Download or read book Freedom's Law written by Ronald Dworkin and published by OUP Oxford. This book was released on 1999 with total page 438 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dworkin's important book is a collection of essays which discuss almost all of the great constitutional issues of the last two decades, including abortion, euthanasia, capital punishment, homosexuality, pornography, and free speech. Dworkin offers a consistently liberal view of the Constitution and argues that fidelity to it and to law demands that judges make moral judgments. He proposes that we all interpret the abstract language of the Constitution by reference to moral principles about political decency and justice. His 'moral reading' therefore brings political morality into the heart of constitutional law. The various chapters of this book were first published separately; now drawn together they provide the reader with a rich, full-length treatment of Dworkin's general theory of law.
Book Synopsis On Reading the Constitution by : Laurence H. TRIBE
Download or read book On Reading the Constitution written by Laurence H. TRIBE and published by Harvard University Press. This book was released on 2009-06-30 with total page 157 pages. Available in PDF, EPUB and Kindle. Book excerpt: Our Constitution speaks in general terms of liberty and property, of the privileges and immunities of citizens, and of the equal protection of the laws--open-ended phrases that seem to invite readers to reflect in them their own visions and agendas. Yet, recognizing that the Constitution cannot be merely what its interpreters wish it to be, this volume's authors draw on literary and mathematical analogies to explore how the fundamental charter of American government should be construed today.
Download or read book American Epic written by Garrett Epps and published by Oxford University Press. This book was released on 2013-09-19 with total page 301 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The United States is the only nation in the world in which political leaders, judges and soldiers all swear allegiance not to a king or a people but to a document, the Constitution. The Constitution today, however, is much revered but little read. . Readers of AMERICAN EPIC will never think of the Constitution in quite the same way again. Garrett Epps, a legal scholar who is also a journalist and writer of prize-winning fiction, takes readers on a literary tour of the Constitution, finding in it much that is interesting, puzzling, praiseworthy, and sometimes hilarious. Reading the Constitution like a literary work yields a host of meanings that shed new light on what it means to be an American"--

It was a lightly edited version of the Tanner Lectures given by Laurence Tribe at the University of Utah in November 1986, and forms the basis for what became Chapters 1 and 2 of this book. Chapters 3 through 5 are based on 'Levels of generality in the definition of rights, ' a recent collaboration by the two of us, which first appeared in the fall 1990 edition of the Chicago law review"--Acknowledgments, page [vii]
Book Synopsis Readings in American Constitutional History, 1776-1876 (Classic Reprint) by : Allen Johnson

This book was released on 2015-06-30 with total page 614 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Readings in American Constitutional History, 1776-1876 In preparing this collection of historical material for publication, I have had in mind chiefly the needs of the average undergraduate. Believing that the so-called "case system" has a distinct disciplinary value and may be applied profitably. within certain limits, to the study of constitutional history, I have tested for some years in my classes a variety of documents drawn from many sources. The matter contained within the covers of this volume may be viewed as the survival of the fittest. So far as possible, a unity and coherence have been given to the selections by careful grouping and by brief introductory comments. The phrase "constitutional history" has been used rather broadly to mean not only the development of Federal and State Constitutions, but also the history of governmental processes. "Readings in the history of American polity" would have been a not inappropriate title for the book. Formal documentary matter - such as legislative bills, acts, and general statutes - has been omitted. Selected statutes are now accessible in several collections, notably in the excellent series edited by Professor William MacDonald. In conclusion, I will say that wherever a choice has been possible, I have selected material with an eye to literary form as well as to historical content. Book Synopsis Readings on the Development of the American Constitution by : O. Lawrence Burnette
Download or read book Readings on the Development of the American Constitution written by O. Lawrence Burnette and published by . This book was released on 2011-01 with total page 802 pages. Available in PDF, EPUB and Kindle. Book excerpt: This compilation is an effort historically to trace the systematic and ordered changes in Constitutional thinking, by judicious selection of the key operative phrases and concepts imbeded in hundreds of cases of varying importance, more clearly to illustrate the evolutionary process by which the Constitution has come to have its current form and meaning. The effort has been to extract from the hundreds of case decisions and dissents, those immutable words and phrases which capture the essence of the points at issue, in the Justice's own words just as they wrote them in the white heat of judicial argument. Moreover, the effort has been to trace the chain of precedents for cases and concepts, more clearly to show how the jigs and jogs fo decisions have altered the Constitution as applied. Whether or not agreed to (being the subject of strong controversy between the members of the Court itself), that process is one of organic, evolutionary growth, reflecting the chaging times, concepts, legal theory, and political ideas in the American experience. In a larger perspective, the Constitution has been the greatest American export to a world grappling with the desire to emulate the American experience of liberty under law. The volume will be of interest to students of the subject, as well as the legal profession; it is the product of a lifetime spent in the study and teaching of the Great Document.
Download or read book American Government written by Peter Woll and published by Longman Publishing Group. This book was released on 2002 with total page 516 pages. Available in PDF, EPUB and Kindle. Book excerpt: Putting students directly in touch with the great authors and political leaders who have shaped and are shaping American government, the new edition of this best-selling reader is one of the most substantial revisions yet. The Fourteenth Edition features new essays that reflect the recent developments and debates over campaign finance reform; the new Supreme Court imposed limits on congressional power over the states; and political trends that are reshaping government and politics at the national and state levels. The book is structured in such a way that it can be used as an ancillary or a core textbook: included are extensive notes that prepare, connect, and comment on the selections and point out their significance so that, more than other readers, it presents a coherent narrative. As it has since its first edition, this reader provides a strong, balanced blend of classic readings and cases that illustrate and amplify important concepts in American government, along with extremely current readings and cases drawn from today's issues and literature.
