Book excerpt: Según los términos del Artículo 1 Común a los cuatro Convenios de Ginebra de 1949, los Estados partes quedan sujetos a una obligación de respetar y de hacer respetar el Derecho Internacional Humanitario (DIH). En este libro se analiza si la Unión Europea (UE) y dos de sus Estados Miembros –Francia y España– ejecutan su obligación de hacer respetar el DIH. Concretamente, se trata de analizar cómo dos corpus jurídicos originalmente indiferentes el uno del otro, el DIH y el Derecho de la Unión, llegaron a converger y entrelazarse. Se sostiene que la aplicación del DIH ha de ser analizada desde una perspectiva multinivel. Mientras el DIH depende de los Estados para asegurar su efectividad, el proceso de integración europea obliga a añadir el nivel supranacional: la UE. Esta configuración genera un círculo virtuoso de cumplimiento del DIH según el cual la autoridad jurídica del Artículo 1 Común queda reforzada, lo cual conlleva una mejor implementación del DIH. Asimismo, la UE proyecta sus valores en la escena internacional y se ve reforzada en su calidad de líder en materia de derechos humanos. Además, la UE constituye un nivel adicional tanto de garantía como de actuación para sus Estados Miembros, que la usan para dar efecto a sus obligaciones derivadas del DIH. Se sostiene pues, que la UE se ha establecido como un actor esencial del DIH en la escena internacional. La UE –un autoproclamado líder en materia de derechos humanos– y sus Estados Miembros no solamente quedan vinculados por el Artículo 1 Común, sino que han aceptado de ejecutar su mandato de manera efectiva en la escena internacional.

De nombreux aspects de la famille sont sous influence européenne, au point que l’on voit se dessiner les contours d’une « famille européenne ». L’ouvrage propose de mettre en lumière l’acquis européen en matière de droit de la famille, au prisme du droit matériel (citoyenneté européenne, politique sociale de l’Union, fonction publique européenne...), comme du droit international privé. Le droit de la famille de l’Union s’identifie alors comme un «droit spécial» complétant la diversité des droits nationaux de la famille. Sa signification théorique et politique dans l’Union est débattue par les auteurs, autant que son devenir. Loin de demeurer fragmentaire à côté des droits nationaux des États membres, il a probablement vocation à se densifier pour offrir aux citoyens et résidents européens un droit commun de la famille au sein de l’Union. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.

Book excerpt: Lumumba as a symbol of decolonisation and as an icon in the arts It is no coincidence that a historical figure such as Patrice Emery Lumumba, independent Congo’s first prime minister, who was killed in 1961, has lived in the realm of the cultural imaginary and occupied an afterlife in the arts. After all, his project remained unfinished and his corpse unburied. The figure of Lumumba has been imagined through painting, photography, cinema, poetry, literature, theatre, music, sculpture, fashion, cartoons and stamps, and also through historiography and in public space. No art form has been able to escape and remain indifferent to Lumumba. Artists observe the memory and the unresolved suffering that inscribed itself both upon Lumumba’s body and within the history of Congo. If Lumumba – as an icon – lives on today, it is because the need for decolonisation does as well. Rather than seeking to unravel the truth of actual events surrounding the historical Lumumba, this book engages with his representations. What is more, it considers every historiography as inherently embedded in iconography.
