distress, a vendor or other creditor trying to manage its exposure or understand a bankruptcy process, or a nonbankruptcy lawyer needing a description of the legal concepts relevant to distressed companies. The book provides answers detailed enough to provide a working understanding of concepts, and relevant statutory and case law cites to facilitate any necessary further reading. Examples and practice tips help illustrate concepts and provide practical guidance. Topics discussed in Financially Distressed Companies Answer Book 2014 include: The roles and fiduciary duties of directors and management in distress situations; Rights and limitations of creditors in dealing with companies in distress and in bankruptcy; Concepts and considerations relating to out-of-court restructurings; Cross-border reorganizations and issues in international restructurings; Key concepts in U.S. bankruptcy cases; and Special rules in bankruptcy for small businesses and single asset real estate companies. Financially Distressed Companies Answer Book 2014 also provides you with: Illustrative timelines to help guide strategic planning; References to sources of additional information, such as bankruptcy court websites; and Practice and cautionary tips to provide guidance on issues such as how to recognize financial distress, when the securities laws might require disclosure and what actions a creditor may take to protect its rights or limit its exposure.

Book excerpt: Despite acknowledging that a 'handful' of providers give him concern, the Regulator is reluctant to give them lower financial viability ratings, fearing that doing so might trigger an upward re-pricing of their debt. Instead, the Regulator uses governance ratings to signal concerns about financial viability. This practice lacks openness and should stop and accurate financial viability ratings should be published. The fear of triggering a re-pricing also prevents the Regulator from using many of his statutory powers, preferring to adopt informal approaches instead. This lacks transparency and risks too close a relationship developing between the Regulator and providers. The devolved administrations' housing regulators, not to mention regulators in other sectors, must encounter similar dilemmas. The Regulator should work with them to see how they have addressed his concern that the use of statutory powers could prove counter-productive. The Committee's concerns are underlined by the case of Cosmopolitan Housing Group, which came close to insolvency in 2012. The Regulator only lowered its financial viability rating for Cosmopolitan in December 2012, despite the fact that he had been monitoring the situation for months and the possibility of insolvency had been raised in the media two months previously. The report also raises concerns about how effectively the Regulator is discharging his remit for consumer regulation. Noting that of 111 complaints related to consumer standards referred to the Regulator no case of serious consumer detriment was found, the Report calls for an annual external check to be carried out to provide assurance that the Regulator is discharging his duties effectively
