Total-disability beneficiaries with an eligible dependent are compensated at 75 percent of gross wages at the time of injury and those without are compensated at 66-2/3 percent. Benefits are adjusted for inflation and are not taxed nor subject to age restrictions. Some policymakers have raised questions about the level of FECA benefits, especially compared to federal retirement benefits. Proposals to revise FECA for future total- and partial- disability beneficiaries include: setting initial FECA benefits at a single rate (66-2/3 or 70 percent of applicable wages at time of injury), regardless of whether the beneficiary has eligible dependents; and converting FECA benefits to 50 percent of applicable wages at time of injury-adjusted for inflation-once beneficiaries reach full Social Security retirement age.This testimony presents results of GAO's four recent reports on FECA issues. It summarizes (1) potential effects of the proposals to compensate total-disability FECA beneficiaries at a single rate; (2) potential effects of the proposal to reduce FECA benefits to 50 percent of applicable wages at full Social Security retirement age for total-disability beneficiaries; and (3) how partial disability beneficiaries might fare under the proposed changes. GAO was asked to examine whether examples of improper payments, potential fraud, or overlapping benefits could be found in the FECA program. This report identifies examples of these issues, what factors may contribute to these issues, and how, if at all, Labor could address them. GAO matched QW and unemployment files from five selected states with FECA payment files for the period of July 2009 to June 2010. GAO identified 530 individuals who received concurrent FECA compensation payments and wages of at least $5,000 between July 2009 and June 2010. GAO also identified 50 individuals who received concurrent FECA compensation and UI benefits of at least $5,000 each during the same period. GAO randomly selected up to seven recipients from each state for an in-depth review, for a total of 32 QW and 19 UI cases, respectively. These examples cannot be generalized beyond those presented. GAO also reviewed Labor's policies, guidelines, and procedures for managing claims. "

Book excerpt: Pursuant to a congressional request, GAO reviewed the Department of Labor's (DOL) Federal Employees' Compensation Act (FECA) Program to: (1) determine the real growth in FECA costs after adjusting for inflation; (2) describe federal agencies' efforts to control program costs; and (3) identify the trend in federal workplace safety. GAO found that: (1) from 1979 to 1987, annual FECA costs increased from about $603 million to $1,070 million, but increased from $603 million to $682 million when adjusted for inflation; and (2) DOL believed that its reduction of backlog cases caused the real increase in FECA costs. GAO also found that federal agencies used many methods to contain program costs, including: (1) revising regulations to allow for suspending or terminating continuation of pay under certain circumstances; (2) rehabilitating FECA beneficiaries so they could return to gainful employment; (3) making computer matches with retirement system records to identify ineligible FECA beneficiaries; (4) rehiring employees who were receiving compensation payments; (5) distributing FECA costs back to the lowest management level possible for greater accountability; (6) monitoring continuation of pay; and (7) making the workplace safer. In addition, GAO found that, from 1979 to 1987, the incidence of work-related injuries and disabilities in the federal workplace declined about 32 percent.

DOD civilians who are injured or ill as a result of a work-related incident are covered under the DOL-administered FECA program. DOL, along with employing agencies like DOD, works to return injured employees to work and provides compensation for work-related disabilities. In 2015, about 90 percent of DOD's injured workers returned to work within 2 years of injury. Senate Report 114-49 included a provision that GAO review DOD's use of the FECA program. This report analyzes (1) characteristics of DOD's 2015 FECA claimants and how they compared to non-DOD claimants and (2) the extent to which DOD experiences any challenges managing its FECA responsibilities and facilitating return-to-work outcomes. GAO analyzed 2015 DOL data to identify characteristics, such as the age and benefit type, of FECA claimants, including those who received benefits that year (beneficiaries). GAO also analyzed relevant law, policies, and guidance on DOL and DOD's management of FECA, and interviewed DOL and DOD officials-including a nongeneralizable sample of DOD program officials.
