Successive problems have plagued various lending markets, bank failure rates have increased, and traditional regulatory techniques of risk control have proved unsuccessful. In this work, Helen A. Garten examines the current crisis in bank regulation and the regulatory response. In addition, she provides a series of recommendations for reforming the system so that regulatory failure will not occur again. Garten begins her study with a strategic view of bank regulation as a response to financial crises in the banking business. Just as the bank failures of the 1930s led to a radical shift in bank regulatory technique, recent competitive pressures and technological innovations that have lessened the profitability of the deposit-lending business are leading to a shift in regulatory strategy today. Although some deregulation has taken place, Garten contends that more significant changes are occurring in the regulation that remains. Regulators are experimenting with a new approach to risk control that will create economic incentives for banks to adopt more successful investment strategies. Garten compares these new regulatory initiatives to the disciplinary techniques of the typical corporate equityholder and shows how they differ from the debtholder's techniques of traditional post-Depression bank regulation. She concludes that the new regulatory strategy may not be enough to help the banking industry emerge from its current difficulties. This work will be an essential resource for lawyers and bankers involved with regulatory policy, as well as for economists and scholars of finance and administrative law.

Resolving the failures of banks and thrifts due to these crises resulted in estimated costs to federal bank and thrift insurance funds over $165 billion, as well as other federal government costs, such as taxpayer-funded assistance during the financial crises. Ongoing monitoring of banking regulators' efforts to identify and respond to emerging threats to the banking system can provide a starting point for identifying opportunities for more targeted and frequent assessments of these efforts. This book discusses regulatory lessons learned from these past crises and offers a framework that the Government Accountability Office and other oversight bodies, such as inspectors general, can use to provide continuous future oversight of regulatory responses to emerging risks. It analyses failed state member bank reports that the Office of the Inspector General issued between 29 June 2009, and 30 June 30 2011, to determine the common characteristics, circumstances, and emerging themes related to the cause of the bank failures and Federal Reserve supervision of the failed institutions.

The details of forging an agreement were left to the staffs of the primary bank regulators in each country, and compromises were inevitable. Although domestic constituencies' reactions to the proposals were invited, the arduous negotiations that led to the proposals generated intense pressure on the principals not to make changes. The European Community's approach to financial integration seems to be driven by a political desire to achieve an integrated market within Europe, despite significant institution al differences among countries. Underlying that desire is a belief that the market pressures that result from different regulatory systems operating in the same market will produce the right answer . The financial provisions of the U .S.-Canada free-trade agreement take a direction that, in my judgment, is more productive. The provisions are more limited in scope than are those of the European initiative. National treatment and national sovereignty are preserved. However, the delicate issue of national responsibility for failing institutions, and its relationship to monetary policies, is not addressed. A Better Alternative A productive basis for international regulation can be formulated around three principles: 1. free entry for foreign-owned subsidiaries chartered under the laws of the host country; 2. national treatment for those subsidiaries; and 3. national responsibility for (a) monetary policy, (b) prevention of unwarranted financial panics in domestically chartered institutions, whether foreign or domestically owned, and (c) supervision of all domestically chartered institutions, regardless of ownership.
