In an alliance among states for the promotion of collective defense or security, such as the North Atlantic Treaty Organization (NATO), burdens have to be shared. This study looks at the experience of the United States and other member states of NATO in four situations of multinational military intervention - Lebanon, the Persian Gulf, the Balkans, and South Asia - and considers the implications of nuclear arms reductions and nonproliferation for the US and NATO. Each case study represents an important period in the distribution of power, interest, and values, amounting to more than a sequential consideration of incidents of military intervention and/or conflict prevention. These politico-military challenges include a major coalition war, a traditional peacekeeping operation, an exercise in peace enforcement, and a conflict that combines counter-insurgency and counter-terrorism with stability and security operations.

Book excerpt: This book applies a justice framework to analysis of the actual and potential role of international law with respect to people on the move in the context of anthropogenic climate change. That people are affected by the impacts of climate change is no longer doubted, including with implications for people movement (migration, displacement, relocation, etc.). Climate Change and People on the Move tackles unique questions concerning international responsibility for people movement arising from the inequities inherent to climate change. Corrective and distributive justice provide the analytical backbone, and are explored in a substantial theoretical chapter and then applied to subsequent contextual analysis. Corrective justice supports analysis as to whether people movement in the climate change context could be conceived or framed as harm, loss, or damage which is compensable under international law, either through fault-centred regimes or no-fault regimes (i.e. insurance). Distributive justice supports analysis as to whether such movement could be conceived or framed as a disproportionate burden, either for those faced with movement or those faced with sheltering people on the move, from which duties of re-distribution may stem. This book contributes to the growing scholarship and analysis concerning international law or governance and people movement in response to the impacts of climate change by investigating the bounds of the law where the phenomenon is viewed as one of (in)justice.

There are only a few instruments that provide guidance to states on how to respond to mass influx situations and how to implement temporary protection regimes. In Temporary Protection in Law and Practice, Meltem Ineli-Ciger takes a step towards clarifying those undefined aspects of temporary protection, by examining temporary protection’s legal foundation in international law and its relationship with the Refugee Convention. The book also reviews temporary protection policies in Europe, Southeast Asia, Turkey and the United States, with a view to identifying elements that enhance and compromise the legality and viability of temporary protection regimes. Building on this analysis and legal limitations to the freedom of states to conceptualize different aspects of temporary protection, this book provides guidance to states on how to introduce and implement a viable temporary protection regime, which operates within the boundaries of international law and international human rights law.

Book excerpt: The Burden-Sharing Dilemma examines the conditions under which the United States is willing and able to pressure its allies to assume more responsibility for their own defense. The United States has a mixed track record of encouraging allied burden-sharing—while it has succeeded or failed in some cases, it has declined to do so at all in others. This variation, Brian D. Blankenship argues, is because the United States tailors its burden-sharing pressure in accordance with two competing priorities: conserving its own resources and preserving influence in its alliances. Although burden-sharing enables great power patrons like the United States to lower alliance costs, it also empowers allies to resist patron influence. Blankenship identifies three factors that determine the severity of this burden-sharing dilemma and how it is managed: the latent military power of allies, the shared external threat environment, and the level of a patron's resource constraints. Through case studies of US alliances formed during the Cold War, he shows that a patron can mitigate the dilemma by combining assurances of protection with threats of abandonment and by exercising discretion in its burden-sharing pressure. Blankenship's findings dismantle assumptions that burden-sharing is always desirable but difficult to obtain. Patrons, as the book reveals, can in fact be reluctant to seek burden-sharing, and attempts to pass defense costs to allies can often be successful. At a time when skepticism of alliance benefits remains high and global power shifts threaten longstanding pacts, The Burden-Sharing Dilemma recalls and reconceives the value of burden-sharing and alliances.
